WHEREAS, the City of Fort Worth, Texas, a municipal corporation
organized and existing under the laws of the State of Texas and its
home -rule charter (hereinafter called "Fort Worth "), and the City
of Euless, Texas, a municipal corporation organized and existing
under the laws of the State of Texas and its home -rule charter
(hereinafter called "Euless "), have entered into a Water and Sewer
Line Agreement, a copy of which is attached hereto as Exhibit "A"
and incorporated herein by reference; and
WHEREAS, pursuant to such Agreement and the obligations of the
respective cities set forth therein, Euless has agreed to transfer the
ownership of certain water and sewer improvements to Fort Worth upon
the occurrence of certain events and the fulfillment of certain
obligations all as provided in such Agreement; and
WHEREAS, pursuant to such commitments and by the adoption of
this Resolution, Euless desires to transfer ownership of certain
such water and sewer improvements to Fort Worth.
NOW, THEREFORE, be it resolved by the City Council of the City
of Euless, Texas, in regular session duly convened, that:
The City of Euless, Texas, by and pursuant to the Agreement
hereinabove referenced, has quitclaimed and by these presents does
quitclaim unto the City of Fort Worth, Texas, and its successors, all
right, title and interest of the City of Euless, Texas, in and to ,the
existing water and /or sewer improvements more particularly described in
Exhibit "B" hereto, which Exhibit is incorporated herein by reference
as though set forth in full, together with any right, title and
interest of.the City of Euless, Texas, in and to any easements
appurtenant to such improvements for the purposes of maintenance,
repair and replacement of such improvements, to have and to hold
all of the right, title and interest of the Ciy of Euless, Texas,
in and to such improvements and the easements and rights -of -way
appurtenant thereto for the purposes above noted and in any manner
belonging unto the said City of Euless, Texas, its successors and
assigns.
ADOPTED by the City Council of Euless, Texas, at a regularly
scheduled meeting on this the 12th day of August , 198 0
by a vote of 5 ayes, 0 nays and 0 abstentions.
