HomeMy WebLinkAbout2023-09-12MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, September 12, 2023 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:32 p.m. on Tuesday, September 12, 2023, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tern Eddie Price, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, Harry Zimmer, and Tika Paudel. During the Precouncil meeting: ➢ Mayor Martin expressed her appreciation and recognized City staff for their efforts to assist the Saleh family with the coordination of the Celebration of Life event held in honor of Mary Lib Saleh, former Mayor of the City. She stated that the service was beautiful, and the family was extremely appreciative of the care and thought shown by the City staff in honoring their mother and "Mimi." ➢ Council Member Paudel expressed his appreciation to City staff for their assistance with hosting the blood donation event held on August 6, 2023, at the Mary Lib Saleh Euless Public Library. He advised that a total of 128 people donated blood at the event. ➢ City Manager Loretta Getchell advised of the following upcoming events: • Flu Shots, September 19 and September 20, 2023, 9 to 11 a.m., City Hall; and City of Euless Quarter Century and Retiree Dinner, Friday, September 15, 2023, 6:30 p.m., Texas Star Conference Centre. ➢ City Manager Loretta Getchell reviewed the regular agenda. ➢ Police Chief Mike Brown introduced Assistant Police Chief Gary Landers. Assistant Police Chief Landers advised that the crash attenuator is fully operational and ready to be deployed when necessary. He expressed his appreciation to the Mayor and City Council for their support of the project. Additionally, he recognized Andy and Debi Chesney, B & B Wrecker Service, Inc., for the donation of a vehicle to deploy the crash attenuator. He stated that the equipment is available 24 hours a day, 7 days a week, and will be delivered to a highway crash site when necessary to protect the Euless public safety personnel when responding to incidents. In closing, he invited the Mayor and City Council outside to inspect the crash attenuator. ➢ Director of Planning and Economic Development Michael Warrix presented a Development update, including commercial and residential developments. Council Minutes Page 2 of 8 September 12, 2023 ➢ City Manager Getchell presented the Financial report. She advised that sales tax collection was up 1.1 percent for the month of July compared to the same period in the prior year and up 3.6 percent year to date. Additionally, car rental tax collection was down two percent for the month of July when compared to the same period in the prior year and up four percent year to date. COUNCIL CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The regular meeting of the Euless City Council was called to order by Mayor Martin at 7:00 p.m. for consideration of scheduled items. PRESENTATION OF EMPLOYEE SERVICE PINS Police Chief Mike Brown introduced Senior Police Officer Tyler Killman. Tyler was accompanied by members of the Police Department. Mayor Martin presented Tyler with a service pin commemorating his 10 years of service with the City. Director of Public Works and Engineering Major Jones introduced Crew Lead Ross Baugess. Ross was accompanied by his wife, Tracey. Mayor Martin presented Ross with a service pin commemorating his 10 years of service with the City. CONSENT AGENDA (items 2 throu_ah 7) Mayor Martin asked Deputy City Manager Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 2 through 7. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 2. REJECTED ALL BIDS FOR BID NO. 014-23 Rejected all bids for Bid No. 014-23 for the construction of the Parks at Texas Star North Gateway Signage due to all bids exceeding the projected budgeted cost. ITEM NO. 3. AUTHORIZED THE PURCHASE OF THIRD -PARTY PLAN AND REVIEW INSPECTION SERVICES Authorized the purchase of Third -Party Plan Review and Inspection Services from Bureau Veritas North America, Inc., 100 East 15th Street, Suite 620, Fort Worth, Texas. The purpose of this agreement is to provide assistance to the City's Planning and Economic Development Department on an as need basis. The estimated expenditure is $100,000. ITEM NO. 4. RATIFIED CITY MANAGER TO PURCHASE POLICE PATROL UNITS Ratified City Manager action to proceed with the purchase of three police pursuit units from Allen Samuels of Hutchinson, Kansas, 1421 East 30th Avenue, Hutchinson, Kansas to replace three total -loss vehicles. In accordance with Chapter 252.022 of the Texas Local Government Code, the purchase is the result of unforeseen damage to public machinery and equipment, and that the procurement is necessary to protect the safety of the City's residents. The estimated expenditure is $130,500. Council Minutes Page 4 of 8 September 12, 2023 ITEM NO. 5. APPROVED DONATION OF THE 2005 SUTPHEN QUINT FIRE APPARATUS Authorized the donation of the 2005 Sutphen Quint Fire Apparatus to the Tolar Volunteer Fire Department through the Texas Forest Service "Helping Hands" program. ITEM NO. 6. AUTHORIZED MAYOR TO NEGOTIATE AND EXECUTE CONVEYANCE DOCUMENTS Authorized the Mayor to negotiate and execute conveyance documents for the purchase of property located at Midway Park Addition No. 2, Block B, in Euless, Texas. ITEM NO. 7. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of August 21, 2023. REGULAR AGENDA ITEM NO. 8. APPROVED A REQUEST FOR A TEMPORARY USE PERMIT NO. 23-05-CC Director of Planning and Economic Development Michael Warrix advised that St. John the Baptist Greek Orthodox Church is seeking a Temporary Use Permit to host the 31st Annual Mid -Cities Greek FoodFest on the church grounds. Mr. Warrix reviewed the festival layout, parking arrangements, and the dates and hours the event will be held. George Vittas, representing St. John the Baptist Greek Orthodox Church, was present to address any questions regarding the request. Council Member Bynum motioned to approve Temporary Use Permit No. 23-05-CC for a Greek Food Festival to be located on Alexander and Cullum Subdivision, Lot 6R and Lot 7R, 303 Cullum Drive, for four consecutive days, beginning on October 12, 2023 and concluding on October 15, 2023. Mayor Pro Tern Price seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 9. APPROVED SITE PLAN NO. 23-05-SP Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant, Quiddity Engineering, LLC, is seeking approval for a Salad and Go drive-thru restaurant on 0.896 acres in the Glade Parks Addition, Block E, Lot 1, 2120 Rio Grande Boulevard. Mr. Warrix reviewed the access to the site, Council Minutes Page 5 of 8 September 12, 2023 parking, pedestrian paths, landscaping, lighting, and building elevations and materials. The Planning and Zoning Commission considered the site plan at their regular meeting on August 15, 2023, and voted 6-0-0 to recommend approval. Ryan Alcala, Project Engineer, Quiddity, was present to address any questions regarding the item. Council Member Stinneford inquired about the placement of trees next to a storm drain on the southwest quadrant of the development and his concern regarding the soil erosion. Mr. Alcala advised that he is aware of the soil erosion next to the storm drain and advised that the area will be compacted and paved and the proposed trees will not be at risk due to soil erosion. Council Member Tompkins requested that, due to the availability of a walk-up window, consideration be given to adding an outdoor trash receptacle for patrons to dispose of trash and debris. Council Member Bynum motioned to approve Site Plan 23-05-SP, for a drive-thru restaurant at Glade Parks Addition, Block E, Lot1, 2120 Rio Grande Boulevard. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 10. APPROVED SITE PLAN NO. 23-09-SP Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant, Khalid Mahmood, is seeking approval for a convenience store with gasoline sales to be located at Franklin Levy Survey, Abstract No. 513, Remainder of Tract 2, 101 West Mid -Cities Boulevard. A site plan for this development was approved by City Council on November 10, 2020, however, as a result of construction inactivity the site plan expired in 2021. Mr. Warrix reviewed the site access, parking, pedestrian paths, landscaping, lighting, and building elevations and materials. The Planning and Zoning Commission considered the site plan at their regular meeting on September 5, 2023, and voted 6-0-0 to recommend approval. Council Member Bynum expressed the following concerns with regard to the proposed development: 1. Increased traffic at the Mid Cities Boulevard and Main Street intersection; 2. Accumulation of trash and debris on the City's green space located directly behind the business; Council Minutes Page 6 of 8 September 12, 2023 3. Concern regarding proposed placement of tree on right hand corner as it relates to the visibility of drivers attempting to make a right-hand turn; and 4. Failure of bicycle rental clients to return the bicycles and the possibility of abandonment of the bicycles in other parts of the City. In response to a question from Council Member Tompkins, Mr. Warrix advised that the proposed landscaping plan meets the square footage, planting, and irrigation requirements of the City's Unified Development Code (UDC). The developer is required to maintain the landscaping (trees, shrubs, groundcover, etc.) as approved by the City Council. Council Member Stinneford inquired about the timeline for construction. Mr. Warrix responded that the applicant intends to apply for the building permit immediately upon approval of the site plan by the City Council. Council Member Stinneford motioned to approve Site Plan 23-09-SP for a commercial development on 1.15 acres in the Franklin levy Survey, Abstract No. 513, Remainder of Tract 2, 101 West Mid -Cities Boulevard. Council Member Paudel seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Zimmer, and Paudel Nays: Council Member Bynum Mayor Martin declared the motion carried. ITEM NO. 11. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 23-10-SP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2363 Mayor Martin opened the public hearing at 7:26 p.m. Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant, Hassan Family Trust, is seeking a Specific Use Permit (SUP) for a place of worship to be located at Euless Gardens, Block 1, Lot 1, Suite A, 203 South Ector Drive. The Planning and Zoning Commission held a public hearing on August 15, 2023, and voted 6-0-0 to recommend approval of the SUP with the following conditions: 1. The Specific Use Permit is tied to the facility name, Islamic Center of Euless; 2. The Specific Use Permit is tied to the facility owner, Hassan Family Trust; and 3. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin asked to hear from any proponents followed by opponents of the case. Council Minutes Page 7 of 8 September 12, 2023 Kamaal Imam, 13249 Vista Glen Lane, Fort Worth, expressed his support for the case. There being no others requesting to speak, Mayor Martin closed the public hearing at 7:29 p.m. Council Member Bynum requested that the applicant be advised of the letter of opposition related to concerns regarding parking from a neighboring commercial property owner, Vaquero Ector Partners, LP. Mr. Warrix advised that staff intends to speak with the applicant to encourage the applicant to contact the neighboring property owners to alleviate any concerns they may have regarding parking. Council Member Paudel motioned to approve Ordinance No. 2363, authorizing the issuance of a Specific Use Permit for a place of worship to be located at Euless Gardens, Block 1, Lot 1, Suite A, 203 South Ector Drive, in the Texas Highway 10 Multi -Use (TX- 10) zoning district with the conditions presented and recommended by the Planning and Zoning Commission. Council Member Bynum seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 12. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2364 Council Member Tompkins motioned to approve Ordinance No. 2364, appointing Tim Murphy and Terri Pearce to serve as the Associate Judges of the Municipal Court of Record. Mayor Pro Tem Price seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 13. PUBLIC COMMENTS Linda McKinnon, 101 Arbor Creek Drive, Euless, addressed the City Council requesting the City's assistance to devise a plan to address the parking concerns of the residents of the Arbor Glen subdivisions as it relates to parents/caregivers picking up students from Council Minutes Page 8 of 8 September 12, 2023 the nearby elementary school, and address a safety concern by students not utilizing the crossing walks when crossing the street. Darl Easton, 1005 Fayette Drive, Euless, addressed the City Council regarding the budget, the audit, and conducting the budget worksessions within the City. He expressed his appreciation to City Manager Getchell for meeting with him to discuss the correlation between the budget and the audit. ITEM NO. 14. REPORTS Citv Manager No report given. Citv Council Mayor Martin advised that the Euless Citizens Police Academy Alumni Association (ECPAAA) will be hosting a bar-b-que Dinner and live auction on Saturday, September 23, 2023, 6 to 8:30 p.m. at the Euless Family Life Center. Tickets can be purchased from any ECPAAA member. Additionally, she advised that the City Council is accepting Board and Commission applications for various volunteer positions and the deadline to apply is October 5, 2023. ITEM NO. 15.
