HomeMy WebLinkAbout2366 10-24-2023ORDINANCE NO. 2366 AN ORDINANCE AMENDING THE CITY OF EULESS ZONING MAP BY CHANGING THE ZONING FROM NEIGHBORHOOD BUSINESS (C-1) ZONING DISTRICT TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT ON CEDAR HILL ESTATES ADDITION, BLOCK 8, LOTS 20 & 21, LOCATED AT 702 SOUTH MAIN STREET AND 704 SOUTH MAIN STREET; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATION; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on October 3, 2023, in conjunction with Planned Development Case No. 23-06-PD, and has rendered a recommendation to the City Council with respect to this case; and WHEREAS, City Council has conducted a public hearing on October 24, 2023, has considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless and that any foreseeable negative impacts of the proposed use have been mitigated through design restrictions or other set conditions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1. ALLOWED USES. The City of Euless Zoning Map is amended to read so that the zoning district classification for Cedar Hill Estates Addition, Block 8, Lots 20 and 21 is Planned Development (PD) zoning district based on Single Family Detached Dwelling (R- 1) zoning district regulations. This Planned Development Ordinance has the following Development Standards: (i) the subject properties are rezoned from Neighborhood Business (C-1) zoning district to Planned Development (PD) zoning district and are required to comply with the Single Family Detached Dwelling (R-1) zoning district standards, and (ii) a new residential driveway is allowed direct access to South Main Street (an arterial) and the driveway must be shared by both lots. SECTION 2. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Chapter 1, "General Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 4. PUBLICATION CLAUSE. The caption, penalty clause, and effective date clause of this ordinance shall be published in a newspaper of general circulation in the City of Euless, in compliance with the provisions of Article II, Section 12, of the Euless City Charter. Further, this ordinance may be published in pamphlet form and shall be admissible in such form in any court, as provided by law. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. The City Council hereby with the adoption of this ordinance establishes the storm water utility fees as set forth in Chapter 13 "Utilities" of the River Oaks Code of Ordinances (2006) as amended, specifically in Section 13.12.012 "Storm Water Utility Fees" to read as follows: "Section 13.12.012 Stormwater Utility Fee. Storm Water utility fees provid- ed for in Chapter 13 "Utilities", Article 13.12 "Storm Water Utility System" of the City of River Oaks Code of Ordi- nances (2006) as amended are calcu- lated based on the total storm water runoff potential for improved parcels for each customer class within the City measured as impervious area in square feet (SF). The total storm water runoff potential shall be divided into the two (2) customer classes of residential and non-residential based on the relative amount of impervious area in each class. (a) Residential Property Fees. Stomm water utility fees for residential prop- erty, as defined in Article 13.12, shall be calculated for each dwelling unit at the following flat rate per dwelling unit: (1) Residential Property: Fee = $ 7.00 per dwelling unit per month (2) Non-residential Property Fees.
