HomeMy WebLinkAbout83-546 04-26-1983RESOLUTION NO. 83 -546 WHEREAS, cable television legislation (Senate Bill 66) was introduced in the United States Senate on January 26, 1983; and, WHEREAS, the National League of Cities Board of Directors adopted a proposed promise with the National Cable Television Association on March 6, 1983; and, WHEREAS, if enacted, this legislation, as amended by the proposed compromise, would preempt regulatory authority of local governments over cable television operations; and, WHEREAS, this bill and the compromise would void provisions of the franchise agreement between the City of Euless and Storer Cable Communications Company, severely limit regulation of cable television by local governments, and increase the authority of the Federal Communications Commission over local cable activities; and, WHEREAS, the bill and the compromise also would prohibit regulation of program content, render null and void all laws or regulations inconsistent with pro- visions of the proposed legislation, and grant automatic rate increases to the cable franchise; and, WHEREAS, regulatory jurisdiction over cable television should be primarily the concern and the responsibility of local governments; and, WHEREAS, and legislation limiting the regulatory authority of local governments over cable television operations would restrict the ability of local govern- ments to respond to the needs of Euless citizens. Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF TIM CITY OF EULESS: SECTION 1. That the Mayor of the City of Euless is authorized to correspond with the Texas Congressional Delegation and other cities of like persuasion and to express the concerns of the Euless City Council and opposition to this legislation and the proposed compromise. SECTION 2. That the City Attorney and the City Manager are authorized to take appropriate action to oppose enactment of this legislation, the proposed cony promise and any future legislation which would preempt regulatory authority of local governments over cable television. SECTION 3. That this Resolution shall take effect immediately from and after its passage and is accordingly resolved.
