HomeMy WebLinkAbout2023-11-28MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, November 28, 2023 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:30 p.m. on Tuesday, November 28, 2023, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tern Eddie Price, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, Harry Zimmer, and Tika Paudel. During the Precouncil meeting: ➢ Council Member Paudel expressed his appreciation to the Police Department for their assistance related to a citizen's situation. ➢ Mayor Martin expressed her appreciation for the new signal light sequencing that was implemented on Industrial Boulevard (FM 157). ➢ Director of Parks and Community Services Duane Strawn introduced Elizabeth Johnson as the new Assistant Director of Parks and Community Services. ➢ City Attorney Wayne Olson introduced Bessie Bronstein, Associate Attorney, Taylor Olson Adkins Sralla and Elam (TOASE). ➢ City Secretary/Chief Governance Officer Kim Sutter advised of the resignation of Richard Barker, Planning and Zoning Commission, Place 7, and advised that discussion will be included in the closed session of the December 12, 2023 meeting. ➢ City Manager Loretta Getchell advised of several upcoming events: • Euless Police and Courts Annual Christmas Dinner, Friday, December 1, 2023, 5 to 8 p.m., Euless Police Department; • Euless Parade of Lights, Saturday, December 2, 2023, 6:30 p.m.; • Retiree Reception, Friday, December 8, 2023, 10 to 11 a.m., Euless Family Life Senior Center; • Employee Christmas Party, Friday, December 8, 2023, 11 a.m. to 2:30 p.m., Euless Family Life Senior Center; • Breakfast with Santa, Saturday, December 9, 2023, 8:30 to 11 a.m., Texas Star Conference Centre; • Salvation Army Mayoral Challenge, Saturday, December 9, 2023, 11 a.m. to 1 p.m., Kroger, 1060 North Main Street; and • Heritage Park Christmas, Saturday, December 9, 2023, 11 a.m. to 3 p.m., Heritage Park. Additionally, she advised that the City has held discussions with the City of Hurst to enter into an Interlocal Agreement related to joint jail services, including the transfer Council Minutes Page 2 of 10 November 28, 2023 of employees. The proposed Interlocal Agreement and a budget adjustment will be placed on the December 12, 2023 meeting agenda for consideration. Deputy City Manager Chris Barker advised of a hydrated lime spill that occurred at the Nepali Cultural and Spiritual Center. He stated that due to the swift action of the Fire Department, Police Department, Public Works, and a hazmat team, the spill was contained quickly. Any damages caused by the spill will be the responsibility of the contractor. ➢ City Manager Loretta Getchell reviewed the regular agenda. ➢ Deputy City Manager Barker introduced Robert Hinkle, Director of Corporate Affairs, North Tarrant Express (NTE) Mobility Partners, LLC and Tommy Williamson, Public Relations Manager, North Tarrant Infrastructure. Mr. Williamson introduced Ignacio Milans, Chief Executive Officer, North Tarrant Infrastructure, Nicola Osio, Vice President of Construction, North Tarrant Infrastructure, Daniel Longoria, Construction Manager, North Tarrant Infrastructure, Pablo Ferrando, Chief Operating Officer, NTE Mobility Partners, LLC. Mr. Williamson addressed the City Council regarding the North Tarrant Express (NTE) Project Expansion and addressed questions and concerns regarding the current configuration as well as the proposed expansion timeline. Police Chief Mike Brown emphasized the City's concerns with the current design as the City has lost six police squad vehicles within the last six months when responding to calls for service along State Highway 183 (SH183). Additionally, it is the City's understanding that the Cities of Hurst and Bedford have lost a combined total of five vehicles within the same timeframe. The cost of the losses is bore by the City with no provisions for reimbursement by the State and/or the NTE. It is believed that failure to expand Segment 2E (State Highway 183 (SH183) from Industrial Boulevard (FM157) to President George Bush Turnpike) in conjunction with Segment 1 will result in further equipment losses as well as increased injuries and fatalities. Mr. Hinkle advised that he is committed to working with the City to address the concerns and issues as they relate to Segment 2E. ➢ Risk Manager Connie Scott presented the proposed updates to the City's Americans with Disabilities Act (ADA) Transition Plan, including completed projects and projects that have been scheduled for future years. She recognized Engineering Technician Caleb Williams for his assistance with updating the plan. ➢ Director of Planning and Economic Development Michael Warrix presented the Development update, including commercial and residential developments. Council Minutes Page 3 of 10 November 28, 2023 ➢ Director of Public Works and Engineering Major Jones presented a Capital Projects update. He also advised the Council of a proposed high-water detection system to be installed at Bear Creek Parkway, Kynette Drive, and Marlene Drive, and advised that the system will activate warning signs and lights when high water levels are detected. CLOSED SESSION The City Council convened into closed session at 6:22 p.m. for deliberation regarding the following: As authorized by Section 551.071 of the Texas Government Code, the City Council reserves the right to adjourn into Closed Session at any time during the course of this meeting to consult with its attorney regarding any of the matters listed on the agenda and to seek legal advice related to possible contract regarding jail services, and pending or contemplated litigation or a settlement offer, including: • PFAS Litigation — Dupont, Chemours, Corteva, and 3M Settlements Deliberate the purchase, exchange, lease or value of real property as authorized by Section 551.072 of the Texas Government Code related to: ® 331 N. Main Street, 411 N. Main Street, and 201 W. ITEM NO. 1. PRESENTATION OF EMPLOYEE OF THE MONTH FOR DECEMBER 2023 Police Chief Mike Brown introduced Inspector I Brigitte McClay. Brigitte was accompanied by her husband, Ian, son, Jet, members of the Police Department, and the Code Compliance Division. Mayor Martin presented Brigitte with a plaque commemorating her selection as Employee of the Month for December 2023. ITEM NO. 2. PRESENTATION OF CERTIFICATES TO FIRE PREVENTION POSTER WINNERS Fire Marshal Drew Washington gave a brief history of the Fire Safety Poster Contest and introduced the grand prize winners for each grade level: First Grade: Ignatius Wanjohi, South Euless Elementary Second Grade: Ammaar Saheem, Harmony School of Innovation Third Grade: Matthius McKone, Oakwood Terrace Elementary Fourth Grade: Yubrissa Gonzalez-Retana, North Euless Elementary Fifth Grade: Taua'ana Duffy, Wilshire Elementary Sixth Grade: Vatiu Mahe, Midway Park Elementary Council Minutes Page 5 of 10 November 28, 2023 Mayor Martin and Fire Chief Chanc Bennett presented each grand prize winner with a certificate and a goody basket. PRESENTATION OF FINANCIAL REPORT FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2023 Finance Director Janina Jewell presented the financial report (preaudit) for the Fiscal Year ending September 30, 2023, CONSENT AGENDA (items 4 throu_ah 10) Mayor Martin asked Deputy City Manager Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 4 through 10. Council Member Tompkins seconded the motion. APPROVED RENEWAL OF BID NO. 012-22 Approved renewal of Bid No. 012-22 for the annual contract for janitorial services to CTJ Maintenance, Inc., 6565 North MacArthur Boulevard, Suite 225, Irving, Texas. This request represents the first of four additional one-year renewals. The estimated annual expenditure is $155,428. ITEM NO. 5. APPROVED AWARD OF BID NO. 013-22 Approved renewal of Bid No. 013-22 for Professional Employee Leasing services at Texas Star Golf Course and Conference Centre to Key2Cash, LLC, dba K2 POE, a Roberts GroupNensure Employee Solutions, 12225 Greenville Avenue, Suite 300, Dallas, Texas. This request represents the first of three additional one-year renewals. The estimated annual expenditure is $1,658,328. ITEM NO. 6. APPROVED A JOB ORDER CONTRACT Approved a Job Order Contract with Payne Mechanical Services, 2345 Dalworth Street, Suite 108, Grand Prairie, Texas, through The Interlocal Purchasing System (TIPS) for the replacement of seven HVAC split systems. AUTHORIZED THE MAYOR TO EXECUTE A LEASE ASSIGNMENT AND ASSUMPTION AGREEMENT Authorized the Mayor to execute a Lease Assignment and Assumption Agreement by and between the Euless Development Corporation (EDC), the City of Euless, U.S. Concrete, Inc. and its subsidiary Redi Mix, LLC., and Smyrna Ready Mix Concrete, LLC, for property located at 331 North Main Street and ratified the action of the EDC to authorize the same by its President. ITEM NO. 8. RATIFIED ACTION OF THE EULESS DEVELOPMENT CORPORATION (EDC) Ratified action of the EDC to authorize the EDC President to execute a Lease Assignment and Assumption Agreement by and between EDC, U.S. Concrete, Inc., and Smyrna Ready Mix Concrete for property located at 411 North Main Street. ITEM NO. 9. AUTHORIZED THE MAYOR TO EXECUTE A LEASE ASSIGNMENT AND ASSUMPTION AGREEMENT Authorized the Mayor to execute a Lease Assignment and Assumption Agreement by and between the City of Euless, Euless, Texas, and U.S. Concrete, Inc. and Smyrna Ready Mix Concrete for property located at 201 West Euless Boulevard. ITEM NO. 10. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of November 14, 2023. REGULAR AGENDA ITEM NO. 11. APPROVED SITE PLAN NO. 23-03-SP Director of Planning and Economic Development Michael Warrix presented the item to the City Council and advised that the applicant, Paradigm Consulting, is seeking approval for the expansion of St. Abanoub Coptic Orthodox Church located at Cedar Hill Estates, Block 9, Lot 18R, 850 South Main Street, in the Single Family Detached Dwelling (R-1) zoning district. Mr. Warrix reviewed the access to the site, parking, landscaping, lighting, building materials, and elevations. The Planning and Zoning Commission considered the Site Plan at their regular meeting on November 7, 2023, and voted 4-0-1 to recommend approval. Awad Eskander, Sammy Eskander, and Father Titus Necola, representing St. Abanoub Coptic Orthodox Church, were present to address any questions regarding the item. In response to the questions raised by Council Members Stinneford, Tompkins, and Bynum, Mr. Eskander advised that they had reached out to many of the residents within Council Minutes Page 7 of 10 November 28, 2023 the neighborhood advising of the proposed expansion. He also stated that the primary purpose of the new building is to provide a more spacious and dedicated place to hold Sunday school classes and that the existing parking lot will be repaved and restriped during the construction of the new building. Lee Ann Folau, 800 Henslee Drive, addressed the Council with concerns about the parking and traffic on Henslee Drive during the Church's services. Mr. Eskander followed by stating that the expansion will also add parking spaces to help eliminate the congestion and parking issues along the neighborhood streets. Council Member Stinneford motioned to approve Site Plan 23-03-SUP for the expansion of St. Abanoub Coptic Orthodox Church located at Cedar Hill Estates, Block 9, Lot 18R, 850 South Main Street. Council Member Zimmer seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 12. HELD A PUBLIC HEARING REGARDING SPECIFIC USE PERMIT CASE NO. SUP23-001 AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2369 Mayor Martin opened the public hearing at 7:41 p.m. Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant, Jordan Stone, has acquired ownership of the franchise store Uptown Cheapskate located at Glade Parks Addition, Block K, Lot 4R1, 1220 Chisholm Trail, Suite 200, and is seeking a new Specific Use Permit (SUP) to reflect the change in ownership. The Planning and Zoning Commission held a public hearing on November 7, 2023, and voted 4-0-1 to recommend approval of the SUP with the following conditions: 1) The Specific Use Permit is tied to the business name, Uptown Cheapskate; 2) The Specific Use Permit is tied to the business owner, Jordan Stone; 3) All merchandise shall be displayed within the store and not exterior to the building; 4) Any customer bringing items to be sold to the retail store shall bring such items interior to the store during business hours; 5) No items shall be left exterior to the store. Any such items shall be removed in a timely manner; and Council Minutes Page 8 of 10 November 28, 2023 6) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:44 p.m. In response to a question from Council Member Bynum, Jordan Stone, the applicant, advised that before moving to Euless, the store was originally set up in Colleyville, Texas, therefore the franchise license was issued as Colleyville Uptown Cheapskate, Council Member Paudel motioned to approve Ordinance No. 2369, authorizing the issuance of a Specific Use Permit for a used merchandise store to be located at Glade Parks Addition, Block K, Lot 4R1, 1220 Chisholm Trail, Suite 200, in the Planned Development (PD) zoning district with the conditions presented and recommended by the Planning and Zoning Commission. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 13. AUTHORIZED CITY MANAGER TO EXECUTE SECOND AMENDMENT TO RIVERWALKI AT EULESS DEVELOPMENT AGREEMENT City Manager Loretta Getchell presented the item to the City Council and advised that the second amendment is necessary to prescribe details of the Primary Water Feature to be used as an additional water storage facility for the City's reclaimed water system. Council Member Stinneford motioned to approve authorizing the City Manager to execute the Second Amendment to Riverwalk! at Euless Development Agreement. Council Member Bynum seconded the motion. AUTHORIZED CITY MANAGER TO EXECUTE FIRST AMENDMENT TO 380 AGREEMENT FOR DEVELOPMENT OF WATERCOLOR PLANNED DEVELOPMENT DISTRICT AND RATIFIED ACTION OF THE EULESS DEVELOPMENT CORPORATION (EDC) AUTHORIZING THE SAME BY ITS PRESIDENT (Secretary's Note: this item is a companion item to Agenda Item #13) Council Member Bynum motioned to authorize the City Manager to execute the First Amendment to 380 Agreement for Development of Watercolor Planned Development District and to ratify action of the Euless Development Corporation authorizing the same by its President. Council Member Paudel seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 15. APPROVED RESOLUTION NO. 23-1648 Mayor Pro Tem Price motioned to approve Resolution No. 23-1648, casting 13 votes for Rich DeOtte and 12 votes for Vince Puente, Sr., to serve as a Director on the Tarrant Appraisal District Board of Directors for a two-year term beginning January 1, 2024, Council Me- niber Zimmer seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 16. PUBLIC COMMENTS Lee Ann Folau, 800 Henslee Drive, addressed the City Council regarding her concerns related to traffic at the Main Street and State Highway 183 (SH183) overpass. Additionally, she suggested the City consider renaming a portion of Henslee Drive to address any confusion for visitors and individuals providing service to residents in the area. Council Minutes Page 10 of 10 November 28, 2023 City Manager Getchell advised Ms. Folau that City staff is happy to meet with her after the meeting to address her questions. ITEM NO. 17. Reservations are required; and • Heritage Park Christmas, Saturday, December 9, 2023, 11 a.m. to 3 p.m., Heritage Park. This is a free event. ITEM NO. 18.
