HomeMy WebLinkAbout86-628 04-22-1986RESOLUTION NO. 86-628 WHEREAS, actual preparation of the draft revised zoning ordinance is underway. The draft text is based upon responses from the policy questionnaire received through the first week of March, 1986; and WHEREAS, a total of twelve (12) responses have been received from the twenty (20) Policy Questionnaires mailed to the twenty (20) individuals representing the City of Euless (Council, P & Z and Staff). This constitutes a 60% response rate which seems to suggest a statistically significant response; and WHEREAS, of the 37 policies proposed by Code Technology Group, 35 received support by a majority of the respondents, 31 policies appear to have the support of the respondents, that is, anywhere from eight (8) to twelve (12) respondents supported those policies WHEREAS, Code Technology Group recommends that the Euless City Council adopt written planning and regulatory principles, concepts and policies. Those policies shall then be the basis for revising and updating the zoning and subdivision ordinance and developing the Euless Unified Development Ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Euless, Tarrant County, Texas, to accept the recommendation of Code Technology Group and adopt written planning and regulatory principles, concepts and policies that are summarized as follows: 1. The Euless Zoning Ordinance is intended to aid substantially in the implementation of the Comprehensive Plan. 2. The Euless Zoning map shall be gradually and systematically adapted to the goals and objectives of the Comprehensive Plan. 3. Cumulative zoning which is contrary to the planning foundation on which zoning should be based shall be eliminated and replaced by express purpose districting in accordance with the planning principles and concepts in the Comprehensive Plan. 4. Planning goals, objectives, policies and standards shall be added to the description of each district in order to more closely link zoning to planning. 5. Functionally related uses may be allowed in the same district, although they are not necessarily compatible, by the use of special use permits (i.e. churches and schools). 6. Some uses have such strong nuisance characteristics that they shall not be allowed in any zoning district except with an approved special use permit (i.e. sexually oriented uses). 7. Compatibility standards shall be developed and incorporated as overlay provisions into the Zoning Ordinance to take into account the need to protect residential areas and critical thoroughfares. 8. A unified development ordinance consolidating both the zoning Ordinance and Subdivision Rules and Regulations shall be developed in order to more effectively respond to market realities, to improve administration of land use regulations, and to avoid overlapping, conflicting or inconsistent ordinance provisions. 9. The ordinance shall be reorganized and make simpler and easier to understand and use. 10. Districts shall be consolidated, where possible, to simplify the ordinance and reduce its complexity. 11. Additional zoning districts shall be added to the ordinance in order to accommodate desirable forms of development (i.e. office park district). 12. Additional emphasis and requirements shall be placed on improving the visual image, aesthetics and the quality of life in Euless. 13. Greater emphasis shall be placed on encouraging the abandonment of non - conforming uses. 14. Zoning shall be used as a timing devise to ensure that service level standards are not reduced as a result of development. 15. Whenever possible, regulations shall be provided in the form of tables and charts in lieu of written text. 16. Graphics shall be used to illustrate definitions. 17. The symbols and nomenclature of each district shall be made more descriptive of the function and purpose of the district. 18. The list of permitted uses shall incorporate the use of the Standard Industrial Classification Manual. 19. Specific preventive restrictions shall be added to the Ordinance for unzoned property. 20. Off- street parking requirements shall be revised to meet recommended standards and loading regulations shall be made more comprehensive. 21. Minimum lot area, width and depth requirements and maximum height regulations shall be revised to confirm to recommended standards and /or local compatibility criteria. 22. Additional screening, landscaping and buffer yard requirements shall be developed to improve the visual appearance of the community and to minimize incompatibilities between district boundaries. 23. The Ordinance shall be reviewed on an annual basis and subject to a comprehensive review, evaluation and update every five years. 24. The Ordinance shall be updated to eliminate existing conflicts with State statutes and shall be reviewed after such legislative session. 25. The City Attorney shall be requested to prepare and submit a report each year that informs the Commission and Council of relevant court decisions that could impact the Ordinance. 26. Specific use requirements of public schools should be added to the low density residential districts. 27. A Planning report shall be prepared on the need to regulate sexually oriented businesses in Euless and the Ordinance updated if warranted in the report. 28. Performance standards shall be developed and added to the Ordinance. 29. Standards for controlling noise shall be incorporated into the Ordinance. 30. Private streets should be constructed in accordance with public street standards. 31. Spot and strip commercial zoning shall be discouraged. Adopted at a regular meeting of the City Council of the City of Euless on the 22nd day of April, 1986, by a vote of ayes, nays, and abstentions. APPROVED: Harold D.
