A RESOLUTION STATING THE PUBLIC BENEFITS ASSOCIATED WITH THE CITY'S
PARTICIPATION IN THE IMPROVEMENT OF HIGHWAY 157; ALLUDING TO THE STATE
DEPARTMENT OF HIGHWAY & PUBLIC TRANSPORTATION MINUTE ORDER NO. 85072;
AND FURTHER PROVIDING FOR THE PARTICIPATION BY THE CITY OF EULESS IN
THE IMPROVEMENT PROGRAM BY THE CONSTRUCTION OF CONTINUOUS CURB AND
GUTTER WHERE NONE NOW EXIST, STORM SEWERS AND OTHER ASSOCIATED
IMPROVEMENTS, ALL AS MAY BE NECESSARY FOR A COMPLETE PROJECT WITH THE
EXCEPTION OF PAVEMENT AND ITS SUPPORT AND THE PARTICIPATION BY THE
CITY OF EULESS IN THE CONSTRUCTION OF DRIVEWAYS AND SIDEWALKS WHERE
NONE NOW EXIST SHOULD THEY BE DEEMED NECESSARY, ALL IN ACCORDANCE WITH
THE PLANS OF THE STATE HIGHWAY DEPARTMENT; PROVIDING FOR PASSAGE AND
AN EFFECTIVE DATE.
WHEREAS, FM Road 157 is currently in need of improvement and widening
to accommodate the flow of traffic into and out of the corporate limits of
the City of Euless; and
WHEREAS, The North Arlington Levee Improvement District is currently
involved in the construction of major public improvements associated with
the construction of a levee that will impact and affect highway 157; and
WHEREAS, the State Highway Department has allocated appropriate
funding in at least the sum of Eight Million Nine Hundred Sixty -Four
Dollars ($8,000,964.00) to effectuate the improvement and widening of
Highway 157 in conjunction with the construction of the aforementioned
levee; and
WHEREAS, the other governmental entities, including the City of
Euless, who will be benefitted as a result of this project have been
requested to participate to some extent in the improvement program; and
WHEREAS, the Council, after review and study, is of the opinion that
participation by the City of Euless in this project would inure to the
benefit of the citizens of the City of Euless and would greatly relieve
existing traffic congestion on 157 and otherwise provide immediate and
long -term beneficial effects to the City of Euless and adjacent
communities:
NOW, THEREFORE,. BE IT RESOLVED That:
(a) the City of Euless, acting by and through its Council in the
passage of this Resolution, does agree to accept the terms and conditions
of the State Department of Highway & Public Transportation's Minute Order
No. 85072 and to work in conjunction with the plans and specifications of
the State Highway Department incident to the improvement of Farm -to- Market
Road 157 as it traverses the City of Euless.
(b) In the implementation of this Resolution, the City of Euless does
further agree to provide for the construction from State Highway 10 in
Euless along State Highway 157 to South Euless city limits of continuous
curb and gutter where none now exist, and storm sewers as may be required,
all as may be necessary for a complete project of the improvement of
Farm -to- Market Road 157 through the City of Euless, Texas, with the
exception of pavement and its support and further to assume responsibility
for the construction of driveways and sidewalks where none now exist should
they be necessary by the City of Euless now or in the future, all in
conjunction with the governing policies, plans and regulations of the State
Department of Highway & Public Transportations.
This Resolution shall become effective immediately upon its passage.

WHEREAS, in TARRANT COUNTY on FARM TO MARKET ROAD 157 from State Highway 10 to
the Trinity River, a distance of approximately 2.8 miles, the State Department
of Highways and Public Transportation is preparing plans for widening; and
WHEREAS, the North Arlington Levee Improvement District of Tarrant County is
proposing to develop the Trinity River Flood Plain east of Farm to Market Road 157,
from the old Rock Island Railroad (Rail Trans) to the Trinity River; and
WHEREAS, Tarrant County, the Cities of Arlington, Fort Worth, Euless and the
North Arlington Levee Improvement District would have certain responsibilities
in this project;
NOW, THEREFORE, the Engineer- Director is directed to tender the following
proposal to the Levee Improvement. District, Tarrant County and the Cities of
Arlington, Fort Worth and Euless:
Provided the North Arlington levee Improvement District will:
1. Provide fill material for the necessary embankment over the levee.
2. Provide any additional right of way for the ultimate facility within
the boundaries of the Levee Improvement District.
3. Provide a traffic impact analysis for the proposed development of and
its effects on Farm to Market Road 157.

4. Provide additional funds for any bridge in excess of the theoretical
bridge required to accommodate a 100 -Year flood, should the Levee
Improvement District desire such a structure. .
Provided the County will:
1. Secure all necessary right of way outside the jurisdiction of the
Levee District according to the policies of the State Department of
Highways and Public Transportation with acquisition procedures to be
in accordance with applicable Federal and State laws governing the
acquisition policies for acquiring real property.
2. Provide for the adjustment of utilities as may be required.
Provided the Cities will:
1. - Provide for the construction of continuous curb and gutter where none
now exist, storm sewers, etc., all as may be necessary for a complete -
project with the exception of pavement and its support.
2. Assume responsibility for the construction of driveways and sidewalks
where none now exist should they be deemed necessary now or in the
future and agree to make such installations in accordance with
governing policies and regulations of the Department.

3. Maintain that portion of the work which is its responsibility in
accordance with present maintenance agreements, and agree to regulate
traffic and prevent encroachment on the right of way, all in
accordance with governing policies and regulations of the Department.
The State Department of Highways and Public Transportation will:
1. Provide for construction at an estimated cost of $8,964,000.
2. Provide relocation assistance as may be determined to be eligible
under the Relocation Assistance Program, at an estimated cost of
$10,000.
3. Provide for the construction for the theoretical bridge required to
accommodate a 100 -Year flood.
Maintain that portion of the work which is its responsibility in
accordance with present maintenance agreements.
!Jpon acceptance of the provisions of this Order by the appropriate officials of
the North Arlington Levee Improvement District, Tarrant County and the Cities of
Arlington, Fort Worth and Euless, the Engineer - Director is directed to proceed
with development of plans for construction and after the.Improvement District,
the County and the Cities have fulfilled their responsibilities proceed with
construction in the most feasible and economical manner financing the cost ► with
funds previously approved in the 4 Year Letting Schedule of the 10 Year Project
Development Plan.
The Engineer - Director is also directed to enter into any necessary agreements
with the !forth Arlington Levee Improvement District of Tarrant County for their
portion of this project.
This Order shall become operative upon acceptance by the North Arlington Levee
Improvement District, Tarrant County and the Cities of Arlington, Fort Worth and
Euless and if not accepted within 90 days of the date hereof, the action herein
contained shall be automatically cancelled.
