WHEREAS, the City Council of the City of Euless recognizes
its obligation to provide for the health, safety and welfare
of its citizens; and
WHEREAS, the transportation of hazardous substances through,
and the storage of hazardous substances in the City of
Euless poses an inherent risk to the health, safety and
welfare of the citizens thereof if such materials should be
discharged into the environment; and
WHEREAS, the City Council of the City of Euless desires that
the City have available to it the power to institute liti-
gation, through its city attorney, to enjoin a violation of
Sec. 26.121 of the Texas Water Code, and to impose civil
penalties for such violations, in furtherance of its au-
thority to act to protect the health and safety of its
citizens.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Euless, that the city is hereby authorized, through
its city attorney, to institute suits in District Court for
injunctive relief or civil penalties or both, as authorized
by Sec. 26.124 of the Texas Water Code, against the party
who committed or is committing or is threatening to commit a
violation of Sec. 26.121 of the Texas Water Code.
PASSED AND APPROVED at a regular meeting of the Euless City
Council on the 10thday of February , 1987 by a
vote of 5 ayes, 0 nays, and 0
abstentions.
