Those present included Chairman: Steve Ellis Vice Chair: LuAnn Portugal, Commission Members: Curtis Brown, David Brown, Rubyann Crites, and Eric Owens. During the Pre -Session Meeting: ➢ Assistant Director of Planning and Economic Development, Lisa Payne reviewed agenda items number 2 and 3 and provided a brief Development Report. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS -- COUNCIL CHAMBERS The regular meeting of the Euless Planning and Zoning Commission was called to order by Chairman Steve Ellis at 6:30 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. Brown gave the invocation. THE PLEDGE OF ALLEGIANCE Commissioner Owens led the pledge of allegiance. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Commissioner D. Brown made a motion to approve the minutes of the regular meeting January 2, 2024. Vice Chair Portugal seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chair Portugal Commissioners C. Brown, D. Brown, Crites, and Owens. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-19- SUP Chairman Ellis opened up the public hearing on Specific Use Permit Case No 23-19-SUP at 6:32 p.m. Lisa Payne gave a brief description of the case. The applicant intends to remodel an existing structure on a 1.01-acre property on the northwest corner of W. Pipeline Rd. and Westpark Way in order to operate a church. A place of worship is only permitted in the C-2 zoning district with the approval of a Specific Use Permit (SUP). The church has provided conceptual plans of the property layout and appearance of the building after remodel. The one -:story building that was originally used as a residence that faced W. Pipeline Rd. will now be oriented toward the future church parking lot to the north. The front and back porches will be enclosed so they become part of the sanctuary, as shown on the floorplan, and commercial restrooms will be added. The area of the masonry building will increase from 1,505 SF to 1,768 SF. The property has an existing concrete driveway apron that the applicant will use as the access point from Westpark Way to the new concrete parking lot that will have twenty parking spaces, which exceeds the assembly parking requirement for a congregation of 50 people. Staff recommends approval of the Specific Use Permit, with the following conditions: 1. The Specific Use Permit is tied to the business name, Iglesia Evangelica De La Fe; 2. The Specific Use Permit is tied to the business owner, Jacinto Mendoza; and 3. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or bas been violated: Public hearing notification letters were mailed to surrounding property owners, and to date, staff has received no written responses. One phone call was received to protest. Chairman Ellis asked to hear from the applicant. Jacinto Mendoza applicant and Vanessa Escobar, church member and translator appeared to answer any questions. Chairman Ellis asked to hear from any proponents/opponents who wished to speak. There being none, Chairman Ellis closed the public hearing at 6:34 p.m. Vice Chair Portugal said she noticed they are from Irving area and if they would share the reason of purchasing in Euless. Ms. Escobar responded that they were unable to locate an Irving address within their budget. She added that they have Euless residents that attend their church and was able to purchase this property. Brown made a motion to approve Case No. 22-19-SUP for a Specific Use Permit for a place of worship proposed to be located on James M. Matson Survey, Abstract 1080, Tract 3C (2302 W. Pipeline Rd.) in Community Business (C-2) zoning district, and consider recommendation for an Ordinance. Commissioner Crites seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chair Portugal and Commission Members: C. Brown, D. Brown, Crites, and Owens. Nays: None Abstention: None Chairman Ellis declared the motion to approve Case No. 22-19-SUP carried. (6-0-0) ITEM 3. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 23-16- SUP Chairman Ellis opened up the public hearing on Specific Use Permit Case No 23-16-SUP at 6:36 p.m. Lisa Payne gave a brief description of the case. Stress Free Auto Care intends to operate a mechanic shop for general automotive repair in an existing building on the southwest corner of W. Euless Blvd. and Martha St. Such a use is only permitted in the TX-10 zoning district with the approval of a Specific Use Permit (SUP). ATL Total Car Care was granted an SUP for the same use in the same suite in November 2022. The existing building is 6,915 square feet in area, but the applicant is only going to use Suite 100, which is 3,475 square feet of space outfitted for auto repair. There is currently a convenience store in another suite in the building, but even'if a restaurant, which is the use with the highest parking requirement, fills all remaining space in the building outside of the auto repair shop, the property still exceeds the minimum parking requirement with 43 existing parking spaces. Stress Free Auto Care confirms all vehicle repair work will be performed inside the building and no outdoor storage is proposed. Seven to eight employees are anticipated and hours of operation will be Monday through Friday from 8:00 AM to 6:00 PM, Saturday from 8:00 AM to 5:00 PM, and closed on Sunday. Staff recommends approval of the Specific Use Permit, with the following conditions: 1) The Specific Use Permit is tied to the business name, Stress Free Auto Care; 2) The Specific Use Permit is tied to the business owner, Stress Free Auto Care, LLC; 3) There sha!I be no outdoor service or repair to any vehicle; 4) There shall be no outdoor storage of vehicles, car parts, or merchandise, to include the fire lane; 5) There shall be no on -site major mechanical or auto body work performed on any vehicle; and Planning and Zoning Commission Minutes Page 4 of 5 February 6, 2024 6) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit• has not been met or has been violated. Sherif Aronia, representative of Duke Partners appeared to answer any questions. Chairman Ellis asked to hear from any proponents/opponents who wished to speak There being none, Chairman Ellis closed the public hearing at 6:40 p.m. Commissioner Owens asked for clarification on the condition requiring no outdoor storage of vehicles. Mrs. Payne responded that a vehicle waiting for a minor service, such as an oil change, may wait in a parking space during business hours, but no junk vehicles or vehicles needing more extensive work may be stored outside of the building. She also stated that merchandise and parts, such as tires, may not be stored outside, especially not in the fire lane. There were no further questions or comments presented by the Commission. Commissioner Crites made a motion to approve Case No. 23-16-SUP a Specific Use Permit for a general automotive repair shop proposed to be located on Oakwood Terrace Addition, Lots 13113 and C1A (301 W. Euless Blvd.) in Texas Highway 10 Multi -Use (TX-10) zoning district, and consider recommendation for an Ordinance. Commissioner C. Brown seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chair Portugal and Commission Members: C. Brown, D. Brown, Crites, and Owens. Nays: None Abstention: None Chairman Ellis declared the motion to approve Case No. 23-16-SUP carried. (6-0-0) ITEM 4. PUBLIC COMMENTS There were no public comments presented.
