HomeMy WebLinkAbout2024-04-23MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, April 23, 2024 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:32 p.m. on Tuesday, April 23, 2024, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, Harry Zimmer, and Tika Paudel. Mayor Pro Tern Eddie Price was not present due to a scheduled absence. During the Precouncil meeting: ➢ Mayor Martin expressed her appreciation to the City Council Members and staff who had a role in organizing and who attended the reception welcoming the Prime Minister of Tonga Hu'akavameiliku Siaosi Sovaleni and the Tongan Ambassador Viliami V. Tone. She advised that the Prime Minister was impressed and pleased that the Tongan community has such a vibrant presence in the City. Council Members Stinneford and Bynum recognized Mayor Martin, the Texas Star Conference Centre staff, and City staff for a wonderful program. City Manager Loretta Getchell commented on how wonderful the food was and stated that pictures of the reception have been posted on the City's social media sites. ➢ Council Member Paudel on behalf of the Nepalese community, expressed his appreciation for the support from City staff during the Nepali Cultural and Spiritual Center's DFW Spiritual Festival. He advised that the event was successful and contributed to raising funds for the Cultural center. ➢ City Secretary/Chief Governance Officer Kim Sutter stated that early voting for the May general election began yesterday and continues through next Tuesday, April 30, 2024. She advised that designated voter parking will be available during the duration of the Arbor Daze event on Saturday, April 27, 2024. ➢ City Manager Getchell advised of several upcoming events: • Northeast Leadership Forum Awards luncheon, Wednesday, April 24, 2024, 11 a.m. to 1 p.m., City of Hurst Conference Center; • Police Corporal Jerry Cook's retirement reception, Friday, April 26, 2024, 1:30 p.m., Municipal Courtroom; • Arbor Daze Festival, Saturday, April 27, 2024, 10 a.m. to 9 p.m., Midway Park; • Concert in the Park: Lover (Taylor Swift tribute band), Friday, May 10, 2024, 7 p.m., Glade Parks; and • HEB Reads! kick-off, Saturday May 11, 2024, 10 a.m. to 1 p.m., Pennington Field; Council Minutes Page 2 of 8 April 23, 2024 City Manager Getchell advised that the public announcement for the H-E-B grocery store has been released, and that she has a meeting with store representatives and the City of Bedford to discuss finalizing the site design. City Manager Getchell provided a copy of the citizen's survey that will launch Friday, April 26, 2024, giving residents an opportunity to provide input for the Euless Parks Master Plan. The deadline to submit the survey is Wednesday, June 26, 2024. ➢ City Manager Getchell reviewed the regular agenda. ➢ Assistant City Manager Wes Rhodes presented the Community Powered Revitalization (CPR) update, highlighting that since its inception in 2009, 822 homes have been revitalized within the Hurst -Euless -Bedford and Grapevine area. He also advised that due to inclement weather the activities planned for Saturday, April 20, 2024, were rescheduled to Saturday, May 4, 2024. ➢ Marketing and Communications Manager Matt Sanders presented the Communications update with a focus on the City's digital presence. ➢ Director of Planning and Economic Development Michael Warrix presented a Development update, including commercial and residential construction. ➢ Director of Finance Janina Jewell presented a Financial report for the period ending March 31, 2024. CLOSED SESSION The City Council convened into closed session at 6:22 p.m. for deliberation regarding the following: The City Council reserves the right to adjourn into Closed Session at any time during the course of this meeting to consult with its attorney regarding any of the matters listed on the agenda, as authorized by Section 551.071 of the Texas Government Code. Mayor Martin recessed the closed session at 6:47 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The regular meeting of the Euless City Council was called to order by Mayor Martin at 7:00 p.m. for consideration of scheduled items. PRESENTATION OF EMPLOYEE OF THE MONTH FOR APRIL 2024 City Secretary/Chief Governance Officer Kim Sutter introduced Administrative Receptionist Jessica Newman. Jessica was accompanied by her husband, Luke, son, Ezra, parents, J.D. and Kay, and members of the City Secretary's Office. Mayor Martin presented Jessica with a plaque commemorating her selection as Employee of the Month for May 2024. Council Minutes Page 4 of 8 April 23, 2024 ITEM NO. 2. PRESENTATION OF PROCLAMATION Council Member Stinneford presented a proclamation proclaiming April as Child Abuse Prevention Month to Lisa Mund, Grants Coordinator, Alliance for Children. Ms. Mund expressed her appreciation to the Mayor and City Council. ITEM NO. 3. PRESENTATION OF PROCLAMATION Council Member Paudel presented a proclamation proclaiming May as National Water Safety Month to Director of Parks and Community Services Duane Strawn and Aquatic/ Senior Superintendent Rich Sharnsky. ITEM NO. 4. PRESENTATION OF QUARTERLY FINANCIAL REPORT FOR PERIOD ENDING MARCH 31, 2024 Director of Finance Janina Jewel presented the quarterly financial report for the period ending March 31, 2024. CONSENT AGENDA (items 5 through 10) Mayor Martin asked Deputy City Manager Chris Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 5 through 10. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 5. APPROVED RENEWAL OF BID NO. 010-23 Approved renewal of Bid No. 010-23 for the annual contract for citywide mowing maintenance to Smith Lawn and Tree, 3200 Handley Ederville Road, Richland Hills, Texas. The original bid was awarded for an initial term of one year with an option for three, one-year renewals. This request represents the first renewal. The estimated expenditure is $329,361, ITEM NO. 6. AUTHORIZED THE PURCHASE OF ASPHALT MILLING SERVICES Authorized the purchase of asphalt milling services from Dustrol, Inc., 2801 Highway 114, Fort Worth, Texas, and TexOp Construction LP, 8525 Thompson Road, Justin, Texas, through an Interlocal Agreement with Tarrant County. The contract is for a one-year period with the option to renew for two additional one-year periods. The estimated expenditure is $125,000. Council Minutes Page 5 of 8 April 23, 2024 ITEM NO. 7. APPROVED RESOLUTION NO. 24-1655 Approved Resolution No. 24-1655, supporting an application to establish a Municipal Setting Designation (MSD) for a tract of land located in the City of Grand Prairie, Texas at 1201 and 1205 Avenue H East and 1152 North Great Southwest Parkway, ITEM NO. 8. APPROVED RESOLUTION NO. 24-1656 Approved Resolution No. 24-1656, adopting the updated Water Conservation Plan for the City of Euless. ITEM NO. 9. APPROVED RESOLUTION NO. 24-1657 Approved Resolution No. 24-1657, agreeing to meet all match contribution requirements for the expenditures under the Tarrant County Home Investment Partnerships Program (HOME) for program year 2024. The required match contribution amount will not exceed $60,000. ITEM NO. 10. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of April 9, 2024. REGULAR AGENDA ITEM NO. 11. APPROVED SITE PLAN NO. 23-14-SP Assistant Director of Planning and Economic Development Lisa Payne presented the item to the City Council and advised that the applicant, Almighty Cleaning, is seeking approval to construct a 5,640 square foot office building on a 0.688-acre lot located at Cresthaven Addition, Block 1, Lot 16R, 908 Cresthaven Drive, in the Community Business (C-2) zoning district. Ms. Payne reviewed the site access, parking, landscaping, lighting, building materials, and elevations. The Planning and Zoning Commission considered the site plan at their regular meeting on April 2, 2024, and voted 7-0-0 to recommend approval. Charlene Hayes and Robert Harness, representing Almighty Cleaning, were present to address any questions regarding the item. Council Member Bynum motioned to approve Site Plan No. 23-14-SP for a 5,640 square foot office building to be located at Cresthaven Addition, Block 1, Lot 16R, 908 Cresthaven Drive. HELD A PUBLIC HEARING REGARDING SPECIFIC USE PERMIT CASE NO.24-02-SUP AND DENIED FIRST AND FINAL READING OF ORDINANCE NO. 2380 Mayor Martin opened the public hearing at 7:27 p.m. Assistant Director of Planning and Economic Development Payne presented the case to the City Council and advised that the applicant, Be at Peace Crematory, is seeking a Specific Use Permit (SUP) for a crematorium to be located at Baccarac Industrial Park, Block A, Lot 4R, 1509 Baccarac Court. The Planning and Zoning Commission held a public hearing on April 2, 2024, and voted 3-2-2 to recommend denial of the SUP. However, staff recommends approval with the following conditions: 1. The Specific Use Permit is tied to the business name, Be at Peace Crematory; 2. The Specific Use Permit is tied to the business owner, Jose de la Torre; 3. The crematory shall maintain compliance with all requirements of the Texas Commission on Environmental Quality (TCEQ), the Texas Funeral Service Commission, and the City of Euless; and 4. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Paul Wieneskie, Civil Appellate Attorney, Bailey & Galyen, representing the business owner addressed the City Council regarding the case. Jose de la Torre, owner of Be at Peace Crematory, was present to address any additional questions regarding the case. Mayor Martin asked to hear from any proponents of the case. There being none, Mayor Martin asked to hear from any opponents of the case. The following individuals spoke in opposition to the case and expressed concerns regarding the potential negative environmental impact and odor of the cremation process, as well as concerns about the impact to neighboring property values: • Michelle Bell, 1501 Baccarac Court, Euless; • Jerry Drennan, 2206 West Euless Boulevard, Euless; • Carmen Solis, 2613 Needles Street, Euless; and • Mike Street, 1523 Baccarac Court, Euless, and speaking on behalf of approximately ten individuals in attendance. There being no others wishing to speak, Mayor Martin closed the public hearing at 7:53 p.m. Council Member Tompkins expressed his concern in regard to the turning radius and the ability of a vehicle to access the bays without encroaching on the neighboring property. Council Minutes Page 7 of 8 April 23, 2024 Council Member Paudel expressed his appreciation for the process in place allowing citizens to make their voices heard. Council Member Tompkins motioned to deny Ordinance No. 2380, denying the issuance of a Specific Use Permit for a crematorium to be located at Baccarac Industrial Park, Block A, Lot 4R, 1509 Baccarac Court, in the Texas Highway 10 Multi -Use (TX-10) zoning district. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 13. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2381 Director of Public Works and Engineering Major Jones presented the item to the City Council and advised that the proposed amendment to Section 86-36 of the City's drought contingency plan is in alignment with the Trinity River Authority's (TRA) recently adopted drought contingency plan. Council Member Bynum motioned to approve the first and final reading of Ordinance No. 2381, amending Chapter 86, "Utilities", Article II, "Water and Sanitary Sewer Systems", "Generally", Sections 86-36, "Drought Contingency Plan", of the Code of Ordinance updating and revising the City's Drought Contingency Plan. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 14. PUBLIC COMMENTS Lee Ann Folau, 800 Henslee Drive, Euless, addressed the City Council regarding Agenda Item No. 12 (Specific Use Permit 24-02-SUP). ITEM NO. 15. REPORTS City Manaqer No report given. Citv Council Mayor Martin announced that early voting for the May 4, 2024 General Election began Monday, April 22, 2024, and will continue through Tuesday, April 30, 2024, at the Euless Family Life Senior Center.
