HomeMy WebLinkAbout2024-04-16 P&Z MinutesCITY OF EULESS PLANNING AND ZONING COMMISSION APRIL 16, 2024 MINUTES The pre -session meeting of the Planning and Zoning Commission was called to order by Chairman Ellis at 6:00 p.m. in the Pre -Council Conference Room of City Hall, 201 North Ector Drive. Those present included Chairman Steve Ellis, Vice Chair LuAnn Portugal, Commission Members Curtis Brown, David Brown, Rubyanne Crites, Eric Owens, and Katherine Flannery. During the Pre -Session Meeting: ➢ Director of Planning and Economic Development Michael Warrix reviewed agenda item number 2. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The regular meeting of the Euless Planning and Zoning Commission was called to order by Chairman Steve Ellis at 6:30 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. STAFF PRESENT: Michael Warrix, Director of Planning and Economic Development Major Jones, Director of Public Works and Engineering Drew Washington, Division Chief / Fire Marshal Yvonne Garcia, Administrative Secretary of Planning and Economic Development VISITORS PRESENT: LeeAnn Folan Cole Patrick INVOCATION Commissioner Flannery gave the invocation. THE PLEDGE OF ALLEGIANCE Commissioner D. Brown led the pledge of allegiance. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Commissioner Crites made a motion to approve the minutes of the regular meeting April 2, 2024. Commissioner C. Brown seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chair Portugal Commissioners C. Brown, D. Brown, Crites, Flannery, and Owens. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 24-05-SUP Chairman Ellis opened up the public hearing at 6:36 p.m. Director of Planning and Economic Development Michael Warrix presented the case to the Planning and zoning Commissioners and advised that the applicant, Trey Fricke, on behalf of OES Equipment, LLC, is requesting a Specific Use permit (SUP) for a warehouse use in AL -KO Southwest Addition, Block A, Lot 1 at 2300 State Highway 121 in the 121 Gateway (TX-121) zoning district, and to consider a recommendation for an Ordinance. The Development Service Group certified this case on April 2, 2024 to be placed on the Planning and Zoning Commission Agenda. Staff recommends approval of the Specific Use Permit, with the following conditions: 1) The Specific Use Permit is tied to the business name, OES Equipment; 2) The Specific Use Permit is tied to the business owner, OES Equipment, LLC; 3) Vehicles, equipment, and all other storage that is located in the rear yard must not extend over the height of the north and south fencing; and 4) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Public hearing notification letters were mailed to surrounding property owners, and to date, staff has received two written responses. Chairman Ellis asked to hear from any proponents/opponents who wished to speak. LeeAnn Folan, resident appeared and asked if the business hours would change during holiday season. Mr. Warrix answered no and that the operating hours are Monday -Friday from 7:00 a.m.- 6:00 p.m. Cole Patrick, a resident who lives adjacent to this property spoke to the commission on some concerns regarding noise and storage. Mr. Warrix clarified-fhe-co-nditions-foT-approval regarding storage. Mr. Patrick welcomed the conditions and asked how to report any future violations. Chairman Ellis responded that he would report that to City's Code Compliance department. Chairman Ellis closed the public hearing at 6:44 p.m. Commissioner D. Brown asked for clarification on the condition number three that mentions storage in the rear yard but not on the side of the building. Mr. Warrix responded that based on the application, storage was shown to be proposed in the rear yard and that fire lanes exist on each side of the building that cannot be encroached upon for storage. Commissioner Crites made a motion to approve Case No. 24-05-SUP for a Specific Use Permit for a warehouse use proposed in AL -KO Southwest Addition, Block A, Lot 1 at 2300 State Highway 121 in the 121 Gateway (TX-121) zoning district, and consider recommendation for an Ordinance. Commissioner D. Brown seconded the motion. The vote was as follows: Ayes: Chairman Eills, Vice Chair Portugal, Commission Members: C. Brown, D. Brown, Crites, Flannery, and Owens. Nays: None Abstention: None Chairman Ellis declared the motion to approve Case No. 24-05-SUP carried. (7-0-0) ITEM 3.
