ACCEPTING THE RESPONSIBILITY OF REIMBURSING THE TEXAS
DEPARTMENT OF TRANSPORTATION FOR THE EXPENSE OF
UTILITY ADJUSTMENTS FOR THE DEVELOPMENT AND
CONSTRUCTION OF IMPROVEMENTS TO F.M. 157 FROM SH 121 TO
SH 183.
WHEREAS, the Texas Department of Transportation has approved the reconstruction of Farm
to Market Road 157 from State Highway 121 to State Highway 183, and
WHEREAS, the City of Euless, on September 13, 1983, approved Texas Department of
Transportation Minute Order No. 81169 - 00019, approving and participating with the Texas
Department of Transportation's activity regarding the reconstruction and improvement of F.M.
157 from State Highway 121 to State Highway 183, and
WHEREAS, the City of Euless agreed in said minute order to participate in the development
and construction of the F.M. 157 Project by providing funding, preparing design documentation,
acquiring the necessary right -of -way, accomplishing utility adjustments and other necessary items
required by the Texas Department of Transportation, and
WHEREAS, the City of Euless recognizes that the City of Bedford may not participate in the
cost of utility adjustments and that the State Department of Transportation has considered all
other sources of revenues for the Bedford portion of utility adjustments;
NOW, THEREFORE, BE IT RESOLVED that the Euless City Council accepts the terms of
the agreement proposed by the Texas Department of Transportation dated April 8, 1994, for
accepting the responsibility of utility adjustments in an amount not to exceed $140,000 and
authorizes the Mayor of the City of Euless to execute in the name of the City of Euless all
necessary applications, contracts and agreements to implement and carry out the purposes
specified in this resolution;
BE IT FURTHER RESOLVED that the Euless City Council hereby requests the Texas
Department of Transportation and Tarrant County to pursue all avenues to collect from the City
of Bedford their share of expenses for this project.
APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Euless,
Texas on the 26th day of April, 1994, by a vote of 7 ayes, 0 nays and
0 abstentions.
