A RESOLUTION DECLARING A PUBLIC NECESSITY FOR
THE ACQUISITION OF PARCELS OF REAL ESTATE
REQUIRED FOR THE CONSTRUCTION AND MAINTENANCE
OF CHANNEL IMPROVEMENTS TO SULPHUR BRANCH.
WHEREAS, the Legislature of the United States, through its passage of
Section 205 of the Flood Control act of 1948, as amended, has authorized the
Secretary of the Army to appropriate funds for the construction of small flood
control projects and related purposes; and
WHEREAS, the City of Euless has executed a Local Cooperative
Agreement with the U.S. Army Corps of Engineers for the construction and
maintenance of channel improvements in Sulphur Branch within the city limits of
Euless; and Hurst; and
WHEREAS, the channel improvements are required to reduce potential
flood losses within the Morrisdale Estates subdivision and to remove forty (40)
lots from the one hundred (100) year flood plain, as defined by the Federal
Emergency Management Agency; and
WHEREAS, certain parcels of real estate have been identified by the Corps
of Engineers and the City of Euless as needed for the construction and
maintenance of the channel improvements; and
WHEREAS, the City Council of the City of Euless finds that a public
necessity exists for the acquisition of the aforesaid parcels of real estate, and that
said parcels when taken, shall be put to a public use for the benefit of the
community at large.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EULESS, TEXAS, THAT:
Section 1: There is a public necessity for the acquisition by the City of
Euless of each of the parcels described in Attachment 1.
Section 2: The real property interest designated for each parcel in
Attachment 1 is necessary and proper for the construction and maintenance of the
channel improvements, and such improvements are hereby declared to be a public
use for a public purpose.
PASSED AND APPROVED by the City Council of the City of Euless,
11th day of October ,1994.

BEING a tract of land in the J. W. Haynes Survey, Abstract No. 770,
the H. Hurst Survey, Abstract No. 657, and the A. Howerton Survey,
Abstract No. 677, Tarrant County, Texas and being a portion of
Tract I as described in a survey prepared by Ronald W. Taylor dated
October 19, 1993 and titled Bluebonnet Dr. Tract No. 1 - 3.611 Ac.
and Tract No. 2 - 20.782 Ac. and being more particularly described
as follows:
BEGINNING at the southeast corner of said Tract I, point being on
the north line of Bluebonnet Drive (a 50 -foot right -of- way);
THENCE S 86° 18' 29" W, 141.18 -feet along the south line of said
Tract I and the north line of Bluebonnet Drive to a point for
corner;
THENCE leaving the south line of'said Tract I and the north line of
Bluebonnet Drive, N 00' 03' 15" E, 213.39 -feet to the-northeast
corner of said Tract I;
THENCE S 34' 33' 10" E, 248.05 -feet along the east line of said
Tract I to the Point of Beginning and Containing 0.35 acres of
land, more or less.

BEING a tract of land in the A. Howerton Survey, Abstract No. 677,
. Tarrant Coutny, Texas and being a portion of Tract II as described
in a survey prepared by Ronald W. Taylor dated October 19, 1993 and
titled Bluebonnet Dr. Tract No. 1 - 3.611 Ac. and Tract No. 2 -
20.782 Ac. and being more particularly described as follows:
BEGINNING at the northeast corner of said Tract II, point being on
the south line of Bluebonnet Drive (a 50 -foot right -of -way);
THENCE S 17° 02' 34" E, 675.00 -ffeet along the east line of said
Tract II to a point for corner;
THENCE N 360 02' 04" W, 400.00 -ffeet to a point for corner;
THENCE N 23° 43' 23" W, 339.34 -feet to a point for corner on the
north line of said Tract II and the south line of Bluebonnet Drive;
THENCE N 86° 18' 29" E, 174.36 -feet along the north line of said
Tract II and the south line of Bluebonnet Drive to the Point of
Beginning and Containing 1.65 acres of land, more or less.
