WHEREAS, the City of Euless, Texas ( "Euless ") and the Hurst - Euless Bedford
Independent School District ( "HEB ") desire to conduct joint elections pursuant to the
provisions of the Texas Election Code, including the conduct of joint early voting and to
provide for the sharing of expenses; and
WHEREAS, Section 271.002 of the Texas Election Code provides for joint elections
upon the passage of a resolution by each of the governing bodies participating therein
reciting the terms of the agreement, including the method for allocating expenses for the
election;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1.
Euless and HEB shall hold a joint election on Saturday, May 6, 1995, for the purpose of
electing members to Places 1 and 3 of the Euless City Council and electing Trustees to
Places 3, 4, and 5 of the HEB Board of Trustees. It is further agreed that such election
shall be conducted by Euless at such polling place as Euless shall designate, utilizing the
election officers appointed by Euless, and with early voting conducted by the Euless City
Secretary at such location as Euless shall name.
SECTION 2.
Electronic vote tabulating equipment shall be utilized for the elections, and separate
ballots shall be utilized containing all the offices and propositions to be voted on at each
polling place, provided that no voter shall be given a ballot or permitted to cast a vote for
any office or proposition on which the voter is ineligible to vote. Returns may be made
on forms which are individual or combined. The officer designated by law to be custodian
of the records for Euless shall be designated as the custodian of the combined records.
SECTION 3.
The expenses of supplies, voting machines and election workers for the Midway
Recreation Center polling place shall be borne proportionately by Euless and HEB, and
HEB agrees to furnish their own ballots at their expense. HEB agrees to indemnify
Euless for the cost of any recount or election contest required for officers or propositions
to be voted on for HEB.
ADOPTED at a regular meeting of the Euless City Council on the 14th day of February,
1995, by a vote of 7 ayes, 0 nays, and 0 abstentions.
