ORDINANCE NO. 2401 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF EULESS, CHAPTER 84, UNIFIED DEVELOPMENT CODE, AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON APPROXIMATELY 8.454 ACRES IN THE SOTOGRANDE ADDITION, TRACTS 14R, 22R1, 22AR1, AND 22111131 LOCATED ON THE SOUTHEAST CORNER OF WEST PIPELINE ROAD AND EL CAMINO REAL, CHANGING THE ZONING FROM PLANNED DEVELOPMENT (PD 2356) DISTRICT TO PLANNED DEVELOPMENT (PD) DISTRICT AS DESCRIBED HEREIN AND ON THE EXHIBITS; PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Ordinance No. 2356, an ordinance of the City of Euless, Texas, established a planned development zoning district in the City of Euless entitled Westdale Apartments and was approved by the City Council of the City of Euless on August 21, 2023; WHEREAS, the Planning and Zoning Commission has conducted a public hearing on September 3, 2024, in conjunction with Planned Development Case No. 24-05-PD, and has rendered a recommendation to the City Council with respect to this case; and WHEREAS, the City Council has conducted a public hearing on September 24, 2024, considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. The official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification of approximately 8.454 acres in the Sotogrande Addition, Tracts 14R, 22R1, 22AR1, and 22R1 B1 located on the southeast corner of West Pipeline Road and El Camino Real is changed from Planned Development (PD) District into Planned Development (PD) District, as described herein and on the attached Exhibits. SECTION 2. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Chapter 1, "General Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 4. SAVINGS CLAUSE. All rights and remedies of the City of Euless are expressly saved as to any and all violations of the provisions of the Euless Unified Development Code applicable to the Property that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 5. PUBLICATION. The caption, penalty clause, and effective date clause of this ordinance shall be published in a newspaper of general circulation in the City of Euless, in compliance with the provisions of Article II, Section 12 of the Euless City Charter. SECTION 6. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. Ordinance No. 2401, Page 6 of 19 DEVELOPMENT REGULATIONS The subject property (the "Property") shall be zoned "PD" — Planned Development District. Use and development of the Property shall conform to the regulations contained herein. All provisions contained in the City's Zoning Ordinance relating to development within the Property which are not in conflict with the provisions contained herein shall continue to apply to the development of the Property. District regulations shall be per the R-5 Multiple Family High Density Dwelling District regulations with the following modifications: l . Maximum units per structure — 28 units. 2. Minimum front yard setback — 25 feet 3. Minimum side yard setback on corner lot — 25 feet 4. Minimum interior side yard setback — 0 feet 5. Minimum rear yard setback interior — 0 feet 6. Maximum building height — 50 feet 7. Parking requirements: 7.1. Garages — 25% of total required parking. 7.2. No covered parking required outside of the garage requirement. 7.3. Garages shall be minimum 10'-6" wide. 7.4. Minimum parking is equal to 1 space per unit (spaces include garage, tandem and surface parking) and 0.5 spaces per bedroom. 8. Minimum patio square footage — 70 square feet 9. Minimum secured storage space per unit — 0 square feet 10. Exterior construction shall consist of a minimum of 40 percent masonry 11. Security gates not required. 12. Perimeter screening not required. 13. No personal open space requirement. Changing the oil got rid of unwanted metal particles as well as casting sand. Today, all you need to do is drive gently for the first 1,000 miles. No jackrabbit starts, heavy towing and so on. Carmakers want you to be happy with their vehicles so, if they needed a break-in oil change, the owner's manual would say so. Of course, you are free to change your oil as often as you like, but it's unnec- essary.
