COUNCIL RESOLUTION NO. 96 -942
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS AUTHORIZING THE CITY'S SPECIAL
COUNSEL TO DISMISS ALL PENDING LITIGATION WITH
THE DFW AIRPORT BOARD, THE CITIES OF DALLAS AND
FORT WORTH, AMERICAN AIRLINES, INC., DELTA AIR
LINES, INC. AND UNITED PARCEL SERVICE CO. AND THE
ATTORNEY GENERAL OF TEXAS, PROVIDED THOSE
PARTIES DISMISS ALL PENDING LITIGATION AGAINST
THE CITY OF EULESS.
WHEREAS, the City of Euless (the "City") and DFW International Airport
Board, the Cities of Dallas and Fort Worth, American Airlines, Inc., Delta Air Lines, Inc.
and United Parcel Service Co., and the Attorney General of Texas (the "Airport"), are
currently involved in four (4) lawsuits (the "Lawsuits ") involving the expansion of DFW
Airport which are styled and numbered as follows: Cause No. 95 -0501, The City of Irving.
et al. v. D /FW International Airport Board, et al.; Cause No. 05 -95- 00479 -CV., The City
of Irvina. et al. v. Dallas /Fort Worth International Airport, Board. et al.; Cause No. 92-
5396-1, The City of Irvina. et al. v. American Airlines, Inc., et al.; and Cause No. 91 -4728-
I, D /FW International Airport Board, et al. v. The City of Irving. Texas, et al.;
WHEREAS, the City desires to dismiss all pending claims in the Lawsuits
provided the Airport agrees to dismiss all pending claims they have in the Lawsuits
against the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS:
Section I. The City's special counsel is hereby authorized to dismiss the
Lawsuits between the City and the Airport upon the express condition that the Airport
agrees to dismiss the Lawsuits against the City.
Section 2. The City's special counsel is hereby authorized and instructed
to forward a copy of this resolution to counsel for the Airport.

EULESS, TEXAS on this filth day of June , A.D., 1996.
