HomeMy WebLinkAbout2024-09-24MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, September 24, 2024 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:35 p.m. on Tuesday, September 24, 2024, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tem Tika Paudel, Council Members Jeremy Tompkins, Eddie Price, Perry Bynum, and Annabel Eads. Council Member Tim Stinneford was absent due to illness. During the Precouncil meeting: ➢ Council Member Tompkins announced that he and Mayor Pro Tem Paudel represented the City at the GrapeFest's annual Mayoral GrapeStomp competition. Additionally, he advised that he attended the Hurst Euless Bedford Chamber of Commerce annual gala and expressed his appreciation to Mayor Pro Tem Paudel and Texas Star General Manager Glenda Hartsell -Shelton for representing the City at the event. ➢ Council Member Paudel expressed his appreciation to Assistant City Manager Wes Rhodes for his assistance with a major water line break at a resident's home while they were abroad, and for his assistance in communicating with the Texas Department of Transportation (TxDot) regarding the traffic issues on Main Street and State Highway 183. ➢ Mayor Martin expressed her appreciation to those who were able to attend the Euless Library Foundation Meeting. ➢ Library Director Sherry Knight advised that the family of Anne Marie Snitz chose to have a private service to honor her memory. ➢ City Manager Loretta Getchell advised of several upcoming events: • City flags to be flown at half-staff from sunrise to sunset, Wednesday, September 25, 2024, in memory of former Mayor Harold Samuels; • National Night Out group photo, Tuesday, October 1, 2024, 5:30 p.m. City Hall; • Public Safety Open House, Saturday, October 5, 2024, 10 a.m. to 2 p.m., Fire Station No. 1; • Euless Library Foundation Book Sale, Saturday, October 5, 2024, 10 a.m. to 4 p.m., Mary Lib Saleh Euless Public Library; • Board and Commission interviews, Monday, October 7, 5:30 p.m., City Hall; and • Employee Burger Bash, Friday, October 11, 2024, 11 a.m. to 1:30 p.m., Parks at Texas Star. Council Minutes Page 2 of 10 September 24, 2024 ➢ City Manager Loretta Getchell reviewed the regular agenda. ➢ City Secretary/Chief Governance Officer Kim Sutter provided an update on the Board and Commission appointment process and advised that staff has scheduled interviews for the City Council to meet with applicants for Monday, October 7, 2024. ➢ Public Works and Engineering Director Major Jones presented a Capital Projects update including the West Pipeline Road construction project, specifically the section of roadway from Raider Drive to Forest Ridge. He advised that the repaving of the roadway will require a complete closure of West Pipeline Road; staff is working with property owners to identify the best dates and times for the closure. CLOSED SESSION The City Council convened into closed session at 6:15 p.m. for deliberation regarding the following: Deliberate the purchase, exchange, lease, or value of real property as authorized by Section 551.072 of the Texas Government Code related to: • 201 West Euless Boulevard • 1100 Westpark Way Discuss or deliberate economic development matters as authorized by Section 551.087 of the Texas Government Code related to: • Commercial or financial information that the City has received from business prospects that the City seeks to have locate, stay, or expand in the City and with which the City is conducting economic development negotiations; deliberate the offer of a financial or other incentive to a business prospect. The City Council reserves the right to adjourn into Closed Session at any time during the course of this meeting to consult with its attorney regarding any of the matters listed on the agenda, as authorized by Section 551.071 of the Texas Government Code. ANNOUNCED EMPLOYEE OF THE MONTH FOR OCTOBER 2024 Mayor Martin announced Texas Star Conference Centre Manager Leslie Conley as Employee of the Month for October 2024. CONSENT AGENDA (items 2 throuph 16) Mayor Martin asked Deputy City Manager Chris Barker to read each item into the record. Council Member Tompkins motioned to approve the consent agenda items number 2 through 16. Council Member Price seconded the motion. AUTHORIZED CITY MANAGER TO RENEW A CONTRACT Authorized the City Manager to renew the City's contract with HUB International, 10000 North Central Expressway, Suite 1200, Dallas, Texas, for benefits consulting and insurance planning services. This request is the first of two, one-year renewal periods effective October 1, 2024. The estimated expenditure is $50,000. ITEM NO. 3. APPROVED CONTRACT EXTENSION PER REQUEST FOR PROPOSAL NO. 006-20 Approved extension of contract per Request for Proposal (RFP) No. 006-20 with United Healthcare Services, Inc. (UHC), 185 Asylum Street, Hartford, Connecticut, for Third - Party Administration and Network, Pharmacy Benefit Management, Utilization Management, Large Case Management, Cobra Administration, Employee Assistance Program, Dental Administration and Network, and Vision Administration and Network. ITEM NO. 4. AUTHORIZED PURCHASE OF THREE POLICE PATROL VEHICLES Authorized the purchase of three police patrol vehicles from Grapevine Dodge Chrysler Jeep, 2601 William D. Tate Avenue, Grapevine, Texas, through the BuyBoard Purchasing Cooperative Program. The estimated expenditure is $144,202. ITEM NO. 5. AUTHORIZED PURCHASE OF GROUNDS MAINTENANCE EQUIPMENT Authorized the purchase of grounds maintenance equipment from Professional Turf Products, L.P., 1010 North Industrial Boulevard, Euless, Texas, through the BuyBoard Purchasing Cooperative Program. The estimated expenditure is $59,533. ITEM NO. 6. AUTHORIZED PURCHASE OF AN AERIAL FIRE TRUCK Authorized the purchase of a 100-foot aerial fire truck from Siddons-Martin Emergency Group, 2517 Nail Road, Krum, Texas, through the Houston -Galveston Area Council Cooperative Purchasing Program (H-GAC). The estimated expenditure is $2,009,997. ITEM NO. 7. AUTHORIZED PURCHASE OF PORTABLE RADIOS AND EQUIPMENT Authorized the purchase of 27 portable radios and associated equipment from Motorola Solutions, 500 West Monroe Street, Chicago, Illinois, through the Houston -Galveston Area Council Cooperative Purchasing Program (H-GAC). The estimated expenditure is $275,302. ITEM NO. 8. AUTHORIZED PURCHASE OF HEART MONITORS/ DEFIBRILLATORS Authorized the purchase of four heart monitors/defibrillators for both fire trucks and ambulances from Stryker Medical, 350 N Orleans Street, Chicago, Illinois. AUTHORIZED PURCHASE OF OFFICE SUPPLIES Authorized the purchase of office supplies from ODP Business Solutions, 6600 North Military Trail, Boca Raton, Florida, for a one-year period through the Omnia Partners Purchasing Cooperative. The estimated annual expenditure is $60,000. ITEM NO. 10. AUTHORIZED PURCHASE OF DIGITAL LIBRARY MATERIALS Authorized the purchase of digital library materials (e-books and e-audiobooks) from OCLC, Inc, 6565 Kilgour Place, Dublin, Ohio, the sole source provider of materials for the Cloud Library platform in use by the Library. The estimated expenditure is $95,000, ITEM NO. 11. AUTHORIZED PURCHASE OF DIGITAL LIBRARY MATERIALS Authorized the purchase of digital library materials (e-books, e-audiobooks, video, and music) from Midwest Tape, Inc., 1417 Timberwolf Drive, Holland, Ohio, for the Hoopla digital circulation platform. The estimated expenditure is $75,000. ITEM NO. 12. AUTHORIZED PURCHASE AND INSTALLATION OF ARTIFICIAL TURF Authorized the purchase and installation of artificial turf for Fenway, Shea, and Jacobs baseball fields at the Parks at Texas Star South from GeoSurfaces, Inc., 7080 St. Gabriel Avenue, Suite A, St. Gabriel, Louisiana, through The Interlocal Purchasing System (TIPS). The estimated expenditure is $258,200. ITEM NO. 13. AUTHORIZED PURCHASE OF CONSTRUCTION MATERIAL TESTING Authorized the purchase of construction material testing services from CMJ Engineering, 7636 Pebble Drive, Fort Worth, Texas, for the Police and Court project through the Tarrant County Request for Qualifications (RFQ) No. 2022-098. The estimated expenditure is $68,094. ITEM NO. 14. AUTHORIZED CITY MANAGER TO ENTER INTO AN INTERLOCAL AGREEMENT Authorized the City Manager to enter into an Interlocal Agreement (ILA) with the City of Grapevine, relating to temporary animal shelter services during the construction of the new City of Euless Animal Shelter. ITEM NO. 15. AUTHORIZED CITY MANAGER TO ENTER INTO AN INTERLOCAL AGREEMENT Authorized the City Manager to enter into an Interlocal Agreement (ILA) with Hurst - Euless -Bedford Independent School District (HEB ISD), the City of Bedford, and the City of Hurst for an Elementary School Resource Officer Program (ESROP). The agreement will cover the FY2024-25 school year and will be renewable annually upon mutual agreement. Council Minutes Page 6 of 10 September 24, 2024 ITEM NO. 16. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of September 10, 2024. REGULAR AGENDA ITEM NO. 17. HELD A PUBLIC HEARING REGARDING PLANNED DEVELOPMENT 24-05-PD AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2401 Mayor Martin opened the public hearing at 7:09 p.m. Director of Planning and Economic Development Michael Warrix presented the case to the City Council and advised that the applicant, Cross Engineering, is requesting an amendment to the Planned Development (PD) zoning district at Sotogrande Addition, Tracts 14R, 22R1, 22AR1, and 22R1 B1, located on the southeast corner of West Pipeline Road and El Camino Real. The amendment would allow revisions to the site boundaries, revisions to the parking regulations, and provide an updated site plan. The Planning and Zoning Commission held a public hearing on September 3, 2024, and recommended approval by a vote of 6-0-0. Chuck Hixson, representing Westdale Real Estate, was present to address any questions regarding the case. Mayor Martin asked to hear from any proponents followed by opponents of the case There being none, Mayor Martin closed the public hearing at 7:11 p.m. In response to a question from Council Member Tompkins, Mr. Hixson stated that the additional parking provided by the new revisions should eliminate the need for overflow parking at the adjacent property. Council Member Bynum motioned to approve Ordinance No. 2401, amending the Planned Development (PD) zoning district at Sotogrande Addition, Tracts 14R, 22R1, 22AR1, and 22R1131, located on the southeast corner of West Pipeline Road and El Camino Real. HELD A PUBLIC HEARING REGARDING SPECIFIC USE PERMIT CASE NO. 24-10-SUP AND DENIED FIRST AND FINAL READING OF ORDINANCE NO. 2402 Mayor Martin opened the public hearing at 7:15 p.m. Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant is seeking a Specific Use Permit (SUP) for an automotive repair business and a parking lot to be located at St. Michael's Addition, Block A, Lots 2 and 3, 2700 and 2710 West Euless Boulevard. Mr. Warrix also noted that six written letters opposing the case have been received. The Planning and Zoning Commission held a public hearing on September 3, 2024, and voted 6-0-0 to recommend denial of the SUP. However, staff recommends approval with the following conditions: 1. The Specific Use Permit is tied to the business name, All in One Auto Repair; 2. The Specific Use Permit is tied to the business owner, Amit Gubhaju; 3. There shall be no outdoor service or repair to any vehicle; 4. There shall be no outdoor storage of vehicles, car parts, or merchandise, to include the fire lane; 5. If the required parking spaces on Lot 3 are not under the same ownership as Lot 2 in the future, a parking agreement shall be filed for record; and 6. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin asked to hear from any proponents. There being none, Mayor Martin asked to hear from any opponents of the case. The following individuals spoke in opposition to the case and expressed concerns regarding the potential negative impact to nearby child centers and noted the presence of several auto repair facilities in the immediate area. Le Vicky, 2601 Needles Street, Euless; Aurora Benash, 1004 Meadow Glen Court, Arlington; and Randy Putnam, 2720 West Euless Boulevard, Euless. There being no others wishing to speak, Mayor Martin closed the public hearing at 7:29 p.m. Council Member Bynum motioned to deny Ordinance No. 2402, denying the issuance of a Specific Use Permit for an automotive repair business and parking lot at St. Michael's Addition, Block A, Lots 2 and 3, 2700 and 2710 West Euless Boulevard, in the Texas Highway 10 Multi -Use (TX-10) zoning district. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Paudel, Council Members Tompkins, Price, Bynum, and Eads Nays: None Council Minutes Page 8 of 10 September 24, 2024 Mayor Martin declared the motion carried. ITEM NO. 19. APPROVED TEMPORARY USE PERMIT NO. 24-04-CC Director of Planning and Economic Development Warrix advised that St. John the Baptist Greek Orthodox Church is seeking a Temporary Use Permit to host the 32nd Annual Mid - Cities Greek FoodFest on the church grounds. Mr. Warrix reviewed the festival layout, parking arrangements, and the dates and hours the event will be held. George Vittas, representing St. John the Baptist Greek Orthodox Church, was present to address any questions regarding the request. Council Member Bynum motioned to approve Temporary Use Permit No. 24-04-CC for a Greek Food Festival to be located at 303 Cullum Drive, for four consecutive days, beginning on October 10, 2024 and concluding on October 13, 2024. Council Member Eads seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Paudel, Council Members Tompkins, Price, Bynum, and Eads Nays: None Mayor Martin declared the motion carried. ITEM NO. 20. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2403 Council Member Tompkins motioned to approve Ordinance No. 2403, allowing the implementation of the Texas Municipal Retirement System (TMRS) "Buyback Provision" for employees qualifying in accordance with TMRS records and provisions. Mayor Pro Tern Paudel seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Paudel, Council Members Tompkins, Price, Bynum, and Eads Nays: None Mayor Martin declared the motion carried. ITEM NO. 21. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2404 City Attorney Wayne Olson presented the item to City Council and advised that Ordinance No. 2264 was adopted on November 12, 2020, approving regulations regarding fair overtime and scheduling standards after such regulations were approved by the citizens of Euless in accordance with an initiative election held on November 3, 2020. Since approval of these regulations, the Texas Legislature adopted House Bill 2127 and Section Council Minutes Page 9 of 10 September 24, 2024 1.005 of the Texas Labor Code prohibiting a municipality from adopting, enforcing, or maintaining an ordinance, order, or rule regulating employment leave, hiring practices, breaks, employment benefits, scheduling practices, and any other terms of employment that exceed or conflict with federal or state law or employers, including any field or regulation that is occupied by a provision in the Texas Labor Code. Therefore, it is the recommendation of staff that Ordinance No. 2264 be repealed to comply with state law. Council Member Bynum motioned to approve Ordinance No. 2404, amending the Code of Ordinance by repealing Chapter 95 "Fair Overtime and Scheduling Standards" in its entirety. Council Member Eads seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Paudel, Council Members Tompkins, Price, Bynum, and Eads Nays: None Mayor Martin declared the motion carried. ITEM NO. 22. CAST VOTE FOR TEXAS MUNICIPAL LEAGUE (TML) REGION 8 DIRECTOR Council Member Tompkins motioned to cast the City of Euless vote for the Texas Municipal League (TML) Region 8 Director for nominee Jon McKenzie. Council Member Price seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Paudel, Council Members Tompkins, Price, Bynum, and Eads Nays: None Mayor Martin declared the motion carried. ITEM NO. 23. APPROVED LEAVE OF ABSENCE FOR COUNCIL MEMBER ANNABELEADS Council Member Bynum motioned to approve a leave of absence for Council Member Annabel Eads for all meetings scheduled for October through December 31, 2024. Citv Council Council Member Tompkins expressed his appreciation for the public hearing process of the City Council and Planning and Zoning Commission, which allows citizens an opportunity to have their voices heard. Mayor Martin advised that the City of Euless flags will be flown at half-staff from sunrise to sunset Wednesday, September 25, 2024, in memory and recognition of former Mayor Harold Samuels. Mayor Samuels served on the City Council for a number of years before assuming the office of Mayor in 1975 — an office he held for 18 years. Throughout his tenure, he maintained an outstanding record of service, motivated by a strong sense of loyalty, a personal obligation to his fellow citizens, and a sincere desire to continually improve the community. He was a remarkable gentleman who has left an indelible mark on the City he so faithfully served. Please keep his family in your thoughts and prayers. ITEM NO. 26.
