HomeMy WebLinkAbout97-973 04-08-1997RESOLUTION NO. 97-973 A RESOLUTION IMPOSING A MORATORIUM ON THE ACCEPTANCE OF APPLICATIONS OR ISSUANCE OF PERMITS FOR MULTI —FAMILY DEVELOPMENT FOR A DURATION NOT TO EXCEED ONE HUNDRED TWENTY (120) DAYS. WHEREAS, the City of Euless, Texas, has experienced and continues to experience significant growth in population; and WHEREAS, the City of Euless has experienced and continues to experience significant growth in multi — family development projects throughout the City; and WHEREAS, experience has shown that some multi— family developments, over time, become deteriorated and dilapidated, and result in reduction in surrounding property values and in greatly increased demands for City services; and WHEREAS, the City Council of the City of Euless, Texas, desires to study methods whereby standards for multi — family developments can be changed or modified to reduce the likelihood of such dilapidation or deterioration in the future; and WHEREAS, although certain multi — family developments are already in progress and will be unaffected hereby, the City Council has determined that the health, safety and general welfare of the citizens of Euless would be best served by exercsing its police power to impose a moratorium on new, additional multi — family developments within the City until the City Council, with the assistance of City staff and the Planning and Zoning Commission, has had adequate opportunity to study and enact new regulations governing multi— family development to address the problems heretofore found to exist; and WHEREAS, the City of Euless, Texas, is a home rule city with full power of local self — government. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. That the matters stated in the preamble hereof are found to be true and correct and are incorporated herein. II. That immediately from and after the passage of this resolution, and extending for a period of no more that 120 days therefrom, there shall be imposed a moratorium on any new multi— family development within the City of Euless. During RESOLUTION NO. 97-973 PAGE 1 this moratorium, City staff will not accept applications or issue permits for any new multi - family davelopment. This moratorium extends to every type of permit and approval within the power of the City to grant in connection with any new development project, including, without limiting the generality of the foregoing, development plans, plats, zoning, site plans and building permits. It is the express intent of this resolution to allow projects currently in progress to proceed unaffected hereby, but to delay the start of any new project until the expiration of this moratorium or any extension hereof. PASSED AND APPROVED by the City Council of the City of Euless, Texas, and effective, on this 8th day of April , 1997.
