WHEREAS, the City of Euless, Texas ( "Euless ") and the Hurst - Euless- Bedford
Independent School District ( "HEBISD ") desire to conduct joint elections pursuant to the
provisions of the Texas Election Code, including the conduct of joint early voting and to
provide for the sharing of expenses; and
WHEREAS, Section 271.002 of the Texas Election Code provides for joint elections
upon the passage of a resolution by each of the governing bodies participating therein
reciting the terms of the agreement, including the method for allocating expenses for the
election;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1.
"Euless" and "HEBISD" shall hold one election on Saturday, May 2, 1998, for the
purpose of electing members to Place One and Place Three of the Euless City Council
and electing Trustees to Place Three, Place Four and Place Five of the HEBISD Board
of Trustees. It is further agreed that such election shall be conducted by "Euless" at such
polling place as "Euless" shall designate, utilizing the election officers appointed by
"Euless ", and with early voting conducted by the Euless City Secretary at such location
as "Euless" shall name.
SECTION 2.
Electronic vote tabulating equipment shall be utilized for the elections, and separate
ballots shall be utilized containing all the offices and propositions to be voted on at each
polling place, provided that no voter shall be given a ballot or permitted to cast a vote for
any office or proposition on which the voter is ineligible to vote. Returns may be made
on forms which are individual or combined. The officer designated by law to be custodian
of the records for "Euless" shall be designated as the custodian of the combined records.
SECTION 3.
The expenses of supplies, voting machines and election workers for the Midway
Recreation Center polling place shall be borne proportionately by "Euless" and "HEBISD ",
and "HEBISD" agrees to furnish their own ballots at their expense. "HEBISD" agrees to
indemnify "Euless" for the cost of any recount or election contest required for officers or
propositions to be voted on for "HEBISD ".
SECTION 4.
This Agreement will continue in force until repealed by official action and notification by
either party.
ADOPTED at a regular meeting of the Euless City Council on the 24th day of February,
1998, by a vote of 7 ayes, 0 nays, and 0 abstentions.
