HomeMy WebLinkAbout98-999 08-11-1998RESOLUTION NO. 98 -999 A RESOLUTION ordering a bond election to be held in the City of Euless, Texas, making provision for the conduct of the election and resolving other matters incident and related to such election. WHEREAS, the City Council of the City of Euless, Texas hereby finds that an election should be held to determine whether said goveming body shall be authorized to issue bonds of said City in the amount and for the purposes hereinafter identified; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1: An election shall be held on the 3rd day of October, 1998 in the City of Euless, Texas, which date is not Tess than fifteen (15) nor more than ninety (90) days from the date of the adoption hereof and the holding of the election on such date rather than on a uniform election date is hereby found to be in the public interest. At such election, the following measure shall be submitted: "SHALL the City Council of the City of Euless, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $13,500,000 for permanent public improvements and public purposes, to wit: street improvements for Main Street, Harwood Road, West Pipeline Road, and other city streets, including relocation of utility lines, drainage, sidewalks, street lighting, landscaping and land acquisition; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and whether ad valorem taxes shall be levied upon all taxable property in the City sufficient to pay the annual interest and provide a sinking fund to pay the bonds at maturity ?" SECTION 2: Electronic optical scan voting system shall be used on the day of the election and shall be used for early voting by personal appearance and by mail. Ballots shall be prepared in accordance with the applicable provisions of the Election Code so the voters may cast their ballots either "FOR" or "AGAINST' the aforesaid measures which shall appear on the ballot substantially as follows: "THE ISSUANCE OF GENERAL OBLIGATION BONDS IN THE AMOUNT OF $13,500,000 FOR STREET IMPROVEMENTS TO INCLUDE MAIN STREET, HARWOOD ROAD AND WEST PIPELINE ROAD" SECTION 3: The City shall be divided into two (2) election precincts for this election and the polling places designated for each election precinct and the persons hereby appointed to serve as Presiding Judge and Altemate Presiding Judge for each polling place are shown in Exhibit "A ", which is attached hereto and incorporated herein by reference as a part hereof for all purposes. Each Presiding Judge shall appoint not Tess than two (2) nor more than ten (10) qualified clerks to serve and assist in holding said election; -provided that if the Presiding Judge herein appointed actually serves, the Altemate Presiding Judge shall be one of the clerks. 720149.1 On election day, the polls shall be open from 7:00 A.M. to 7:00 P.M. Early voting shall be conducted at the City of Euless Midway Recreation Center, 300 W. Midway Drive, Euless, Texas (Mailing Address: 201 North Ector Drive, Euless, Texas 76039), in accordance with the provisions of V.T.C.A., Election Code. Early voting for this election shall begin Wednesday, September 16, 1998 and end Tuesday, September 29, 1998, and the hours designated for early voting by personal appearance shall be from 8:00 A.M. to 5:00 P.M. on each day, except Saturdays, Sundays and official State holidays. For purposes of processing ballots cast in early voting Martha Burleson is hereby appointed Presiding Judge of the Early Voting Ballot Board. SECTION 4: All resident qualified electors of the City shall be permitted to vote at said election, and on the day of the election, such electors shall vote at the polling place designated for the Election Precinct in which they reside. This election shall be held and conducted in accordance with the provisions of V.T.C.A., Election Code and Chapter 1 of Title 22, V.A.T.C.S., and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 5: A substantial copy of this resolution shall serve as proper notice of said election. Said notice, including a Spanish translation thereof, shall be posted at three (3) public places within the City and at the City Hall not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in a newspaper of general circulation in said City, the first of said publications to appear in said newspaper not more than thirty (30) days and not less than fourteen (14) full days prior to the day of the election.
