HomeMy WebLinkAbout99-1014 02-23-1999RESOLUTION NO. 99 -1014 A RESOLUTION CALUNG A GENERAL ELECTION FOR THE OFFICES OF MAYOR AND CITY COUNCIL MEMBERS, PLACE TWO AND PLACE FOUR; AND ESTABUSHING THE DATES AND TIMES OF EARLY VOTING FOR SUCH ELECTION; AND ESTABLISHING A DATE FOR A RUNOFF ELECTION, IF REQUIRED. WHEREAS, pursuant to the Election Code of the State of Texas, and the Euless City Charter, it is provided that there shall be held in each municipality in the State of Texas, a general election for the purpose of electing officials of said municipality; WHEREAS, the City of Euless, Texas ( "Euless ") and the Hurst - Euless- Bedford Independent School District ( "HEBISD ") desire to conduct joint elections pursuant to the provisions of the Texas Election Code, including the conduct of joint early voting and to provide for the sharing of expenses; and WHEREAS, Section 271.002 of the Texas Election Code provides for joint elections upon the passage of a resolution by each of the governing bodies participating therein reciting the terms of the agreement, including the method for allocating expenses for the election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 The City Council of the City of Euless, Texas, at a regular meeting held this date, does hereby order an election of officers for the City of Euless, Texas, to be held on the first Saturday in May, that being May 1, 1999, for the purpose of electing a Mayor and one Council Member for Place Two and one Council Member for Place Four, who shall each serve for a period of three years or until their successors have been duly qualified. The effective date of taking such office shall be as soon as the returns are canvassed and declared. The candidate receiving a majority of the votes cast for Mayor, the candidate receiving a majority of the votes cast for City Council Member Place Two, and the candidate receiving a majority of the votes cast for City Council Member Place Four, shall be declared elected to such offices. SECTION 2 Pursuant to Resolution 98 -988, approved by the Euless City Council on February 24, 1998, the Hurst - Euless- Bedford Independent School District will conduct a joint election with the City of Euless, Texas, for the purpose of electing Trustees to Place Six and Place 7 of the HEBISD Board of Trustees. SECTION 3 All qualified voters determined by the laws of the State of Texas, the Charter and Ordinances of the City of Euless shall be qualified to vote at such election. For the purpose of said election, the entire City is hereby constituted into two voting precincts. Voting on election day, May 1, 1999, shall be conducted at Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, 76039 and City of Euless Public Library, 201 N. Ector Drive, Euless, Texas 76039, and said election shall be held between the hours of 7:00 a.m. and 7:00 p.m. on the aforementioned date. SECTION 4 Applications for candidacy to the offices of Mayor, City Council Member Place Two, and City Council Member Place Four, shall be made to the City Secretary of the City of Euless not sooner than 8:00 a.m., February 15, 1999, and not later than 5:00 p.m., March 17, 1999, in manner and form as prescribed by law, and the Charter and Ordinances of the City of Euless, Texas. SECTION 5 The names of eligible and qualified candidates for such office shall be placed on the ballots for such election by the City Secretary at the time and in the manner prescribed by law, and the Charter and Ordinances of the City of Euless. SECTION 6 Early voting for the above designated election shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, weekdays from Wednesday, April 14, through Tuesday, April 27, from 8:00 a.m. to 5:00 p.m. and on Saturday, April 24, from 9:00 a.m. to 5:00 p.m. The early voting clerk for said election shall be the City Secretary, and applications for a ballot to be voted by mail shall be addressed to the Office of the City Secretary, 201 North Ector Drive, Euless, Texas, 76039, to be received no later than April 23, 1999. RESOLUTION NO. 99 -1014, PAGE 2 OF 3 SECTION 7 Voting machines used for the conduct of the election, shall be procured, maintained, operated, sealed and the votes therefrom tabulated pursuant to procedures established and authorized by the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 8 The results of the election shall be certified, canvassed, and returned in the form and manner prescribed by the laws of the State of Texas and the Charter and Ordinances of the City of Euless. SECTION 9 The notice of the election hereby ordered and called shall be promulgated, published and posted in keeping with the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 10 Any runoff election required for the election of Mayor and members of the City Council of the City of Euless, Texas, following the regular election of May 1, 1999, shall be held on Saturday, May 29, 1999. ADOPTED at a regular meeting of the Euless City Council on the 23rd day of February, 1999, by a vote of 7 ayes, 0 nays, and 0 abstentions.
