HomeMy WebLinkAbout99-1016 03-23-1999RESOLUTION NO. 99 -1016 A RESOLUTION CALLING A SPECIAL ELECTION FOR THE OFFICE OF CITY COUNCIL MEMBER, PLACE FIVE; ESTABUSHING THE DATES AND TIMES OF EARLY VOTING FOR SUCH ELECTION; APPOINTING JUDGES AND ALTERNATE JUDGES; AND ESTABUSHING A DATE FOR A RUNOFF ELECTION, IF REQUIRED WHEREAS, pursuant to Sec. 201.501 of the Election Code of the State of Texas, and the Euless City Charter, it is provided that there shall be held a special election for the purpose of filling a vacancy in office of the City Council of the City of Euless; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1 The City Council of the City of Euless, Texas, at a regular meeting held this date, does hereby order a special election for the City of Euless, Texas, to be held on May 1, 1999, for the purpose of electing one Council Member for Place Five, who shall serve for the unexpired term ending May 6, 2000, or until a successor has been duly qualified. The effective date of taking such office shall be as soon as the retums are canvassed and declared. The candidate receiving a majority of the votes cast for the office of City Council Place Five shall be declared elected to such office. SECTION 2 All qualified voters determined by the laws of the State of Texas, the Charter and Ordinances of the City of Euless shall be entitled to vote at such election. For the purpose of said election, the entire City is hereby constituted into two voting precincts. The polling place for said election shall be Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, 76039, and City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, 76039, and said election shall be held between the hours of 7:00 a.m. and 7:00 p.m. on the aforementioned date. SECTION 3 Pursuant to Sec. 201.054 of the Texas Election Code applications for candidacy of the office of City Council Member Place Five shall be made to the City Secretary of the City of Euless not sooner than 8:00 a.m. March 24, 1999, and not later than 5:00 p.m., March 31, 1999, in the manner and form as prescribed by law, and the Charter and Ordinances of the City of Euless, Texas. SECTION 4 The names of eligible and qualified candidates for such office shall be placed on the ballots for such election by the City Secretary at the time and in the manner prescribed by law, and the Charter and Ordinances of the City of Euless. SECTION 5 Early voting for the above designated election shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, weekdays from Wednesday, April 14, through Tuesday, April 27, from 8:00 a.m. to 5:00 p.m. and on Saturday, April 24, from 9:00 a.m. to 5:00 p.m. The early voting clerk for said election shall be the City Secretary, and applications for a ballot to be voted by mail shall be addressed to the Office of the City Secretary, 201 North Ector Drive, Euless, Texas, 76039, to be received no later than April 23, 1999. SECTION 6 Voting machines used for the conduct of the election, shall be procured, maintained, operated, sealed and the votes therefrom tabulated pursuant to procedures established and authorized by the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 7 The results of the election shall be certified, canvassed and returned in the form and manner prescribed by the laws of the State of Texas and the Charter and Ordinances of the City of Euless. SECTION 8 Notices of the election prescribed by this Resolution shall be promulgated, published and posted in keeping with the laws of the State of Texas and the Charter and Ordinances of the City of Euless. SECTION 9 Any runoff election required for the election of Counci! Member, Place Five of the City of Euless, Texas, following the regular election of May 1, 1999, shall be held on Saturday, May 29, 1999. SECTION 10 Early voting by personal appearance for Euless City Council Member, Place Five will be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, weekdays from Wednesday, April 14 through Tuesday, April 27, from 8:00 a.m. to 5:00 p.m. and on Saturday, April 24, from 9:00 a.m. to 5:00 p.m. Applications for ballots by mail Resolution No. 1016, Page 2 of 3 for the Euless City Council Election shall be mailed to Susan Crim, City Secretary, 201 North Ector Drive, Euless, Texas, 76039, to be received no later than 5:00 p.m., April 23, 1999. SECTION 11 Voting on Election Day, May 1, 1999, shall be conducted at two polling places, Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, and the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, between the hours of 7:00 a.m. and 7:00 p.m. Registered voters living in County Precincts 3036, 3160, 3183, 3247, 3329, 3335, 3336, 3391, 3414, 3432, 3511, and the portion of Precincts 3175 and 3457 that are within the City of Euless limits will vote at the Euless Public Library, 201 N. Ector Drive, Euless, Texas. Registered voters living in County Precincts 3216, 3389 and the portion of precincts 3322, 3390, 3396 and 3457 that are in the City of Euless limits will vote at Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas. SECTION 12 The following named persons are hereby appointed officers for said elections: Euless Public Library: Election Judge Barbara Girouard Altemate Judge Richard Girouard Bear Creek Elementary School: Election Judge Kim Collins Altemate Judge Martha Burleson Early Voting Ballot Board: Judge Martha Burleson The Presiding Election Judge for each precinct shall appoint not less than two nor more than ten qualified election clerks to serve and assist in conducting said election; provided, that if the Presiding Judge actually serves as expected, the Altemate Presiding Judge shall serve as one of the clerks. The Early Voting Ballot Board Judge shall appoint two other members of the Early Voting Ballot Board. All appointments shall be in accordance with the terms and provisions of the Texas Election Code. Election judges and clerks shall be compensated for services rendered at a precinct polling place at an hourly rate of $6 per hour. ADOPTED at a regular meeting of the Euless City Council on the 23rd day of March, 1999, by a vote of 7 ayes, 0 nays, and 0 abstentions.
