A RESOLUTION DECLARING A PUBLIC NECESSITY 1) FOR
THE ACQUISITION OF A PARCEL OF REAL ESTATE, OF
APPROXIMATELY 9.12 ACRES, REQUIRED FOR THE
CONSTRUCTION OF NEEDED ROADWAY AND PARK
IMPROVEMENTS ALONG MID- CITIES BOULEVARD AND, 2)
FOR TITLE CLARIFICATION FOR TWO PARCELS OF LAND
PREVIOUSLY DEEDED TO THE CITY OF EULESS
WHEREAS, the Texas Department of Transportation has agreed to design and
construct roadway paving improvements to Mid- Cities Blvd.; and has agreed to construct
park improvements adjacent to Mid - Cities; and
WHEREAS, the proposed roadway paving improvements will expand the current
two lane and four lane sections into six lane thoroughfare sections which will require
additional right -of -way; and park improvements will require additional right -of -way; and
WHEREAS, the City of Euless has agreed to provide the necessary right -of -way
to allow Texas Department of Transportation to construct the proposed roadway paving
and park improvements; and
WHEREAS, the City of Euless was previously deeded several parcels of land for
roadway and park purposes; and
WHEREAS, the City of Euless has a need for the clarification of title for the
existing roadway and park parcels; and
WHEREAS, the City Council of the City of Euless finds that a public necessity
exists for the acquisition of the aforesaid parcels of real estate, and that said parcels when
taken, shall be put to a public use for the benefit of the community at large.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
1HE CITY OF EULESS, TEXAS, THAT:
Section 1: There is a public necessity for the acquisition by the City of Euless
of the parcels described in Attachment 1.
Section 2: The real property interests designated in Attachment 1 are
necessary and proper for the construction of needed roadway and park improvements
along Mid - Cities Blvd., and to clarify title to certain existing property interests used by
the city for park and roadway purposes, and such improvements are hereby declared to be
a public use for a public purpose.
PASSED AND APPROVED at a regular meeting of the Euless City Council on
the 13th day of April, 1999, by a vote of 7 ayes, 0 nays, and 0 abstentions.
