HomeMy WebLinkAbout2024-05-13CITY OF EULESS ZONING BOARD OF ADJUSTMENT May 13, 2024 MINUTES The Pre -Session Meeting of the Zoning Board of Adjustment was called to order by Vice Chairman Moore at 5:30 p.m. on May 13, 2024 in the Pre -Council Conference Room, 201 North Ector Drive. Those present included Vice Chairman Clarence Moore, Board Members: Charles Cinquemani, Annabel Eads, Ron Young, and Alternate Board Member: Randy Byers. During the Pre -Session Meeting: ➢ Andrea Russell, City Attorney gave presentation on role and responsibilities of the Zoning Board of Adjustment members ➢ Lisa Payne, Assistant Director of Planning and Economic Development reviewed the regularagenda items. ZONING BOARD OF ADJUSTMENT CONSIDERATION OF SCHEDULED ITEMS -- COUNCIL CHAMBERS The regular meeting of the Euless Zoning Board of Adjustment was called to order by Vice Chairman Clarence Moore at 6:32 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. STAFF PRESENT: Michael Warrix, Director of Planninc and Economic Development Lisa Payne, Assistant Director of Planning and Economic Development David Pendley, Building Official Yvonne Garcia, Administrative Secretary of Planning and Economic Development VISITORS PRESENT: Jonathan Hake Chuck F-iixson Salesi Fono Ana Tu'ipulotu INVOCATION Board Member Eads gave the invocation. THE PLEDGE OF ALLEGIANCE Vice Chairman Moore led the pledge of allegiance. ITEM 1. ELECTION OF OFFICERS -CHAIRMAN AND VICE CHAIRMAN Page 1 of 4 Zoning Board of Adjustment Page 2 of 4 May 13, 2024 Board Member Young made a motion to nominate Clarence Moore as Chairman and Charles Cinquemani as Vice Chairman. Board Member Eads seconded the motion. The vote was as follows: Ayes: Chairman Moore, Vice Chairman: Cinquemani, Board Members: Eads, Young, and Alternate Board Member: Byers. Nays: None Abstention: None Chairman Moore declared the motion carried. (5-0-0) ITEM 2. APPROVED ZONING BOARD OF ADJUSTMENT MINUTES Chairman Moore made a motion to approve the minutes for the regular meeting of March 17, 2022 with a correction of a typo on Page 2. Board Member Cinquemani seconded the motion. The vote was as follows: Ayes: Chairman Moore, Vice Chairman: Cinquemani, Board Members: Eads, Young, and Alternate Board Member: Byers. Nays: None Abstention: None Chairman Moore declared the motion carried. (5-0-0) ITEM 3. HELD A PUBLIC HEARING FOR ZONING BOARD OF ADJUSTMENT CASE NO. 24-01-ZV AND CONSIDERED A REQUEST FOR A SETBACK VARIANCE Chairman Moore opened the public hearing at 7:05 p.m. Lisa Payne presented the case to the Zoning Board of Adjustment Members and advised that the applicant is requesting a variance from the side and rear setback of the R-5 zoning district in the Sotogrande Addition, Tract 22R1 at 1107 El Camino Real. Chairman Moore asked if the applicant wished to address the Board. Jonathan Hake, Cross Engineering, and Chuck Hixson, Vice President of Westdale Properties appeared to answer any questions. Chairman Moore asked to hear from anyone who wish to speak. Zoning Board of Adjustment Page 3 of 4 May 13, 2024 Seeing none, Chairman Moore closed the public hearing at 7:09 p.m Board Member Young asked who receives notices, if there is any hardship to the existing buildings and if this will affect any life safety or fire protection. Mrs. Payne answered that state law requires cities to send property notices to those who own property within 200 feet of the subject property, and that the Fire Marshal approved the layout. Board Member Cinquemani asked if there are any other options available to the applicant. Mr. Hake answered no. Other options would mean losing a building in the proposed multifamily development on the property to the north. Alternate Board Member Byers asked if they approve the variance, and it forces the existing buildings to be legal nonconforming, will they have to request another variance in the future for them to be in compliance. Mrs. Payne responded that they would not need to come back and doesn't affect the existing buildings future. There were no further questions or comments presented by the Board. Board Member Cinquemani made a motion to approve Case No. 24-01-ZBA for a Setback Variance for Sotogrande Addition, Tract 22R1 at 1107 El Camino Real, Board Member Eads seconded the motion. The vote was as follows: Ayes: Chairman Moore, Vice Chairman Cinquemani, Board Members: Eads_, Young, and Alternate Board Member: Byers. Nays: None Abstention: None Chairman Moore declared the motion carried. (5-0-0) ITEM 4. HELD A PUBLIC HEARING FOR ZONING BOARD OF ADJUSTMENT CASE NO.24-02-ZV AND CONSIDERED A REQUEST FOR A SETBACK VARIANCE Chairman Moore opened the public hearing at 7:18 p.m. Lisa Payne presented the case to the Zoning Board of Adjustments Members and advised that the applicant is requesting a variance from the front setback requirement of the R-1 zoning district in the Park Crestmoor Addition, Block 1, Lot 1 at 101 Ridgecrest Drive. Chairman Moore asked if the applicant wished to address the Board. Salesi Fono, appeared, gave presentation and available for questions. Zoning Board of Adjustment Page 4 of 4 May 13, 2024 Chairman Moore asked to hear from anyone who wish to speak. Ana Tu'ipulotu, property owner appeared and requested the board to consider the variance based on her family members, who also live in the home, decline of health. Amia Tuliiotu, neighbor appeared in support of the variance. Chairman Moore asked to hear from anyone who wish to speak. Seeing none, Chairman Moore closed the public hearing at 7:33 p.m. Board Member Cinquemani asked if wheelchair access is provided under the patio cover. Mr. Fono said there will be -one for a resident that requires a wheelchair. There were no further questions or comments presented by the Board. Board Member Cinquemani made a motion to approve Case No. 24-02-7_V for a Setback Variance for Park Crestmoor Addition, Block 1, Lot 1 at 101 Ridgecrest Drive. Alternate Board Member Byers seconded the motion. The vote was as follows: Ayes: Chairman Moore, Vice Chairman: Cinquemani, Board Members: Eads, Young, and Alternate Board Member: Byers. Nays: None Abstention: None Chairman Moore declared the motion carried. (5-0-0) ADJOURN There being no further business, the meeting was adjourned at 7:42 p.m. airman Clarence Moore
