HomeMy WebLinkAbout99-1039 10-12-1999RESOLUTION NO. 99 -1039 WHEREAS, federal legislative and regulatory initiatives impose significant controls and requirements upon Texas municipalities in regulating the nature, diversion and control of storm water drainage; and WHEREAS, the burden upon a municipality in monitoring and complying with such legislative and regulatory requirements is often substantially impacted by the development and regulatory controls imposed by upstream municipalities; and WHEREAS, there exists, under current Texas law, no uniform regulation or a requirement that a municipality implement and coordinate such storm water drainage and discharge and its impact on downstream municipalities, which lack of uniform requirements and failure of coordination, often creates and imposes substantial engineering, regulatory and monetary impact upon such downstream municipalities; and WHEREAS, legislation establishing uniform requirements and requiring coordination of effort in complying with such federally mandated regulations would be of substantial benefit to all Texas municipalities. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS; SECTION 1 That the City of Euless, Texas, supports the enactment of legislation which would encourage, promote, and establish certain regulatory requirements for the downstream discharge of surface water runoff and coordination of same with downstream municipalities in future development of real property improvements which would create additional downstream surface water drainage that would substantially impact downstream municipalities in their performance and compliance with federally mandated regulations. ADOPTED at a regular meeting of the Euless City Council on the 12th day of October, 1999, by a vote of 7 ayes, 0 nays, and 0 abstentions.
