A RESOLUTION CONCURRING WITH THE STATE'S DETERMINATION THAT A
PORTION OF THE STATE'S DRAINAGE EASEMENT IS NO LONGER NEEDED FOR
THE USE OF CITIZENS FOR DRAINAGE PURPOSES OR AS A ROAD AND THAT
THE EASEMENT BE RELEASED IN ACCORDANCE WITH STATE REGULATIONS.
WHEREAS, the State of Texas acquired and holds in its name a drainage easement on State
Highway 183 as described in Exhibit A attached hereto and made a part hereof, and
WHEREAS, the State of Texas has determined that said drainage easement is no longer needed
for drainage purposes or construction, maintenance and operation of State Highway 183, and
WHEREAS, City Staff have studied the public need for said drainage easement and have
determined that said easement is no longer needed for the use of citizens for drainage purposes or
as a road or for public transportation purposes, and is not suitable for conservation, park,
recreation and /or similar purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1. THAT the State of Texas' drainage easement shown on the attached Exhibit A is
no longer needed for the use of citizens for drainage purposes or as a road and is not suitable for
conservation, park, public transportation, recreation or similar purposes;
SECTION 2. THAT the City Council of the City of Euless, Texas concurs with the State's
plan to release the drainage easement in accordance with the established laws and regulations of
the State of Texas;
SECTION 3. THAT the Mayor of the City of Euless is authorized to enter into a maintenance
agreement with the State of Texas for the hereinabove referenced drainage easement upon
review and concurrence with said maintenance agreement.
PRESENTED AND APPROVED at a regular meeting of the Euless City Council on the 26th
day of October, 1999, by a vote of 6 ayes, 0 nays, and 0 abstentions.

FIELD NOTES
BEING a 0.986 acre tract of land situated in the Terrell Jasper Survey, Abstract No. 861, in the
City of Euless, Tarrant County, Texas, and being that same tract of land described as a drainage
easement to the State of Texas in the deed recorded in Volume 4169 at page 456 of the Deed
Records of Tarrant County, Texas, being also a portion of that certain 11.984 acre tract of land
conveyed to A.S. Patel as evidenced by a Special Warranty Deed with Vendor's Lien recorded in
Volume 13037 at page 356 of the Deed Records of Tarrant County, Texas, and being more
particularly described by metes and bounds as follows:
COMMENCING at the intersection of the west right -of -way line of Wilshire Drive (a 60 -foot wide
right -of -way) with the south right -of -way line of State Highway 183 (a variable width right -of-
way), being the northeast corner of Lot 10A, Block 3 of Wilshire Village, Section 7, as shown on
the plat recorded in Volume 388 -128 at Page 22 of the Plat Records of Tarrant County, Texas;
THENCE South 89 deg. 33 min. 39 sec. West, departing said west right -of -way line and along the
north line of said Lot 10A and said south right -of -way line a distance of 139.00 feet to a point for
the northeast corner of said Lot 10A in the east line of a called 15.051 acre tract of land conveyed
to A. S. Patel as evidenced by a Special Warranty Deed with Vendor's Lien recorded in Volume
12426 at Page 1484 of said Deed Records;
THENCE North 00 deg. 17 min. 49 sec. West, along said east line and said south right -of -way line
a distance of 13.01 feet to a 1/2 -inch steel rod found for an ell corner;
THENCE South 89 deg. 42 min. 00 sec. West along the north line of said called 15.051 acre tract
and said south right -of -way line, at a distance of 529.93 feet passing a 1/2 -inch steel rod found for
the northwest corner of said called 15.051 acre tract and the northeast corner of said 11.984 acre
tract, a total distance of 970.24 feet to a point for the northeast corner of said Drainage Easement,
being the POINT OF BEGINNING;
THENCE South 00 deg. 41 min. 53 sec. East, departing said south right -of -way line and along the
eastern line of said Drainage Easement, a distance of 154.43 feet to a point for the beginning of a
curve to the left having a central angle of 44 deg. 34 min. 17 sec., a radius distance of 220.00 feet, a
chord distance of 166.86 feet and a chord bearing of South 22 deg. 59 min. 02 sec. East;
THENCE Southeasterly along said Easement line and curve an arc distance of 171.12 feet to a
point for the end of said curve;
THENCE South 45 deg. 15 min. 53 sec. East, along said Easement line a distance of 179.83 feet to
a point for corner;

THENCE South 44 deg. 44 min. 07 sec. West, along said Easement line a distance of 80.00 feet to
a point for corner;
THENCE North 45 deg. 15 min. 53 sec. West, along said Easement line a distance of 179.83 feet to
a point for the beginning of a curve to the right having a central angle of 08 deg. 34 min. 16 sec., a
radius distance of 300.00 feet, a chord distance of 44.91 feet and a chord bearing of North 40 deg.
58 min. 34 sec. West;
THENCE Northwesterly along said Easement line and curve to the right an arc distance of 44.95
feet to a point of continuous curvature for a curve to the right having a central angle of 35 deg. 59
min. 07 sec., a radius distance of 300.00 feet, a chord distance of 185.34 feet, and a chord bearing
of North 18 deg. 41 min. 27 sec West;
THENCE Northwesterly along said Easement line and curve to the right, an arc distance of 188.43
feet to point for the end of said curve in the common line between said 11.984 acre tract and Farr -
Pacific, an addition to the City of Euless as shown on the plat recorded in Volume 388 -168 at Page
16 of the Plat Records of Tarrant County, Texas;
THENCE North 00 deg. 41 min. 53 sec. West, along said common line being the western line of
said Easement, a distance of 154.99 feet to al/2-inch steel rod with plastic cap stamped "Prism
Surveys" set for the northwest corner of said 11.984 acre tract in the previously said south right -of-
way line of S.H. 183;
THENCE North 89 deg. 42 min. 00 sec. East, departing said common line and along said right -of-
way line, a distance of 80.00 feet to the POINT OF BEGINNING;
and CONTAINING 42,943 square feet or 0.986 acre of land, more or less;
OF WHICH the following described portion is to be vacated:
BEGINNING at the above- described POINT OF BEGINNING;
THENCE South 00 deg. 41 min. 53 sec. East, departing said south right -of -way line and along the
eastern line of said Drainage Easement, a distance of 154.43 feet to a point for the beginning of a
curve to the left having a central angle of 44 deg. 34 min. 00 sec., a radius distance of 220.00 feet, a
chord distance of 166.84 feet and a chord bearing of South 22 deg. 58 min. 53 sec. East;
THENCE Southeasterly along said Easement line and curve an arc distance of 171.12 feet to a
point for the end of said curve;
THENCE South 45 deg. 15 min. 53 sec. East, along said Easement line a distance of 179.83 feet to
a point for corner;

a point in the previously said south right -of -way line of State Highway 183;
THENCE North 89 deg. 42 min. 00 sec. East along said right -of -way line a distance of 22.75 feet to
the POINT OF BEGINNING;
And CONTAINING 27,214 square feet or 0.625 acre of land, more or less;
of 15, 730 square feet or 0.361 acre of land, more or less.
