WHEREAS, The city of Euless in exercise of its police powers and in furtherance of the public health,
safety and welfare has adopted a Unified Development Code for the city of Euless; and
WHEREAS, an integral part and purpose of such Code is the screening of certain outside storage in
commercially zoned areas of the city so as to assure and provide visual buffering of such outside storage, enhance
the beautification of the city, safeguard and enhance property values, to protect public and private investment and
to preserve and protect the unique identity and environment of the city for its current and future development;
and
WHEREAS, exceptions and variances to such screening requirements for outdoor storage, including
the type and location thereof do not serve the welfare of the city and would create a disproportionate favor and
advantage between businesses conforming to such standards to those granted variances; and
WHEREAS, such variances would adversely affect the interests of the city and neighboring property
owners; and
WHEREAS, the Euless Zoning Board of Adjustment, on the 28th day of October, 1999 in Case No. 99-
07, did grant a variance to such screening requirements to permit a fence which does not comply with the setback
and masonry wall provisions of the Unified Development Code which the City Council perceives to be
significantly detrimental to the public welfare of the citizens of the city of Euless; and
WHEREAS, the Euless Unified Development Code specifically authorizes the City Council to initiate
proceedings to request revocation of a previously granted variance by the Zoning Board of Adjustment; and
WHEREAS, the Euless City Council desires to initiate such proceedings.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS;
That, the Euless Zoning Board of Adjustment, convene for the purpose of considering the revocation of
the variance granted in Zoning Board of Adjustment Case No. 99 -07.
That in taking such action the Euless City Council further acknowledges the uniqueness of its action and
at the precedent set thereby is, and should not be in anywise perceived or considered to be a reflection upon any
prior actions of the Zoning Board of Adjustment or the dedicated service of the members thereof in the
performance of their past and future service on such board on behalf of the citizens of Euless.
ADOPTED at a regular meeting of the Euless City Council on the 23rd day of November, 1999, by a
vote of 6 ayes, 0 nays, and 0 abstentions.
