AN ORDINANCE REPEALING EULESS ORDINANCE NO. 992,
ESTABLISHING THE CITY'S DEFINED SELF INSURANCE AND
RISK MANAGEMENT PROGRAM; CREATING THE RISK
CLAIMS BOARD OF THE CITY; CREATING THE RISK
MANAGEMENT FUND; PROVIDING THE TERMS FOR
WITHDRAWALS FROM THE FUND UNDER THE PROGRAM;
PROVIDING FOR WORKER'S COMPENSATION CLAIMS
ADMINISTRATION; AND CONTAINING OTHER PROVISIONS
RELATING THERETO; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Euless, Texas, on the 8th day of November, 1988, did
adopt Ordinance No. 992 providing for and authorizing a comprehensive plan of
self - insurance and risk management; and
WHEREAS, subsequent thereto, the City chose, in lieu of fully self - insuring and
administering its liability and risk program, _ to enter into a combination of
self - insurance, self administration, third party administration, insurance and
re- insurance; and
WHEREAS, previously adopted ordinances of the City of Euless and
self - enabling provisions of state law do provide for and authorize the plan and
program of risk management and insurance currently utilized by the City of Euless,
Texas; and
WHEREAS, the program and authority provided by Ordinance No. 992 is no
longer necessary, nor desirable.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
I.
Ordinance No. 992 finally adopted by the Euless City Council on the 8th day of
November, 1988, and providing for the establishment of a defined self - insurance and
risk management program; creating the Risk Claims Board for the city; creating the
Risk Management Fund; providing the terms for withdrawals from the fund under the
program; providing for worker's compensation claims administration; and containing
other provisions relating thereto shall be, and the same is hereby, repealed and is
null, void and of no consequence.

Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs�'arid
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Euless City Charter and the laws of
the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless
City Council on the 15h day of _ September. 1989; by a vote of 5 ayes, 0 nays,
ands abstentions; GIVEN SECOND READING AND APPROVED at a regular
meeting of the Euless City Council on the 26thday of September 1989; by a vote
of 5 ayes, 0 nays, and abstentions.
