HomeMy WebLinkAbout1044 01-08-1991ORDINANCE NO. 1044 AN ORDINANCE AMENDING SECTION 5 -1 OF CHAPTER 5 OF THE CODE OF ORDINANCES, CITY OF EULESS, TEXAS, TO INCREASE THE AD VALOREM EXEMPTION OF RESIDENCE HOMESTEADS OF RESIDENTS OF THE CITY OF EULESS SIXTY -FIVE (65) YEARS OF AGE OR OLDER FROM TWENTY -ONE THOUSAND FIVE HUNDRED FORTY DOLLARS ($21,540) TO THIRTY THOUSAND DOLLARS ($30,000) OF THE ASSESSED VALUE OF SUCH RESIDENCE. WHEREAS, Section 1 -b of Article VIII of the Constitution of the State of Texas authorizes political sub - divisions to exempt from ad valorem taxation a portion of the value assessed as to residence homesteads of residents who are sixty -five (65) years of age or older, and WHEREAS, the City of Euless, Texas, now exempts the sum of Twenty -one Thousand Five Hundred Forty Dollars ($21,540) of the assessed value of a residence homestead for such citizens and desires to increase such exemption to the sum of Thirty Thousand Dollars ($30,000). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS; I. That Section 5 -1 "Homestead ad valorem tax exemption for persons sixty -five (65) or over -- Granted" of Chapter, 5 "Finance and Taxation" of the Code of Ordinances, City of Euless, Texas, as amended, be hereby amended to hereafter be and read as follows: Sec. 5 -1. Homestead ad valorem tax exemption for persons sixty -five (65) or over -- Granted. From and after January 1, 1991, and upon compliance with the requirements hereafter set forth, there shall be exempted the sum of Thirty Thousand Dollars ($30,000) of the assessed value of residence homesteads of residents of the City of Euless, Texas, who are sixty -five (65) years of age or older from all ad valorem taxes thereafter levied by such city. II. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. III. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 8th day of January 1991, by a vote of 4 ayes, 0 nays, and 0 abstentions; GIVEN SECOND READING AND APPROVED at a regular meeting of the Euless City Council on the 22nd day of January 1991, by a vote of 4 ayes, 0 nays, and 0 abstentions.
