Jimmy Payton, Chairman Neal Adams, Vice Chairman Bob Pippin Glenn Walker Bill Byers arrived late Paul To mne, Attorney Susan Crim, City Secretary Bonnie O'Brien' Willie Mae McCormick Charlie Miller Bill Pasteur, Marland Ernest and Dwayne Wilcox were not present The following Bob Pippin moved to approve the minutes of the March 14, 1991, Charter Review Committee meeting. The motion was seconded by Bonnie O'Brien and carried by unanimous vote. Article X. Section 2 Neal Adams moved to amend Section 2 of Article X by accepting the language as recomyended in the City Attorney's letter dated March 15, 1991, for this section to read as follows: "The Planning and Zoning Commission shall: a) RecoYmnend a city plan for the physical development of the city, b) Recommend to the City Council approval or disapproval of proposed changes in the zoning plan, and c) Exercise advisory authority over platting or subdividing land within the corporate limits of the city and outside said corporate limits to the extent authorized by law. The Commission shall have and perform such additional duties as may be prescribed by ordinance, including the exercise of final authority over platting or subdividing land." The motion was seconded by Glenn Walker and carried by unanimous vote. Article XI. Sections 1 through 5 There were no changes recommended for Sections 1 through 5 of Article XI. CHARTER REVIEW COMMITTEE APRIL 11. 1991 PAGE 2 Article XI, Section 6 In Article XI, Section 6, Bob Pippin moved to accept the language as recommended in the City Attorney's letter dated March 28, 1991, for this section to read as follows: "Sec. 6 Regulation of Rates The council shall, to the extent and in the manner authorized by law, have full power to regulate by ordinance the rates, charges and fares of every public utility franchise holder operating in the City, provided that no such ordinance shall be passed as an emergency measure." The motion was seconded by Glenn Walker and carried by unanimous vote. Article XI, Sections 7 through 12 There were no changes recommended for sections 7 through 12 of Article XI. Article XII, Sections 1, 2 and 3 There were no changes recommended for Sections 1, 2 and 3 of Article XII. Article XII, Section 4 In Section 4 of Article XII, Glenn Walker moved to accept the language as recommended in the City Attorney's letter dated March 28, 1991, for the last sentence of this section to read as follows: "Any officer or employee of the city who shall violate the provisions of this section shall be punished as may be prescribed by law for such offense, and may forthwith be removed from office." The motion was seconded by Willie Mae McCormick and carried by unanimous vote. Neal Adams suggested the City Attorney review state statutes to see whether or not the City Council has the authority to remove one of its own members. If it does, should a mechanism be provided in the Charter for such removal or is it already provided by law. Article XII, Section 5 There were no changes recommended for Section 5 of Article XII. Article XII, Section 6 Bill Pasteur moved to amend Section 6 of Article XII by accepting the language as recommended in the City Attorney's letter dated March 28, 1991, for this section to read as follows: CHARTER REVIEW COMMITTEE APRIL 11. 1991 PAGE 3 "The City of Euless shall not be held responsible on account of any claim for damages to any person or property unless the person making such complaint or claiming such damages shall, within aNNL,,p..-iate periods prescribed by law or ordinance of the City, file with the City Secretary a written statement, under oath, detailing the incident, and if it be for personal injuries, giving a list of the witnesses, if any known to affiants, who witnessed such accident or such other or further report as may be required by applicable law or ordinance." The motion was seconded by Bob Pippin and carried by unanimous vote. Bill Byers arrived at the meeting at this time. Article XII. Sections 7 through 19 There were no changes recommended for Sections 7 through 19 of Article XII. Articles XIII and XIV Neal Adams moved to delete Articles XIII and XIV as they now exist and substitute an Article XIII that places with Council the authority to create, establish and organize by ordinance such boards and commissions as they deem necessary including, but not limited to, the Parks and Recreation Board and Library Board. The motion was seconded by Bill Pasteur and failed by a vote of 3-5 with one abstention as follows: AYES: Neal Adams, Bill Pasteur, Bob Pippin NAYS: Jimmy Payton, Willie Mae McCormick, Bonnie O'Brien, Charlie Miller, Glenn Walker ABSTAINED: Bill Byers Chairman Payton requested the City Attorney bring back the recommended changes in ballot proposition form at the next meeting which will be held at 7:00 p.m. on Thursday, May 9. The City Secretary will furnish to each Charter Review Committee member a copy of the Charter with the proposed changes in bold type for their review prior to the May 9 meeting.
