HomeMy WebLinkAbout1048 05-14-1991ORDINANCE NO. 1048 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTI- FIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE VILLAGES OF BEAR CREEK ADDITION; PROVIDING FOR A CHANGE OF ZONING FROM COMMUNITY UNIT DEVELOPMENT CONFORMING TO THE R -3 (12 U /A) AND R -5 (20 U /A) ZONING DISTRICT STANDARDS TO COMMUNITY UNIT DEVELOPMENT CONFORMING TO THE R -5 (21.5 U /A) ZONING DISTRICT REQUIREMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission has conducted a public hearing on April 2, 1991, in conjunction with Case No. 91 -04 ZC and has rendered a recommendation to the City Council with respect to same; WHEREAS, City Council has conducted a public hearing on April 23, 1991, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the official zoning distric map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district clas- sification of that 9.6028 acres of land known as Lot 1, Block 1, Villages of Bear Creek Addition, as filed at Tarrant County Deed of Records in Volume 388 -191, Page 63, generally located on the southeast corner of Mid - Cities and Fuller Wiser Road, be changed from Community Unit Development conforming to R -3 and R -5 Zoning District Ordinance requiremnts (per Ordinance #754) to Community Unit Development conforming to the R -5 zoning district requirements with limitations in density to a maximum of 21.5 U /A, and other requirements specified on the site plan labled as "Exhibit A," bearing Euless date stamp of May 14, 1991, (attached hereto and made a part hereof). Said property described in in "Exhibit A," pursuant to Section 7 -1100 of the Euless Zoning Ordinance, shall be subject to all the safeguards and conditions set forth on said site plan described herein as Exhibit "A." Said site plan shall be applicable only to the property described herein. SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One Thousand Dollars ($1,000), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 23rd day of April, 1991, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 14th day of May 1991, by a vote of 5 ayes, 0 nays, and 0 abstentions.
