April 19, 1976
The called meeting of the Euless City
Council was called to order at 7:50 P.M. in the Council Chamber of Euless
City Hall by Mayor Pro Tem Harold Samuels. Members present were: Mrs.
Willie Mae McCormick, Messrs. Ray Ozebek, Harold Copher, and Wayne Wright.
(Absent: Mayor A. C. Krause.)
Also present were City Manager W. M.
Sustaire, and Recording Secretary Bonnie O'Brien.
VISITORS
Visitors present were as follows: Messrs.
Frank Douglass, Wayne Sanderlin, Jan K. Boyd, C. G. Miller, Carl Tyson,
Charles Hunt, Mel McReynolds, Guy Jennings, Merrill C. Morong, Ivan Gregory, Jr.,
Barry Sanderlin, Warren Samuels, Bob Pippin, W. G. Ragley, W. R. Trahan, R. R.
Bolton, N. B. Gregory, Col. Don Perkins, Ronald Shields, Glenn Walker, Hugh

The invocation was given by Mr. Frank Douglass.
CANVASS ELECTION BALLOT
Mayor Pro Tem Samuels announced this meeting
was called for the purpose of canvassing the ballots cast in the Municipal
Run -Off Election for Mayor and for the Charter Amendment Election.
Mr. W. W. Cromer, Election Judge, announced
that 1,331 ballots were cast, and the election results are as follows:

Amendment No. 1
Should Section 2, Article II of the Euless City Charter be amended to change
the qualification for office of Mayor and Councilmen of the City of Euless
to conform with current constitutional requirements established by the courts
by deleting the requirement for real property ownership, by changing the
Euless residency requirement from two (2) years to one (1) year, and deleting
the requirement that a candidi�ate may not be in arrears in the payment of any
obligation due the City?

Amendement No. 2
Should Section 9, Article II of the Euless City Charter be amended to provide
a vacancy in the office of Mayor or any Councilman who has missed three (3)
regular consecutive meetings of the Council unless prevented from attendance
by sickness br unless leave of absence was previously obtained?

Amendment No. 3
Should Section 2, Article II of the Euless City Charter be amended to dispense
with the requirement of formal reading of each ordinance in its entirety by,
the Council and in place thereof allow the reading by the Council of the
descriptive caption of such ordinance which provides a briefer detail of the
terms and provisions of the ordinance?

Amendment No. 4
Should Section 3, Article II of the Euless City Charter be amended to change
the form of application to become a candidate for the office of Mayor or City
Councilman to conform with current constitutional requirements established by
the courts by deleting the requirement for real property ownership, changing
the Euless residency requirement from two (2) years to one (1) year, and
deleting the requirement that a candidate may not be in arrears of the payment
of any obligation due the City?

Amendment No. 5
Should Section 2, Article I and Article VI of the Euless City Charter be
amended to change the name of the City court from the "Euless Corporation
Court" to the "Euless Municipal Court" in compliance with recent changes in
state law; to provide for additional judges as such need may arise; and to
require that the Municipal Judge or Judges be an attorney at law?

Amendment No. 6
Should Section 12, Article VII of the Euless City Charter be amended to allow
the City Manager, without competitive bidding, to negotiate purchases or
contracts, up to the limits allowed by state law? (Recent change in state
law now allows for purchases or contracts up to $3,000 while the present
Charter imposes a $2,000 limit, without competitive bidding.)

Amendment No. 7
Should Section 6, Article IX of the Euless City Charter be amended to allow
the Euless City Council authority to establish the amount of delinquent
penalties and interest on unpaid City taxes?

Amendment No. 8
Should Section 2, Article XII of the Euless City Charter be amended so that
citizens of Euless will not be disqualified from holding office or employment
with the City solely because of the fact that they are a shareholder or
director owning less than five per cent (5%) of the stock of a company or
because they are strictly salaried employees of a company contracting or
selling to the City? Any officer or employee of the City having any other
financial interest in a contract with the City however, would continue to
be ineligible to serve as an officer or employee of the City?

Mayor Pro Tem Samuels stated there needed to
be a resolution forwarded to the State regarding the Charter Amendment Election.
Councilman Ozebek moved to approve Resolution
No. 358, accepting the tabulation of votes on the Charter Amendment Election
as presented by Mr. W. W. Cromer.
Mrs. McCormick seconded the motion and the
vote is as follows:
Ayes: Mr. Ozebek, Mrs. McCormick, Messrs. Samuels, Copher and Wright
Nays: None
Mayor Pro Tem Samuels declared the motion
carried.
Mayor Vro Tem Samuels stated that Amendment
one (1), Amendment four (4), and Amendment eight (8) failed.
Councilman Harold Copher moved to accept the
tabulation of votes on the Municipal Run -Off Election as presented by Mr. W. W.
Cromer, and declare Mr. Harold Samuels elected to the office of Mayor.

Mr. Ozebek seconded the motion and the
vote is as follows:
Ayes: Messrs. Copher, Ozebek, Wright, Samuels, and Mrs. McCormick
Nays: None
Mayor Pro Tem Samuels declared the
motion carried, and expressed leis appreciation to the Election Officials.
