AN ORDINANCE AMENDING CRDIPW CE No. 347, THE
OOKRNMEZEIVE MIME CRDI ANCE OF 7HE CITY OF
EULESS, TEXAS, BY RB2OIRING PAVED SURFACES IN THE
FRONT YARDS FOR THE PARTC{TG OF VEHICLES IN RESI-

WS, the Euless Zoning Ordinance requires a minimim, of off- street
parking to secure safety from fire, lessen congestion in the streets;
facilitate the adequate provision of transportation and to encourage
the most appropriate use of the land; and,
WHEREAS, in order to minimize any adverse impacts on parking in the
street and on grassy areas in front yards, it is deemed necessary to
require that all vehicles be parked on a paved surface on the proper-
ty; and,
WHEREAS, it is the desire of the City Council of the City of Euless,
Texas, to amend its Zoning Ordinance to conform to the request of the
Planning and Zoning Counission.
NOW IMMURE, BE 1T CREAMED BY THE CITY COUNCIL OF THE CITY OF
MI ES, TEXAS:
SSECTICN 1
TAT, Section 8 -500 "General Provisions" in the Minimum Off -Street
Parking section of the Euless Zoning Ordinance be amended by adding to
the end of said section subparagraph (7) to read as follows:
(7) Paved Surface Required: Dccept as otherwise
provided, it shall be unlawful for any person to
Park or to cause, suffer, maintain or allow to be
parked upon any property under his control any
vehicle, including but not limited to automobile,
truck, motorcycle, motorhome, camper, trailer,
boat or mobile home, on any property except upon
an all weather surface, except however, no all
weather surface shall be required if:
(1) said vehicle is parked within a rear or side
yard and is screened from view from adjacent
properties and public streets in accordance with
Section 10 -104 of this code, or;
(2) the houga was originally built with a one -car
garage or with no garage.
SECTION 2
'UQT, Section 8 -500 "General Provisions" in the Minimum Off -Street
Parking section of the Euless Zoning Ordinance be amended by adding to
the end of said section sub - paragraph (8) to read as follows:
(8) All Weather Surface Defined: Except for fire
lanes and drives serving loading and trash recep-
tacle areas, which shall be engineered to support
anticipated maximum loads, all weather surface
shall consist of paving that meets the minimum
standard equivalent of a four (4) inch concrete
slab having a minimum compressive strength of
3,000 p.s.i., with 6" x 6" ten -gauge mesh suspend-
ed in the center of the slab or two-inch hot mix
asphaltic concrete over compacted six-inch crushed
rock base. Exceptions to these pavements may be
approved by the City Engineer, and be based on
equivalency.

SEi1FRAEt7IJR7l CIAIJSE. That it is hereby declared to be the intention
of the City Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any court
of ccayetent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by
the City Council without the incorporation in this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or section.

PENALTY Ft VIOJATIQN. Any person, firm or corporation violating any
of the terms and provisions of this ordinance shall be deemed guilty
of a misdemeanor and, upon conviction thereof, shall be fined in an
amount not to exceed $1000.00. Each such violation shall be deemed a
separate offense and shall be punishable as such hereunder.

EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after its passage and publication for buildings constructed
hereafter, and in one year for all existing structures, as provided by
the Euless City Charter and the laws of the State of Texas.

FMS, the Euless Zoning Ordinance requires a minimum of off- street
parking to secure safety from fire, lessen congestion in the streets;
facilitate the adequate provision of transportation and to encourage
the most appropriate use of the land; and,
WHEREAS, in order to protect property values, minimize adverse impacts
that parking on fwtL lawns has on neighborhoods, it is deemed
necessary to require that all vehicles be parked on a paved surface on
the property.

EULE S, TEXAS:
SOCTION 1
THAT, Section 8 -500 "General Provisions" in the Minimum Off- Street
Parking section of the Euless Zoning Ordinance be amended by adding to
the end of said section sub - paragraph (7) to read as follows:
(7) Paved Surface Required: Except as otherwise
provided, it shall be unlawful for any person to
park or to cause, suffer, maintain or allow to be
parked upon any property under his control any
vehicle, including but not limited to an automo-
bile, truck, motorcycle, motorhome, carper,
trailer, boat or mobile home, except upon an all
weather surface, except however, unless:
(1) the vehicle is parked within a rear or side
yard and is screened fluid view fi mt adjacent
properties and public streets in accordance with
Section 10 -104 of this code, or;
(2) the property is zoned for single family na
and the residents existing thereon was originally
constructed prior to July 12, 1977, with only a
one -car garage or with no garage.

THAT, Section 8 -500 "General Provisions" in the Minimum Off -Street
Parking section of the Euless Zoning Ordinance be amended by adding to
the end of said section subparagraph (8) to read as follows:
(8) All Weather Surface Defined: Except for fire

necessary to access the parked vehicles, includes
access there to that meets the minimum mm standard
equivalent of a four (4) inch concrete slab having
a minimum ressive strength of 3,000 p.s.i.,
with 6" x 6" ten-gauge mesh suspended in the
center of the slab or two -inch hot mix asphaltic
concrete over compacted six -inch crushed rook
hasp. Exceptions to these pavements may be
approved by the City Engineer, and be based on
equivalency.
