HomeMy WebLinkAbout1079 04-28-1992ORDINANCE NO. 1079 AN ORDINANCE AMENDING SECTION IV OF ORDINANCE NUMBER 889, SAME BEING THE UNIFORM BUILDING CODE, UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, UNIFORM HOUSING CODE, AND UNIFORM MECHANICAL CODE OF THE CITY OF EULESS, TEXAS; RAISING THE MAXIMUM FINE TO TWO THOUSAND DOLLARS ($2,000.00) FOR A VIOLATION OF THE AFOREMENTIONED CODES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. That Section IV "Penalty for violation" of Ordinance No 889, same being the Uniform Building Code, Uniform Code for the Abatement of Dangerous Buildings, Uniform Housing Code, and Uniform Mechanical Code of the City Euless, Texas, as same may have been from time to time amended, is hereby amended to hereafter be and read as follows: Sec IV. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined as provided in Section 1 -6 of the Euless Code of Ordinances for violation of a provision governing fire safety, public health or zoning. Each day that such violations shall continue or be permitted to exist shall constitute a separate offense and shall be punishable as such hereunder. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause That Ordinance No 889 and the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. ORDINANCE NO. 1079 Page 1 Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas; provided, however, that the provisions of this ordinance shall apply only to offenses committed on or after the effective date of this ordinance. Offenses committed before the effective date of this ordinance are subject to the former penalty in effect on the date of commission of such offense. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 28th day of April 199_L; ; by a vote of 4 ayes, 0 nays and 0 abstentions. PRESENTED AND PASSED ON SECOND AND FINAL READING at a regular meeting of the Euless City Council on the 12th day of May 1992 by a vote of 7 ayes, 0 nays and 0 abstentions.
