HomeMy WebLinkAbout2025-02-20CITY OF EULESS ZONING BOARD OF ADJUSTMENT FEBRUARY 20, 2025 MINUTES The Pre -Session Meeting of the Zoning Board of Adjustment was called to order by Chairman Moore at 5:45 p.m. on February 20, 2025 in the Pre -Council Conference Room, 201 North Ector Drive. Those present included Chairman Clarence Moore, and Vice Chairman, Charles Cinquemani Board Members: Carol Dufinetz, Ron Young, and Alternate Board Member: Zack Penn. Board Member, Randy Byers was absent. During the Pre -Session Meeting: Andrea Russell, City Attorney gave presentation on role and responsibilities of the Zoning Board of Adjustment members ➢ Lisa Payne, Assistant Director of Planning and Economic Development reviewed the regular agenda items. ZONING BOARD OF ADJUSTMENT CONSIDERATION OF SCHEDULED ITEMS -- COUNCIL CHAMBERS The regular meeting of the Euless Zoning Board of Adjustment was called to order by Chairman Clarence Moore at 6:30 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. STAFF PRESENT: Michael Warrix, Director of Planning and Economic Development Lisa Payne, Assistant Director of Planning and Economic Development David Pendley, Building Official Yvonne Garcia, Administrative Secretary of Planning and Economic Development VISITORS PRESENT: Gene Vest • Vernon Gilmore Catherine Gunn Rosas INVOCATION Board M;ember Dufinetz gave the invocation. APPROVED ZONING BOARD OF ADJUSTMENT MINUTES Vice Chairman Cinquemani made a motion to approve the minutes for the regular meeting of May 13, 2024. Board Member Dufinetz seconded the motion. The vote was as follows: Ayes: Chairman Moore, Vice Chairman: Cinquemani, Board Members: Dufinetz, Young, and Alternate Board Member: Penn. Nays: None Abstention: None Chairman Moore declared the motion carried. (5-0-0) ITEM 3. HELD A PUBLIC HEARING FOR ZONING BOARD OF ADJUSTMENT CASE NO. 24-03-ZBA AND CONSIDERED A REQUEST FOR A FENCE VARIANCE Chairman Moore opened the public hearing at 6:35 p.m. Lisa Payne, Assistant Director of Planning and Economic Development presented the case to the Zoning Board of Adjustment Members and advised that the applicant is requesting a fence variance in the Morrisdale Addition, Block 17, Lot 15 at 1504 Cliffwood Road in the R-'1 Single -Family Detached Dwelling zoning district. The applicant is proposing to construct a 12-foot tall wood fence with horizontal pickets to maintain privacy on his property due to the steep topography compounding the changes made on the property to the west, across his rear lot line.. She also explained that the neighbor has constructed an accessory structure to use as a guest house, which appears one story taller due to the topography. The construction has required the removal of several trees in the neighbor's heavily treed lot and has impacted the view and privacy. Due to the topography, it has been determined that a 12-foot-tall fence would sufficiently screen the views from one backyard to another and staff recommended approval. Property notices were sent to those who own property within 200 feet of the subject property and staff received one response in favor. Chairman Moore asked if the applicant wished to address the Board. Gene Vest, applicant appeared and was available for any questions. Chairman Moore asked to hear from anyone who wish to speak. Catherine Roses, neighbor at 1505 Shady Creek Drive appeared and in support of the variance. Zoning Board of Adjustment Page 3 of 3 February 20, 2025 Chairman Moore asked if there was anyone else who wishes to speak on this property. There being none, Chairman Moore closed the public hearing at 6:45 pm. Board Member Young stated that, based on the photos and presentation provided, it is apparent that the hardship on the property was not created by the owner. Board Member Cinquemani inquired about the status of the existing fence. Mr. Vest confirmed that the replacement will be a 12-foot fence. There were no further questions or comments presented by the Board. Board Member Young made a motion to approve Case No. 24-01-ZBA for a Fence Variance for Sotogrande Addition, Tract 22R1 at 1107 El Camino Real. Alternate Board Member Penn seconded the motion. The vote was as follows: Ayes: Chairman Moore, Vice Chairman Cinquemani, Board Members: Dufinetz, Young, and Alternate Board Member: Penn. Nays: Nona Abstention: None Chairman Moore declared the motion carried. (5-0-0) ITEM 3. ADJOURN There being no further business, the meeting was adjourned at 6:57 p.m. 16117' Chairman e ce Moore
