HomeMy WebLinkAbout2426 06-24-2025ORDINANCE NO. 2426 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF EULESS, CHAPTER 84, UNIFIED DEVELOPMENT CODE, AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON APPROXIMATELY 3.147 ACRES IN THE VILLAGES OF BEAR CREEK, BLOCK 2, LOT 3 LOCATED AT 2301 STATE HIGHWAY 360, REZONING FROM COMMUNITY UNIT DEVELOPMENT (CUD) DISTRICT TO PLANNED DEVELOPMENT (PD) DISTRICT AS DESCRIBED HEREIN AND ON THE ATTACHED EXHIBITS; PROVIDING FOR DEVELOPMENT STANDARDS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on June 3, 2025, in conjunction with Zoning Case No. 24-07-PD, and has rendered a recommendation to the City Council with respect to this case; and WHEREAS, the City Council has conducted a public hearing on June 24, 2025, considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. The official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification of approximately 3.147 acres in the Villages of Bear Creek Addition, Block 2, Lot 3 located at 2301 State Highway 360, is changed from Community Unit Development (CUD) District to Planned Development (PD) District, as described herein and on the attached exhibits. Said property described above shall be subject to all the safeguards and conditions set forth within the attached exhibits or stipulated herein. Said exhibits shall be applicable only to the property described in herein. In the event of any conflict or inconsistency between these PD Standards and the applicable City regulations, the terms and provisions of these PD Standards shall control. In the event a development standard or regulation is not addressed herein, the standards of Chapter 84 "Unified Development Code" and other City regulations apply. Local building codes, life safety codes, and all applicable Federal, State and Local regulations take precedence where any standard requires or recommends actions that are in conflict with such codes and regulations. SECTION 2. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Chapter 1, "General Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 4. SAVINGS CLAUSE. All rights and remedies of the City of Euless are expressly saved as to any and all violations of the provisions of the Euless Unified Development Code applicable to the Property that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 5. PUBLICATION. The caption, penalty clause, and effective date clause of this ordinance shall be published in a newspaper of general circulation in the City of Euless, in compliance with the provisions of Article II, Section 12 of the Euless City Charter. SECTION 6. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. This Planned Development ("PD") is intended to provide a framework for the construction of the twenty-five (25) townhomes on 3.147 acres of land located approximately 950 feet north of the northwest intersection of State Highway 360 and Mid Cities Boulevard. Access to the site is via the southbound State Highway 360 service road. The two-story townhomes will be a minimum of 1,600 square feet and will feature an enclosed two -car garage in addition to two driveway spaces per unit. To the west of the subject property is Extra Space Storage, to the north is the Harlowe Apartments (multi- family), and to the south is a gas well pad site. A green space with a retention pond is planned for the east side of the project as a buffer to State Highway 360. In addition, an enclosed dog park is planned for the use of the residents and their pets. The request for PD zoning is required since the roadways within the property are proposed to be private streets and fire -lanes (called "Mutual Emergency Access, Drainage, and Utility Easement" or "MEADUE") that are twenty-six (26) feet in width. The current TH-Townhome zoning regulations call for a maximum of four (4) units per building — two of the proposed buildings are planned with five (5) units each; one building is planned with seven (7) units, and the fourth building is planned for eight (8) units. Minor changes in setbacks and other development regulations are also proposed to accommodate the villas. Mid Cities Villas at DFW will bring much -needed housing to Euless, at a medium density, and utilize a small tract of land that otherwise would be unsuitable for many land uses. Ordinance No. 2426, Page 6 of 13 o- w.n ro e Mid Cities Villas at DT-W CASE #24-07-PD DEVELOPMENT REGULATIONS Permitted Uses. The single permitted use for this Planned Development shall be townhomes. They will be designed with a two -car front -loading garage and will be two stories in height (maximum 35 feet). Residential Development Regulations. 1. The property is regulated by Ordinance No. 851 which amended Ordinance No. 347 (the City of Euless Zoning Ordinance) and established a Community Unit Development zoning district (CUD). The area within the CUD that applies to the 3.147 acre subject property is subject to the R-3, Multiple -Family Low Density Dwelling zoning district with the further limitation of no more than eight (8) units per acre. The R-3 zoning district allows townhome development. PD Planned Development district regulations shall be as defined by the TH Townhouse Dwelling district regulations in Sec. 84-107.5 of the Code of Ordinances, as amended, with the following modifications: Mid Cities Villas at DFW Planned Development Development Items PD Standards Minimum Lot Area 1,890 sq ft Minimum Lot Width 27 ft Minimum Lot Depth 70 feet Minimum Floor Area per Unit 1,600 Minimum Front Yard 20 ft Minimum Exterior Side Yard 5 ft Minimum Interior Side Yard 0 ft Minimum Rear Yard 10 feet Maximum Structure Height (at peak) 2 stories/35 ft Maximum Lot Coverage 60% Dwelling Unit Density 8 units per acre Maximum Number of Units Per Structure 8 Residential Design and Materials. 1. Building Materials. In the context of approved building materials, a "facade" does not include doors, garages, fascia, windows, dormers, window box -outs, bay windows, recessed porches or patios, soffits, and eaves. (a) Except for windows, doors, garage doors, balconies, recessed patios or porches, the front facades shall be a combination of a minimum of 70% brick or stone and a maximum of 30% cementitious fiberboard and/or three -step stucco on front elevations. (b) No single exterior material shall comprise the entire front facade of any building. (c) Side and rear facades shall be a minimum of 30% brick or stone and a maximum of 70% cementitious fiberboard and/or three -step stucco. Any facade may include accent materials 24-07-PD Mid -Cities Villas at DFW Development Regulations page 1 Ordinance No. 2426, Page 7 of 13 not listed above, except that aluminum siding, vinyl siding, concrete block, reflective glass, and galvanized steel are prohibited. 2. Roof Design. All pitched roofs of the residential buildings shall have a minimum pitch of 6:12 to facilitate an architecturally pleasing ridgeline. 3. Residential Garages and Parking. (a) Each townhome shall have a minimum of two enclosed parking spaces and two additional parking spaces in the driveway. (b) Driveways shall be a minimum of 20 feet in length from the Mutual Access, Drainage, and Utility Easement (MEADUE). (c) An 18 foot wide driveway shall be paved with concrete in the front yard. 4. Accessory Structures. Accessory structures of any kind are prohibited. Landscaping, Amenities, and Open Space. 1. Landscaping Requirements. (a) Automatic underground irrigation shall be provided throughout the development. (b) All trees, plants, and grasses shall be chosen from the City of Euless landscape list. (c) Each townhome shall have a minimum of 270 square feet of fenced yard space. (d) Each townhome shall have two ornamental trees (minimum 8' in height): one to be located in the front yard and the second in the rear yard. (e) Each townhome shall have a minimum of three shrubs (minimum 3 gallon in size) visible from the MEADUE and adjacent to the front entrance. Large decorative grass plants (minimum 3 gallons in size) may be substituted for the shrubs. (f) Existing shade trees along the northern property line and within the open space adjacent to State Highway 360 will be retained if possible. Additional shade trees in the open space and appropriate shrub/grass plantings will be provided. 2. Amenities and Open Space. (a) The open area adjacent to State Highway 360 shall be developed into a passive recreation area with a detention pond and benches for seating. At least ten (10) shade trees shall be provided outside of the proposed 10' utility easement adjacent to the proposed masonry screening wall. (b) A separate area shall be designed as a dog park or an amenity of equal value. The proposed dog park will be enclosed with minimum five-foot tall wrought iron fence. The dog park shall be a minimum of 2,000 square feet in size. (c) Open areas shall be designated on the Concept Plan, the Landscape Plan, and on all approved plats for the property. 3. Access/Maintenance. (a) An HOA common area lot five feet in width shall be located behind all townhome rear yards for mutual access. This HOA lot may be utilized as a pedestrian trail surrounding the property. The trail will consist of black Tejas crushed rock (or similar walkable material). (b) A similar HOA common area lot five feet in width will be provided between the rear yards of the ten townhomes in the center of the project that back to one another. (c) Both of the common area lots mentioned in (a) and (b) above shall be maintained by the Homeowners Association (HOA) and/or property management company. 24-07-PD Mid -Cities Villas at DFW Development Regulations page 2 Ordinance No. 2426, Page 8 of 13 (d) All open areas, other than the five foot wide common area lots mentioned in (a) and (b) above, shall be irrigated and maintained by the Homeowners Association (HOA) and/or property management company. (e) Residents' front and side yards shall be irrigated maintained by the Homeowners Association (HOA) and/or property management company. (f) Residents' rear yards shall be the responsibility of each homeowner or resident. Fencing. 1. Exterior fencing for the property shall be as follows: (a) No fencing shall be provided along the west and north property lines; (b) A six foot tall masonry screening wall shall be provided on the east property adjacent to the proposed 10' utility easement with a crossing of the easement along the north end. 2. Individual townhome fencing shall be as follows: (a) Rear fencing at the lot line of each unit and the side lot line of corner units shall be constructed of wrought iron and be a minimum of six feet in height. (b) The fences between individual rear lots may be wood for privacy and shall be a minimum of six feet in height. (c) End units may have fencing extended to the adjacent side lot line but are not permitted to encroach within the front setback. (d) Fencing between the ten townhomes located at the center of the property, backing to each other shall be as follows: (i) A five foot wide access easement, extending from the north MEADUE to the south MEADUE shall be provided between the rear of these ten units; (ii) A six foot tall wrought iron fence shall be provided at the rear of each of these townhomes. Parking and Access. 1. Each townhome unit will meet the parking requirements of the Zoning Ordinance with two enclosed spaces. All driveways will provide two additional spaces per unit. In addition, five (5) additional parking spaces will be provided for guest parking. 2. Access to SH 360 will be provided via an existing MEADUE easement which connects SH 360 to the self -storage business located west of the subject property. 3. All private streets/MEADUEs, parking spaces, driveways, and areas located within the property are required to comply with ADA regulations, as applicable, and shall be constructed and maintained with concrete according to City of Euless standards. Private Street Addressing. Since the only method of addressing Mid Cities Villas at DFW would be to assign the townhomes State Highway 360 addresses, the GIS staff member for the City of Euless will provide a set of assigned addresses along the private streets. The private streets will be differentiated from public streets within the city by the different color of the placard. The developer shall choose the street names, subject to approval of the City of Euless. Home Owners Association.
