HomeMy WebLinkAbout1092 11-10-1992ORDINANCE NO. 1092 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM NEIGHBORHOOD BUSINESS DISTRICT (C -1) AND COMMUNITY BUSINESS DISTRICT (C -2) TO PLANNED DEVELOPMENT (PD) FOR SINGLE FAMILY DETACHED (R -1) WITH ADDITIONAL STIPULATIONS ON CERTAIN PROPERTY OUT OF THE J. P. HALFORD SURVEY, A -711; PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission has conducted a public hearing on August 18, 1992, and September 1, 1992, in conjunction with Zoning Case No. 92 -08, and has rendered a recommendation to the City Council with respect to same; WHEREAS, City Council has conducted a public hearing on September 22, 1992, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district classification of that 16.720 acres of land generally located fronting the south of Harwood and east of F.M. 157, more specifically described in Exhibit "A" (attached hereto and made a part hereof), be changed from Neighborhood Business District (C -1) and Community Business District (C -2) to (PD -R -1) Planned Development for single - family detached housing conforming to the R -1 zoning district standards and the following additional requirements and conditions: Minimum floor area per dwelling unit of 1,400 square feet; Side building lines adjacent to streets not less than 15 feet; The lots backing up to Lots Number 5R through 7R and IOR through 12R of Block 39, Midway Park Addition, be limited to single story units; Side setbacks for fences adjacent to streets shall not be less than 10 feet from the property line; A twenty -five foot triangle for sight visibility and pedestrian easement shall be provided on all street intersections; No driveways permitted onto Harwood Road; 7. All newly constructed streets shall be of concrete; 8. The extension of Timber Ridge Drive shall be, at a minimum, a four lane boulevard entry; 9. A screening wall be extended across the frontage of Harwood, be a minimum of six feet in height masonry wall, located on private property and be maintained by an owners association; 10. That street landscaping be provided in the form of four inch diameter trees (minimum) set on a minimum of forty feet on centers located in the right -of -way and in accordance with the City's tree ordinance and that said trees be irrigated in a manner that is acceptable to the City; SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two - Thousand Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
