HomeMy WebLinkAbout2428 08-12-2025ORDINANCE NO. 2428 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF EULESS, CHAPTER 84, UNIFIED DEVELOPMENT CODE, AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON APPROXIMATELY 2.057 ACRES IN THE MIDWAY SQUARE PHASE THREE ADDITION, BLOCK E, LOT 1, LOCATED AT THE NORTHEAST CORNER OF EAST MIDWAY DRIVE AND FULLER - WISER ROAD, REZONING FROM NEIGHBORHOOD BUSINESS (C- 1) DISTRICT TO PLANNED DEVELOPMENT (PD) DISTRICT AS DESCRIBED HEREIN AND ON THE ATTACHED EXHIBITS; PROVIDING FOR DEVELOPMENT STANDARDS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on July 1, 2025, in conjunction with Planned Development Case No. 23-05- PD, and has rendered a recommendation to the City Council with respect to this case; and WHEREAS, the City Council has conducted a public hearing on August 12, 2025, considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. The official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification of approximately 2.057 acres in the Midway Square Phase Three Addition, Block E, Lot 1, located at the northeast corner of East Midway Drive and Fuller - Wiser Road, is changed from Neighborhood Business (C-1) District to Planned Development (PD) District, as described herein and on the attached exhibits. Said property described above shall be subject to all the safeguards and conditions set forth within the attached exhibits or stipulated herein. Said exhibits shall be applicable only to the property described in herein. In the event of any conflict or inconsistency between these PD Standards and the applicable City regulations, the terms and provisions of these PD Standards shall control. In the event a development standard or regulation is not addressed herein, the standards of Chapter 84 "Unified Development Code" and other City regulations apply. Local building codes, life safety codes, and all applicable Federal, State and Local regulations take precedence where any standard requires or recommends actions that are in conflict with such codes and regulations. SECTION 2. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 3. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Chapter 1, "General Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 4. SAVINGS CLAUSE. All rights and remedies of the City of Euless are expressly saved as to any and all violations of the provisions of the Euless Unified Development Code applicable to the Property that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 5. PUBLICATION. The caption, penalty clause, and effective date clause of this ordinance shall be published in a newspaper of general circulation in the City of Euless, in compliance with the provisions of Article II, Section 12, of the Euless City Charter. Further, this ordinance may be published in pamphlet form and shall be admissible in such form in any court, as provided by law. SECTION 6. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. Ordinance No, 2428, Page 4 of 10 #23-05-PD — PLANNED DEVELOPMENT (PD) — HERITAGE GARDENS RESIDENTIAL DEVELOPMENT STANDARDS. This is a proposal to rezone the subject property from C-1 Neighborhood District to PD Planned Development District with a base zoning of R-1 L Single Family Limited Dwelling District. The development standards of the Planned Development zoning district shall be as defined by the Single - Family Limited Dwelling (R-1 L) zoning district under Section 84-103 of the Euless Unified Development Code as amended unless modified by the design associated with the development as shown in the Concept Plan or as follows: A. Density: There shall be a maximum of ten (10) Single -Family Residential Lots on the 2.057 acres within the Heritage Gardens at Midway development. Resulting in an overall maximum density of 5 units per acre. B. Lot Sizes: The lot sizes with Heritage Gardens at Midway shall be as follows: Lot Sizes R-1 L PD Minimum Lot Area 5200 SF Minimum Lot Width 40 FT Minimum Lot Depth 100 FT C. Setbacks and Lot Coverage: The setbacks at Midway are as follows. Setback Description R-1 L PD Front Yard setback** 20 Ft Living Area/Garage Setback Side Yard Setback 6 FT Rear Yard Setback 20 FT Max. Lot Coverage 75% and lot coverage criteria for Heritage Gardens **Front porches, eves, bay windows and chimneys shall be permitted to encroach upon the setback building line. D. Allowed Uses: Only two allowed uses shall be permitted: a. Single Family detached residence b. Neighborhood Open Space with typical accessory structures and parking spaces to be maintained by the HOA. E. Open Space: There are two (2) open space lots, Lot A and Lot B, within Heritage Gardens at Midway. a. The open space lot areas will be fully maintained by the Heritage Gardens at Midway HOA. b. In the park area of an open space lot there shall be a one (1) shade structure and seating for a minimum of six (6) people. c. All amenities must be installed before the first residential building permit is issued. F. Sidewalks and Trails: five-foot (5') wide sidewalks shall be constructed by the developer adjacent to the open space park in HOA Lot A, and between Boon Ct and the residential lots. These sidewalks will be part of HOA Lot A and shall be maintained by the HOA. A five-foot (5') wide sidewalk shall be constructed by the developer in E. Midway Drive right-of-way (ROW). This sidewalk and the existing sidewalk in Fuller -Wiser Road ROW will be maintained by the City of Euless. G. Building Exterior Materials allowed: a. 80% on first and second floor: Brick and/or Stone b. 20% on first and second floor: Wood/Hardy Board/Cementitious Fiberboard c. Doors and Windows count towards first floor exterior mix calculations. H. Parking: A minimum of four (4) off-street parking spaces will be provided on each lot, two (2) enclosed and two (2) in the driveway. I. Lot Grading: All lots shall be graded to meet the minimum city standards. Lots 7, 8, 9 and 10 shall be graded to have a MFF (Min. Finish Floor) of 2.0' above the base flood elevation as these lots are in a Ordinance No, 2428, Page 5 of 10 portion of the FEMA Floodplain. J. Tree Preservation: Every attempt will be made to save existing quality trees on the site where feasible. The following requirements shall apply: a. Unless otherwise exempted by this ordinance, the following procedures shall apply to protect any tree which will be preserved within this development. b. All persons submitting construction plans shall ensure that such plans comply with the requirements of this ordinance. c. The following activities are prohibited within the limits of the critical root zone of any protected tree subject to the provisions of this ordinance. i. Material Storage: No storage or placement of materials intended for use in construction or water materials accumulated due to excavation or demolition shall be placed within the limits of the critical root zone of any protected tree. ii. Equipment cleaning/Liquid disposal: No equipment shall be cleaned or other liquids, including without limitation paint, oil, solvents, asphalt, concrete, mortar or similar materials deposited or allowed to flow into the critical root zone of a protected tree or the existing onsite creek. iii. Tree Attachments: No signage, wire or other attachments, other than those of a protective nature, shall be attached to any protected tree. iv. Vehicular Traffic: No vehicular and/or construction equipment traffic or parking shall take placed within the critical root zone of any protected tree other than on existing street pavement. This restriction does not apply to single incident access within the critical root zone for purposes of establishing the building pad and associated lot grading, vehicular traffic necessary for routine utility maintenance, emergency restoration of utility service, or routine mowing operations. v. Impervious Paving: No paving with asphalt, concrete or other impervious materials shall be placed within the limits of the critical root zone of a protected tree except as otherwise allowed in this ordinance. vi. Drip Line limits: No heavy equipment included but not limited to trucks, tractors, trailers, bulldozers, bobcat tractors, trenchers, compressors, and hoists, shall be allowed inside the drip -line of any protected tree on any construction site without prior written approval of the City Building official. d. The following procedures shall be followed on all types of construction projects (including residential, land development, municipal/public domain projects): i. Protective Fencing: Prior to the issuance of any building or earth disturbance permit, or commencing consultation, the owner, contractor or subcontractor shall construct and maintain, for each protected tree on a construction site, a protective fencing which encircles the outer limits of the critical root zone or drip -line whichever is greater of the tree to protect it from construction activity or in cases of heavily wooded sites, as approved by the City Building official. ii. All protective fencings shall be in place prior to commencement of any site work and remain in place until all exterior construction activity at the site has been completed. iii. Protective fencing shall be at least four (4) feet high, clearly visible, and shall have a tree protection sign affixed to the fence every twenty (20) feet in such a manner to be clearly visible to workers on the site. iv. The use of orange vinyl construction fencing, or similar fencing, is generally permitted only if there is no construction or vehicular activity within ten (10) feet of the fence. If construction activity or vehicular activity is expected within ten (10) feet of the fence, then the fence shall be constructed with Chain Link or a similar metal/wooden material or semi -rigid vinyl tape fencing supported with a top support wire or equivalent support material affixed to a metal or wooden post(s), all of which shall be a minimum of six (6) feet high. K. Homeowners' Association (HOA). a. A mandatory homeowner's association will be established for this Planned Development. The responsibilities of the association will include in perpetuity ownership and maintenance of the screening devices, trees, landscaping, all entryway signage, decorative features, all interior "streets", alleys, sidewalks, all common areas including any necessary stormwater management and retention/detention facilities. b. The HOA will also be responsible for enforcement of the neighborhood's deed Ordinance No. 2428, Page 6 of 10 restrictions/CC&R's in order to maintain the quality, character and long-term sustainability of the community. c. Documents establishing the HOA shall be submitted to the City for review/approval prior to or at the time of submission of the Final Plat or Replat application and shall be filed for record at Tarrant County prior to Final Plat approval and City acceptance of any project associated public improvements (whether on -site or off -site). L. Drainage a. Underground detention systems shall be allowed within this PD. b. All Drainage facilities shall be owned and maintained by the HOA. c. Design and maintenance details of any underground detention systems shall be submitted to the City for approval prior to construction. d. Except as amended in this section, all other design elements regarding drainage shall follow Sec 84-444 Stormwater Improvement Standards for the City of Euless Code of Ordinances M. Landscaping a. Plant materials used in conformance with the provisions of this section shall conform to the standards of the American Standard for Nursery Stock, or equal thereto. b. Grass seed, sod and other materials shall be clean and reasonably free of weeds and noxious pests and insects. c. Shrubs and hedges shall be a minimum of 2 feet in height when measured immediately after planting. d. Ground covers used in lieu of grass in hole and in part shall be planted in such a manner as to present a finished appearance and coverage must be 100% at time of installation. e. Grass areas must be solid sod. f. Open Space Park area (26,870 SF) shall contain at least 1 tree for every 300 Square feet or fraction thereof. g. Live Oak shade trees (minimum 3 caliper inches and 12-ft tall) are required to be planted 40-ft on center in HOA Lot B along Midway Dr and Fuller -Wiser Road. h. Residential front yards, where provided, shall contain 2 omamentaltrees (8-ft. tall at time of planting) per dwelling within the front yard and 8 shrubs per dwelling located within the flower bed. i. Grass, ground cover, shrubs and other landscape materials shall be used to cover all open ground. j. Landscaping requirements shall not be such as to cause visibility obstructions and/or blind corners at intersections. k. An automatic irrigation system is required to be installed for any new construction where landscape is installed. N. Fencing a. Fencing shall be required as follows: i. Fencing material must be stone, iron, brick, or wood privacy. 1. Iron fencing to be installed along Fuller -Wiser road North of the access road to the residential lots, see Concept Plan for location. 2. Wood privacy fencing to be installed on shared lot lines of the residential lots, see Concept Plan for location. 3. Brick fencing to be installed along outer lot lines located to the West, East and South of the residential lots, see Concept Plan for location. ii. Fencing must be at least six feet (6 ft) and no more than eight feet (8 ft) high. iii. Fencing must be constructed with metal or stone or brick posts. iv. Fencing to be installed between residential structures, along Fuller -Wiser Road and Midway Drive as well as between commercial structures and residential structures. O. Miscellaneous Residential Regulations a. Residential developments shall meet the following conditions: i. Must contain enhanced amenities such as a park, playground or similar.
