AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF EULESS, CHAPTER 84, UNIFIED DEVELOPMENT CODE,
AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON
APPROXIMATELY 2.267 ACRES IN THE MIDWAY SQUARE PHASE
THREE ADDITION, BLOCK E, LOT 1, LOCATED AT THE
NORTHEAST CORNER OF EAST MIDWAY DRIVE AND FULLER -
WISER ROAD, REZONING FROM NEIGHBORHOOD BUSINESS (C-
1) DISTRICT TO PLANNED DEVELOPMENT (PD) DISTRICT AS
DESCRIBED HEREIN AND ON THE ATTACHED EXHIBITS;
PROVIDING FOR DEVELOPMENT STANDARDS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR
VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public
hearing on July 1, 2025, in conjunction with Planned Development Case No. 24-01-
PD, and has rendered a recommendation to the City Council with respect to this case;
and
WHEREAS, the City Council has conducted a public hearing on August 12,
2025, considered the recommendation of the Planning and Zoning Commission, and
has determined that the proposed change is in the best interest of the general welfare
of the City of Euless.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS, THAT:
SECTION 1.
The official zoning district map of the City of Euless, Texas, being a part of
Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district
classification of approximately 2.267 acres in the Midway Square Phase Three
Addition, Block E, Lot 1, located at the northeast corner of East Midway Drive and Fuller -
Wiser Road, is changed from Neighborhood Business (C-1) District to Planned
Development (PD) District, as described herein and on the attached exhibits. Said
property described above shall be subject to all the safeguards and conditions set
forth within the attached exhibits or stipulated herein. Said exhibits shall be
applicable only to the property described in herein.
In the event of any conflict or inconsistency between these PD Standards and the
applicable City regulations, the terms and provisions of these PD Standards shall control.
In the event a development standard or regulation is not addressed herein, the standards
of Chapter 84 "Unified Development Code" and other City regulations apply. Local
building codes, life safety codes, and all applicable Federal, State and Local regulations
take precedence where any standard requires or recommends actions that are in conflict
with such codes and regulations.
SECTION 2.
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City
Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance
are severable, and if any phrase, clause, sentence, paragraph, or section of this
ordinance shall be declared unconstitutional by the valid judgment or decree of any court
of competent jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this ordinance
of any such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION 3.
PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of
the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be fined in accordance with Chapter 1, "General
Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such
violation shall be deemed a separate offense and shall be punishable as such
hereunder.
SECTION 4.
SAVINGS CLAUSE. All rights and remedies of the City of Euless are
expressly saved as to any and all violations of the provisions of the Euless Unified
Development Code applicable to the Property that have accrued at the time of the
effective date of this Ordinance; and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be prosecuted until
final disposition by the courts.
SECTION 5.
PUBLICATION. The caption, penalty clause, and effective date clause of this
ordinance shall be published in a newspaper of general circulation in the City of
Euless, in compliance with the provisions of Article II, Section 12 of the Euless City
Charter. Further, this ordinance may be published in pamphlet form and shall be
admissible in such form in any court, as provided by law.
SECTION 6.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and
after its passage, as provided by the Euless City Charter and the laws of the State of
Texas.

HERITAGE GARDENS AT MIDWAY — COMMERCIAL
LEGAL DESCRIPTION
BEGINNING at a 1/2-inch iron rod with a yellow plastic cap stamped "GEONAV" (hereinafter
referred to as "with cap") set at the northwest corner of said Lot 1 and on the east right-of-way
line of Fuller Wiser Road (80-feet wide public right-of-way), said corner being the northwest corner
of said Lot 1 and the beginning of a non -tangent circular curve to the left, having a radius if 95.00
feet, a chord bearing of North 81 degrees 22 minutes 08 seconds East, a chord distance of 27.81
feet;
THENCE Northeasterly, departing said east right-of-way line and along the north line of said Lot
1, through a central angle of 16 degrees 50 minutes 01 seconds, an arc distance of 27.91 feet to
a 1/2-inch iron rod with cap set for corner;
THENCE North 72 degrees 57 minutes 07 seconds East, continuing along said north line, a
distance of 441.51 feet to a 1/2-inch iron rod with cap stamped "RPLS 4050" found for the
northeast corner of said Lot 1, said corner being on the west line of Block G of the Enclave at
Bear Creek, an addition to the City of Euless as recorded in Document Number D216305354,

#24-01-PD — PLANNED DEVELOPMENT (PD) — HERITAGE GARDENS DEVELOPMENT
STANDARDS.
This is a proposal to rezone the subject property from C-1 Neighborhood District to PD Planned
Development District with a base zoning of C-2 Commercial Business District. The development
standards of the Planned Development zoning district shall be as defined by the Community Business
District (C-2) zoning under Section 84-111 of the Euless Unified Development Code as amended
unless modified by the design associated with the development as shown in the Concept Plan or as
follows:
A. Density: There shall be a maximum of two (2) Commercial Lots on the 2.267 acres within the
Heritage Gardens at Midway development.
B. Lot Sizes: The lot sizes with Heritage Gardens at Midway shall be as follows:

C. Setbacks and Lot Coverage: The setbacks and lot coverage criteria for Heritage Gardens at
Midway are as follows.

D. Open Space: There is one (1) open space area known as the Drainage Easement (Lot A), within
Heritage Gardens at Midway. The open space area will be fully maintained by all owners of Lots
1 and 2 of Heritage Garden at Midway.
E. Allowed Uses: Community Center and Parking Lot associated with a place of worship. A Community
Center may host a non-profit or charitable organization that provides ongoing activities for the general
benefit of people in the community such as educational enhancement, training and/or tutorial
experiences, art classes, general health, wellness and nutritional activities, recreational and social
activities. A Specific Use Permit is not required for the remote parking lot on Commercial Lot 1
because it is listed as an allowed us in the PD Development Standards.
F. Must have 100% brick and/or stone or glass pane on the front elevation and any elevation visible from
the front of a residential lot on Boon Court; and must have 75% brick and/or stone or glass pane on all
other exterior elevations.
G. Sidewalks and Trails: The required five-foot (5') wide sidewalk in Fuller -Wiser Road's right-of-way
(ROW) is existing and will be maintained by the City of Euless
H. Lot Grading: All lots shall be graded to meet the minimum city standards. Lots 1 and 2 shall be
graded to have an MFF (Min. Finish Floor) of 2.0' above the base flood elevation as these lots are
adjacent to the FEMA Floodplain.
I. Tree Preservation: Every attempt will be made to save existing quality trees on the site where feasible.
The following requirements shall apply:
a. Unless otherwise exempted by this ordinance, the following procedures shall apply to protect
any tree which will be preserved within this development.
b.All persons submitting construction plans shall ensure that such plans comply with the
requirements of this ordinance.
c. The following activities are prohibited within the limits of the critical root zone of any protected
tree subject to the provisions of this ordinance.

i. Material Storage: No storage or placement of materials intended for use in
construction or water materials accumulated due to excavation or demolition shall be
placed within the limits of the critical root zone of any protected tree.
ii. Equipment cleaning/Liquid disposal: No equipment shall be cleaned or other liquids,
including without limitation paint, oil, solvents, asphalt, concrete, mortar or similar
materials deposited or allowed to flow into the critical root zone of a protected tree or the
existing onsite creek.
iii. Tree Attachments: No signage, wire or other attachments, other than those of a
protective nature, shall be attached to any protected tree.
iv. Vehicular Traffic: No vehicular and/or construction equipment traffic or parking shall
take placed within the critical root zone of any protected tree other than on existing
street pavement. This restriction does not apply to single incident access within the
critical root zone for purposes of establishing the building pad and associated lot
grading, vehicular traffic necessary for routine utility maintenance, emergency
restoration of utility service, or routine mowing operations.
v. Impervious Paving: No paving with asphalt, concrete or other impervious materials
shall be placed within the limits of the critical root zone of a protected tree except as
otherwise allowed in this ordinance.
vi. Drip Line limits: No heavy equipment included but not limited to trucks, tractors,
trailers, bulldozers, bobcat tractors, trenchers, compressors, and hoists, shall be allowed
inside the drip -line of any protected tree on any construction site without prior written
approval of the City Building official.
d.The following procedures shall be followed on all types of construction projects (including
residential, land development, municipal/public domain projects):
i. Protective Fencing: Prior to the issuance of any building or earth disturbance permit,
or commencing consultation, the owner, contractor or subcontractor shall construct and
maintain, for each protected tree on a construction site, a protective fencing which
encircles the outer limits of the critical root zone or drip -line whichever is greater of the
tree to protect it from construction activity or in cases of heavily wooded sites, as
approved by the City Building official.
ii. All protective fencings shall be in place prior to commencement of any site work and
remain in place until all exterior construction activity at the site has been completed.
iii. Protective fencing shall be at least four (4) feet high, clearly visible, and shall have a
tree protection sign affixed to the fence every twenty (20) feet in such a manner to be
clearly visible to workers on the site.
iv. The use of orange vinyl construction fencing, or similar fencing, is generally permitted
only if there is no construction or vehicular activity within ten (10) feet of the fence. If
construction activity or vehicular activity is expected within ten (10) feet of the fence,
then the fence shall be constructed with Chain Link or a similar metal/wooden material
or semi -rigid vinyl tape fencing supported with a top support wire or equivalent support
material affixed to a metal or wooden post(s), all of which shall be a minimum of six (6)
feet high.
J. Drainage
a. Underground detention systems shall be allowed within this PD.
b.All Drainage facilities shall be owned and maintained by the Property Owner. Design and
maintenance details of any underground detention systems shall be submitted to the City for
approval prior to construction.
c. Materials used for underground detention shall be HDPE, CMP or Aluminum Ultra Flow (AUF)
by Contech.
d. Except as amended in this section, all other design elements regarding drainage shall follow
Sec 84-444 Stormwater Improvement Standards for the City of Euless Code of Ordinances.
K. Landscaping
a. Plant materials used in conformance with the provisions of this section shall conform to the
standards of the American Standard for Nursery Stock, or equal thereto.
b. Grass seed, sod and other materials shall be clean and reasonably free of weeds and noxious
pests and insects.
c. All trees planted in the front yard, side yard, parking area, along a street or alley shall be Live
Oaks (Quercus virginiana), Red Oak (Quercusrubra) or Crepe Myrtle (Lagertroemia) and shall

be of a minimum of 3 caliper inches when measured 6 inches above ground.
d. Shrubs and hedges shall be a minimum of 2 feet in height when measured immediately
after planting.
e. Ground covers used in lieu of grass in hole and in part shall be planted in such a manner as to
present a finished appearance and coverage must be 100% at time of installation.
f. Grass areas must be solid sod.
g. Landscaped Areas
i. All landscaped areas shall contain at least (1) one tree for every 300 Square feet or
fraction thereof.
ii. (2) two ornamental trees (at least 8' tall at time of planting) may be substituted for (1)
one required shade tree, but this substitution may not be made for more than 50% of the
required shade trees.
iii. Parking islands are required at the end of parking rows and will require (1) one large
shade tree (minimum 3 caliper inches and 12 feet tall).
iv. Public Rights of Way areas are to be landscaped with a minimum of four (4) ornamental
trees (8-ft. tall at time of planting) between the proposed fence line and property line
along Fuller -Wiser Road.
h. Residential lots and community center
i. Evergreen shrubs (at least 6 feet tall at planting) to be installed at 4 feet on -center
between the community center and all residential lots to the South and East.
i. Grass, ground cover, shrubs and other landscape materials shall be used to cover all open
ground.
j. Landscaping requirements shall not be such as to cause visibility obstructions and/or blind
corners at intersections.
k. An automatic irrigation system is required to be installed for any new construction where
landscape is installed.
L. Fencing
a. Fencing shall be required as follows:
i. Fencing material must be stone, iron, brick, or wood privacy.
1. Brick Fencing to be installed along property lines that border residential or
multifamily zoned areas.
2. Iron fencing to be installed along public rights of way and Drainage Easements.
ii. Fencing must be at least six feet (6-ft) and no more than eight feet (8-ft) high.
iii. Fencing must be constructed with metal or stone or brick posts.
iv. Fencing to be installed between residential structures, along Fuller -Wiser Road and
Midway Drive as well as between commercial structures and residential structures.

WHEREAS, the City of Eu-
less is a home rule city acting
under its charter adopted by
the electorate pursuant to
Article XI, Section 5 of the
Texas Constitution and Chap-
ter 9 of the Local Government
Code; and
WHEREAS, the City Council
of the City of Euless, Texas, in
order to protect the public
health and safety from loss of
life and property caused by
surface water overflows and
surface water stagnation, has
heretofore, pursuant to legis-
lative authority, established
a Municipal Drainage Utility
System within the municipal
boundaries of the City of Eu-
less, Texas, and, also pursuant
to legislative authority, estab-
lished fees, together with the
assessment, levying, and col-
lection thereof, to finance and
fund such Municipal Drainage
Utility System; and
WHEREAS, the City Council
finds it necessary to adjust the
rates for drainage charges lev-
ied against real property; and
WHEREAS, the City Council
finds that the basis for the
drainage charges set forth
herein is directly related to
drainage; and
WHEREAS, the City Council
finds that the classification of
benefited properties set forth
herein is nondiscriminatory,
equitable, and reasonable;
and
WHEREAS, the City Coun-
cil finds that the schedule of
charges set forth herein be-
low, and the rates upon which
such schedule of charges was
calculated, are equitable for
similar services in all areas of
the City of Euless, Texas.
NOW, THEREFORE, BE IT

The schedule of charges for
drainage services furnished or
caused to be furnished by the

lying within the city subject
to drainage charges under
V.T.C.A., Local Government
Code Chapter 552, Subchap-

1. Basic Drainage Charge.
The monthly drainage rate is
hereby established at $40.00
per impervious acre of land.
This rate may be modified
by the City Council from time
to time by a modification of
such basic drainage charge.
Impervious land area shall be
calculated by multiplying the
acreage of the parcel by the
runoff coefficient for the par-
ticular land use as specified in
subsection (3) of this section.
2. Single -Family Residential.
The monthly municipal drain-
age utility charge for each sin-
gle-family residential parcel is
hereby levied at $4.25.
3. Other. All other lots, tracts
and parcels of land within
the City of Euless shall be
charged on the basis of the
acreage contained in such lot,
tract or parcel of land, and the
use made of such property
in accordance with the fol-
lowing schedule of drainage
charges, which are hereby lev-
ied against all such remaining
lots, tracts and parcels of land

SECTION 2.
CUMULATIVE CLAUSE.
This Ordinance shall be cumu-
lative of all provisions of the
City Code and other ordinanc-

event the conflicting provi-
sions of the other ordinances
are hereby repealed.
SECTION 3.
SEVERABILITY CLAUSE. It
is hereby declared to be the
intention of the City Council
that the sections, paragraphs,
sentences, clauses, and
phrases of this ordinance are
severable, and if any phrase,
clause, sentence, paragraph,
or section of this ordinance
shall be declared invalid or
unconstitutional by the valid
judgment or decree of any
court of competent jurisdic-
tion, such invalidity or un-
constitutionality shall not
affect any of the remaining
phrases, clauses, sentences,
paragraphs, and sections of
this ordinance, since the same
would have been enacted
by the City Council without
the incorporation in this or-
dinance of any such invalid
or unconstitutional phrase,
clause, sentence, paragraph,
or section.
SECTION 4.
EFFECTIVE DATE. This
ordinance shall be in full force
and effect from and after its
passage and the rates adopted
herein shall be effective with
billing dates beginning on or
after October 1, 2025.

The Contractor will be se-
lected based on offering the
best value to the City.
Proposers must submit a
cashier's check, certified
check, or acceptable bidder's
bond with their proposal as
a guarantee that the Bidder
will enter into a contract for
the project with the Owner
within ten (10) days of Notice
of Award of the contract. The
security must be payable to
the City of Southlake in the
amount of five percent (5%)
of the proposal submitted.
Contractor must execute the
contract, bonds and certif-
icates of insurance on the
forms provided in the Con-
tract Documents. Contractors
for this Project must pay no
less than the prevailing wage
rates for the area established
by the Owner and included in
the contract documents.
Performance, Payment and
Maintenance Bonds, bound
to the City of Southlake are
required, each in an amount
of not less than one -hundred
percent (100%) of the con-
tract price, conditioned upon
the faithful performance of
the contract and upon pay-
ment of all persons supplying
labor or furnishing materials.
The City of Southlake re-
serves the right to adopt the
most advantageous interpre-
tation of the proposals sub-
mitted in the case of ambi-
guity or lack of clearness in
stating proposal prices, to re-
ject any or all bids or propos-
als, and/or waive formalities.
Bids or proposals may not be
withdrawn within ninety (90)
days from date on which bids
or proposals are opened.

cedures, and memorandums.
Qualifications will be ac-

AM (CST) until FRIDAY, SEP-
TEMBER 12, 2025, AT 5:00
PM (CST). Qualifications will
not be accepted after the dos-
ing date and time.

GUST 29, 2025, at 5:00 PM
(CST). All questions must be
submitted by the deadline via

no emails or phone calls will
