AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF
ORDINANCES FOR THE CITY OF EULESS, TEXAS; PROVIDING FOR
THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN;
PROVIDING A PENALTY FOR THE VIOIATI0N THEREOF; PROVIDING
FOR THE MANNER OF AMENDING SUCH CODE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING WHEN SUCH CODE AND
THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE City Council of the City of Euless:
Section 1
The Code entitled "Code of Ordinances, City of Euless, Texas," published in 1993,
by Municipal Code Corporation, consisting of Chapters 1 through 94, each
inclusive, is adopted.
Section 2
All ordinances of a general and permanent nature enacted on or before December
8, 1992, and not included in the Code or recognized and continued in force by
reference therein, are repealed.
Section 3
The repeal provided for in section 2 hereof shall not be construed to revive any
ordinance of part thereof that has been repealed by a subsequent ordinance that
is repealed by this ordinance.
Section 4
Unless another penalty is expressly provided, every person convicted of a
violation of any provision of the Code or any ordinance, rule or regulation
adopted or issued in pursuance thereof, shall be punished by a fine not exceeding
$2,000.00 for violations of all such rules, ordinances and police regulations
that govern fire safety, zoning, or public health and sanitation, including
dumping of refuse, nor exceeding $500.00 for all other violations. Each act of
violation and each day upon which any such violation shall occur shall constitute
a separate offense. The penalty provided by this section, unless another penalty
is expressly provided shall apply to the amendment of any Code section whether
or not such penalty is reenacted in the amendatory ordinance. In addition to the
penalty prescribed above, the City may pursue other remedies such as abatement
of nuisances, injunctive relief, and revocation of licenses or permits.
Section 5
Sec. 30 -4, "Animals ", subsection (c), of said Code of Ordinances, is hereby
amended to read as follows:
(c) Rabies vaccination (issuance of a receipt) .......... actual cost
Section 6
Sec. 34 -66, "Office created; appointment, removal; salary as fixed ", of said
Code of Ordinances, is hereby amended to read as follows:
Sec. 34 -66. Office created; appointment; removal.
The office of the fire marshal is hereby created. Such office shall
be filled by appointment of the fire chief. The fire marshal shall
be properly qualified for the duties of his office and shall be
removed only by the fire chief and shall be removed only for cause.
Section 7
Additions or amendments to the Code when passed in the form as to indicate the
intention of the City Council to make the same a part of the Code shall be
deemed to be incorporated in the Code, so that reference to the Code includes
the additions and amendments.
Section 8
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and
if any phrase, clause, sentence, paragraph or section of this ordinance shall be
declared invalid or unconstitutional by the valid judgment or decree of any court
of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections
of this ordinance, since the same would have been enacted by the City Council
without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
Section 9
This ordinance shall be in full force and effect from and after its passage and
publication as provided by the Euless City Charter and the laws of the State of
Texas.
PRESENTED AND PASSED on the first and final reading on the 13th day of April
1993, at a regular meeting of the City Council of the City of Euless, Texas, by
a vote of 7 ayes, 0 nays and 0 abstentions.
