HomeMy WebLinkAbout1110 04-27-1993 ORDINANCE NO. 1110 AN ORDINANCE AMENDING ORDINANCE NO. 347 IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE BELL RANCH TERRACE ADDITION; PROVIDING FOR A CHANGE OF ZONING FROM PD #819 (PLANNED DEVELOPMENT FOR SINGLE FAMILY ATTACHED AND MULTI-FAMILY DWELLING DISTRICT 13.1 U/A); CUD #154 (COMMUNITY DISTRICT) TO PD (PLANNED DEVULUMNT FOR SINGLE FAMILY DETACHED); PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning commission has conducted a public hearing on April 6, 1993, in conjunction with Zoning Case No. 92-18, and has rendered a reamnnendation to the City Council with respect to same; iKHMEAS, City Council has conducted a public hearing on April 27, 1993, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, TMUMUM, BE IT C MUN D BY THE CITY COaK IL OF THE CITY OF IIlLESS, TEXAS: SE MCN 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district classification of that 10.37 acres in Bell Ranch Terrace, Phase 3, for Tats 4-7, Block 10; Lots 1-14, Block 11; Lots 2-7, Block 12; Lots 1-9, Block 15; and Tots 1-2, Block 16, be changed from PD #819 (Planned Development for Single Family Attached and Mulit-Family Dwelling District 13.1 U/A) ; CUD #854 (Commimity Unit Development for Multi-Family Dwelling District 13.1 U/A) and R-TA (Single Family Attached District) to PD (Planned Development Single Family Detached Dwellings) , in accordance with the site plan bearing the City of Euless date stamp of April 20, 1993, and labeled as Exhibit "A" (attached hereto and made a part hereof) . Said property described in Ddiibit "A", pursuant to Section 7-1100 of the Mess Zoning Ordinance, shall be subject to all the safeguards and conditions set forth on said site plan described herein. Said site plan shall be applicable only to the property described herein. SETrP ON 2 SEVERABIIXry CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY Fat VICEMON. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two-thousand Dollars ($2,000) , and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. S C11CN 4 EFFECTTVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
