C[ADSE; PIWIDING A PENALTY; AND AN EFFEIMW DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public hearing on
May 18, 1993, in conjunction with Zoning Case No. 93-02, and has rendered a
recwmrexidation to the City Council with respect to same; and
FFMS, the City Council has conducted a public hearing on June 8, 1993,
considered the recommendation of the Planning and Zoning Commission, and has
determined that the proposed change is in the best interest of the general
welfare of the City of Euless.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCD:, OF THE CITY OF FiIIESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas, being a part
of Ordinance No. 347, be amended to read so that the zoning district classi-
fication of that 39.396 acres of land ]mown as Tracts 4B, 4A1, 4C, 6B1, 4AIA,
6B1a, 6A1, 6 and a part of Tract 3, of the J. Doss Survey, Abstract #441, more
Particularly described by Exhibit "A", date stamped May 6, 1993, (attached
hereto and made a apart hereof) now zoned R-1 (Single Family Detached District)
and is hereby changed to PD (Planned Development for commercial amusement) ; in
accordance with the development plan described in Exhibit "B" bearing the City
of Euless date stamp of May 6, 1993, (attached hereto and made a part hereof) .
Said property described above pursuant to Section 7-1100 of the Euless Zoning
Ordinance, shall be subject to all the safeguards and conditions set forth on
said site plan described herein. Said site plan shall be applicable only to the
property described herein.
SECTION 2
SEVERABMTY Cram. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses,
and phrases of this ordinance are severable; and if any phrase, clause, sen-
tence, paragraph, or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, or sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase.
SHTICK 3
PENALTY FOR VICIATICN. Any person, firm, or corporation violating the terms and
provisions of this ordinance, or the amerxtrents to the ccmprehensive zoning
ordinance of the City of Euless hereby made, shall be deemed guilty of a
misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount
not to exceed TWO-Thousand Dollars ($2,000) and each day such violation shall
continue or be permitted to exist shall constitute a separate offense. Any
amendment to the general penalty provision found in the comprehensive zoning
ordinance of the City of Euless, as amended, shall be deemed to automatically
amend this penalty provision in conformity therewith.

EFFE]CTTVE OATS. This ordinance shall be in full force and effect from and after
its passage, as provided by the Euless City Charter and the laws of the State of
Texas.
PMOUED AND PASSED CN FIRST AND FINAL READING at a regular meeting of the
Euless City Council on the 8th day of June 1993, by a vote of 7
ayes, 0 nays, and 0 abstentions.
