HomeMy WebLinkAbout1120 09-14-1993ORDINANCE NO. 1120 AN ORDINANCE OF THE CITY OF EULESS, TEXAS, CREATING THE EULESS MUNICIPAL COURT OF RECORD NUMBER 1; FINDING THAT THE FORMATION OF SUCH COURT IS NECESSARY TO PROVIDE A MORE EFFICIENT DISPOSITION OF CASES ARISING IN THE CITY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Euless, Texas, after study, finds and determines that the formation of a municipal court of record is necessary to provide a more efficient disposition of cases arising in the City of Euless; and WHEREAS, the City Council desires, by this ordinance, to create said municipal court of record in the City of Euless. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. That there is hereby created within the City of Euless, Texas, a municipal court of record, which hereafter shall be designated and known as the Euless Municipal Court of Record Number 1 °. Said Municipal Court of Record Number 1 shall be officially created and shall commence operations on October 1, 1993. II. That the presently existing and operating municipal court in the City, which is not a court of record, shall cease operations on October 1, 1993, at the time that the Euless Municipal Court of Record Number 1 is created and commences operations. All records of the Euless Municipal Court shall, at that time, become records of the Euless Municipal Court of Record Number 1. III. The City Council hereby adopts the provisions of House Bill 2841, enacted by the 73rd Legislature of the State of Texas, and codified as Subchapter X of Chapter 30 of the Texas Government Code, to govern operations and procedures in the Euless Municipal Court of Record Number 1. IV. That, pursuant to the provisions of Subchapter X of Chapter 30 of the Texas Government Code, as amended, the City Council hereby provides that, in lieu of providing a court reporter at trials, the proceedings in the Municipal Court of Record Number 1 shall be recorded by a good quality electronic recording device. V. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas; provided, however, that the Municipal Court of Record hereby created shall actually come into existence and begin operations on October 1, 1993. PRESENTED AND GIVEN FIRST READING and approved at a regular meeting of the Euless City Council on the 14th day of September, 1993; by a vote of 5 ayes, 0 nays, and 0 abstentions.
