AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE
ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE
CITY OF EULESS ZCNING DISTRICT MAP ON CERPAIN PROS M OUP
OF THE SOLOMON HUITT SURVEY AND THE RAY SHELTON SUBDIVISICN;
PROVIDING FC R A CHANGE OF 7MM FROM MULTI-FAMILY DISIRICIS
(R-3, R-4, R-5 AND CUD 1675) TO PLANNED DEVEC[&tffidP FCR
SINGLE FAMILY DETACHED, SMALL TUTS (PD); PROVIDING FC2 A
SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND AN EFFECTIVE
DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public hearing on
October 19, 1993, in conjunction with Zoning Case No. 93-04, and has rendered a
recommendation to the City Council with respect to same; and
WHEREAS, the City Council has conducted a public hearing on October 26, 1993,
considered the recommendation of the Planning and Zoning Commission, and has
determined that the proposed change is in the best interest of the general
welfare of the City of Euless.
NOW, THEREKIRE, BE IT CROAIIM BY THE CITY CO[ ELL OF THE CITY OF ESIIFSS, TEXAS:
SBCPICN 1
THAT the official zoning district map of the City of Euless, Texas, being a part
of Ordinance No. 347, be amended to read so that the zoning district classi-
fication of that 22.66 acres ]mown as Tracts 3, 4 and 5 of the Ray Shelton
Subdivision, from its present zoning of R-5 and CUD #675 (R-3 and R-4
Multi-Family Dwellings) and 13.04 acres out of the Solomon Huitt Survey, A-705,
presently zoned R-3 and R-4 (Multi-Family Dwellings at 12 and 16/UA), more
particularly described by Exhibit "A", (attached hereto and made a apart hereof)
is hereby changed to PD (Planned Development for Single Family Detached, small
lots) , in accordance with the detailed site plan bearing the Euless date stamp
of November 4, 1993, and attached hereto as Exhibit "A".
Said property described above pursuant to Section 94-566 of the Euless Code of
Ordinances, shall be subject to all the safeguards and conditions set forth on
said site plan described herein. Said site plan shall be applicable only to the
property described herein.
SEMON 2
SEVERABII.TTY CLAUSE. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses,
and phrases of this ordinance are severable; and if any phrase, clause, sen-
tence, paragraph, or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, or sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase.
SECPICN 3
PE{F,M FOR VIOLATION. Any person, firm, or corporation violating the terms and
provisions of this ordinance, or the amerxhnents to the comprehensive zoning
ordinance of the City of Euless hereby made, shall be deemed guilty of a
misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount
not to exceed Iwo-Ihousand Dollars ($2,000) and each day such violation shall
continue or be permitted to exist shall constitute a separate offense. Any
amendment to the general penalty provision found in the comprehensive zoning
ordinance of the City of Euless, as amended, shall be deemed to automatically
amend this penalty provision in conformity therewith.
SEMCN 4
EFFDCFiVE DATE. This ordinance shall be in full force and effect from and after
its passage, as provided by the Euless City Charter and the laws of the State of
Texas.

Euless City Council on the ' 9th day of November 1993, by a vote of 5
ayes, 1 nays, and 0 abstentions.
