AN ORDINANCE REPLACING ORDINANCE NO. 636, AUTHORIZING,
RATIFYING AND CONFIRMING THE PLACING AND MAINTENANCE OF
ALL LOCAL TRAFFIC CONTROL SIGNS NOW EXISTING AT THE
VARIOUS INTERSECTIONS AND LOCATIONS WITHIN THE CORPORATE
LIMITS OF THE CITY OF EULESS, TEXAS; PROVIDING FOR
FUTURE PLACING AND MAINTENANCE OF TRAFFIC CONTROL SIGNS
AS DIRECTED BY THE CITY COUNCIL OF SAID CITY; PROVIDING
A PENALTY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
FOR PUBLICATION OF NOTICE AND AN EFFECTIVE DATE.
WHEREAS, Article III, Section 31 of the V.A.C.S. 6701d, Uniform Act
Regulating Traffic on Highways, provides that local authorities may erect traffic
control signs in their respective jurisdictions; provided all such traffic
control devices conform to Texas Department of Transportation's manual and
specifications.
Now, therefore, be it ordained by the City Council of the City of Euless,
Texas:
SECTION I
The City Council of the City of Euless, Texas, hereby authorizes, ratifies
and confirms the placing and maintenance of all traffic control signs now
existing in the corporate city limits of Euless, under their authority.
The traffic control signs on State Highway right -of -way are not under the
authority of the City of Euless.
SECTION II
The City Council of the City of Euless, Texas, further authorizes the
future placing and maintenance of all traffic control signs at or under the
direction of the City Engineer, said signs to conform to the Texas Manual of
Uniform Traffic Control Devices, adopted by the Texas Department of
Transportation of the State of Texas, and a record shall be made of the placement
of each such traffic control sign, such record to be maintained in the office of
the City Engineer.
SECTION III
Wherever and whenever any such traffic control signs have been placed, it
shall be unlawful for the driver or operator of any vehicle to fail to comply in
obedience thereto and such driver or operator who has complied, as required,
shall be subject to -the usual right -of -way rules described by law.
SECTION IV
Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any
sum not to exceed five hundred dollars ($500.00).
SECTION V
That it is hereby declared to be the intention of the City Council that in
the event any paragraphs, clauses, sentences, phrases or sections of this
ordinance shall be declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs or sections of this
ordinance.
SECTION VI
This ordinance shall become effective upon and after final passage and
publication as provided by the Euless City Charter and the laws of the State of
Texas.
PRESENTED AND PASSED ON THE FIRST AND FINAL READING on the 22nd day of
February 1994, at a regular meeting of the City Council of the City of
Euless, Texas by a vote of 7 ayes, o nays, and o abstentions.
