HomeMy WebLinkAbout1129 02-22-1994ORDINANCE NO. 1129 AN ORDINANCE OF THE CITY OF EULESS, TEXAS AMENDING CHAPTER 86, "UTILITIES," SECTION 86 -13 OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS, AS AMENDED, TO MODIFY THE C1TY5 REGULATIONS REGARDING THE DISCHARGE OF WATER FROM SWIMMING POOLS IN THE CITY; AMENDING SAID SECTION 86- 131(2) OF THE EULESS CODE OF ORDINANCES TO REQUIRE NEW SWIMMING POOLS TO BE CONSTRUCTED WITH A BACKWASH LINE THAT DISCHARGES INTO THE SANITARY SEWER SYSTEM; PROVIDING A PENALTY CLAUSE; PROVIDING A SEVERABILTTY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. - WHEREAS, Section 26.121 of the Texas Water Code prohibits the discharge of swimming pool water into a municipal storm sewer system; and WHEREAS, Section 26.177 of the Texas Water Code requires cities with a population of 5000 or more to establish a water pollution control and abatement program; and WHEREAS, the City of Euless presently has an ordinance which requires the discharge of swimming pool water into the municipal storm sewer system; and WHEREAS, in order to protect the health, safety and welfare of current and future citizens of the City of Euless, Texas; the City Council of the City of Euless finds that Section 86 -131 (2) of the City Code of Ordinances shall be amended to comply with Sections 26.121 and 26.177 of the Texas Water Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. That Chapter 86, "Utilities," Section 86 -131 (2) of the Code of Ordinances of the City of Euless, Texas, as amended, be hereby amended to hereafter be and read as follows: (2) No person shall discharge or cause to be discharged any stormwater, groundwater; roof runoff, subsurface drainage or drainage from downspouts, yard drains, yard foundations and ponds, or lawn sprays into any sanitary sewer except as provided by this Code. Unpolluted industrial water, such as water drains, blow -off pipes or cooling water from various equipment shall not be discharged into sanitary sewers. All new swimming pools shall be required to have a backwash line that discharges into the sanitary sewer system. IL Penalty Clause. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined as provided in Chapter I, Section 1 -12 of the Code of Ordinances. FR1A Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. IV. Saving Clause. That Chapter 86 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. V. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
