The driver of a vehicla may nvertnke and p,ss upon the riglit of another vehicle only under the following conditions: (1) Vihcn the vehicle overtaken is n--.king or abcut to make a left turn; (2) U pon r. strc:tt or highway with unobstructed pavement not occupisd by prrked vehicles of sufficient width for two (2) or more lines of ri.cving vehicles in each dir-.etinn. (3) Upon a nne -way , or upon ariy roadway :n which traffic is restricted to one direction of movement, whether the roadway is free frog, obstruction r.nd of sufficient width for two (2) or more lines of moving vehicles. (b) The driver of a vehicle may overtake -.-id pass another vehicle upon the right only under conditions permitting such movement In safety. In no event shall such movement be made by driving off the pavement or main traveled portion of the roadway. Section 27: Limitc,ti;ns on Overtaking on the Loft - -No vehicle shall be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same directi -n un- less such left side is clearly visible, and is free of oncoming traffi for sufficient distcnce ,head to permit such overtaking c.nd passing to be completely made with:ut interferring with the safe operation of any vehicle approaching from the opposite direction or any vehicle overtaken. In Lvcrj event the overtaking vehicle must return to the right -hand side of the roadway before doming within one hundred (100) feet of any vehicle approaching from the opposite direction. Section 28: Further Limitations on Driving to Left of Center of Rordway -- (A) No vehicle shall at any time be driven to the left side of the roadway under the following conditions.: 1. When approaching within one hundred (100) fact of any bridge, viaduct or tunnel. 3. Section 36: Turning Movements and Required Signals - -(a) No person shall turn a vehicle at an interscctirn unless the vehicle is in proper position upon the roadway as required in Secti.r. 34, or turn a vehicle tc enter a prove.te road or driveway or - therwise turn a vehicle from a direct course or mt,ve right or left upon a rot_dway unless end until suc'nm- vement can be made with safety. No person shall so turn any vehicle without giving an appropriate signal in the manner hereinrfter provided in th4 event any other traffic may be affected by such movement. (b) L signal of intention to turn right or left when required shall be given continuously during not less than the last ne 4undred (100) feet traveled by the vehicle before turning. (b) 1.11 vehicles used for the trnnspnrtatir)n of nunils to and /or from any ehhool or college shall have a sign on the fr;,nt and rear and on each side of said vehicle, showing the words "School Bus" and said words shall be plainly rendnble in letters not less than eight (8) inches in height and the wards "School Bus" shall be removed or covered when the vehicle is not in use as a school bus. -22- Section 75: Mufflers, Preventinn cif i+, ' -- (, ) Every m,t.,r vehicle shall at all times be equipped wit a muffi.(.r in g :)�d w,,rking order and in eenstant operatics to prevent excessive or unusual noise and annoying smoke and no person shall use a muffler, cut -out, by -pass, or similer device upon a motor vehicle ona hi -hway. (b) The engine and power mechanism of Every motor vehicle shall be so equipped and adjusted as to prevent the escape -)f excessive fumes or smoke. Section 76: Driving Through Funeral or Other Proccssion:--No driver of a Vehicle shall drive between the vehicles cnmprisin, a funeral ar other authorized procession while they are in motion and when such vehicles tire conspicuously design,, -ted as required in this ordinance. This provision shall not npnly to at intersections where traffic is controlled by traffic - control siEnals or police officers. Section 77: Drivers in a Procession:- -Each driver in a funeral or other procession shall drive rs near to the ribht hand edge cf the roadway as practical and shall follow the vehicle ahead as close as is practical and safe. Section 78: Funeral Processions to be Identified: - -L funeral composed of a procession of vehicles shall be identified as such by the dis- play upon the outside of ecch vehicle of a pennant of other identifying insignia or by such other method as may be determined and designated by the traffic division. Section 79: Shen Permits Required f.,r Parades and Pr.,6(.ssions: - -No funeral, procession or parade containing 200 or more persons or 50 or more vehicles, excepting the forces cf the United States Lrmy or Navy, the military forties of this State, and forces of the Police and Fire Dopprtment, shall necupy, march, or prncccd al ng any street except in accordance with a permit issued by the Chief �f Police and such other regul ^tians as Pre set forth herein which may anply. Section 80: Limitations on Backing--The driver of a vehicle shall not back the sane unless such movement can be made with reasonable safety and without interferring with Other traffic. Section 86: Displaying Advertising : - -It shall be unlawful for anyone to operate any vehicle on any street within the corporate limits of the City of Euless for the primary purpose of displaying• advertis- ing. Section 87: Opening of Vehicle Doors: - -It shall be unlawful for the wwner operator or any other person to open the door of a vehicle or to step from a parked vehicle into a roadway or sidewalk in such a manner as to interfere with or impede the progress of any vehicle or pedestrian. ARTICLE XLL. PENALTY, SAVINGS CLAUSE:, REPEL' LING CLAUSE, DECL.RING LN EMERGENCY. Section 88: Any person who shall violate any of the provisions of this ordinance shall be deemed guilty cf a misdemeanor and upon conviction shall be fined not less than one 0$1.00) Dollar nor more than Two H undred ($200.00) Dollars. Section 89: Payment of fine at Traffic Violations Bureau: - -W) Any person who has received any notice t- appear in answer to a traffic charge under this chapter may, within the time specified in the notice, appear at the traffic violati °ns bureau and answer the charge set forth in such notice by 147ing a prescribed fine, and, in writing pleading guilty to the charge, wriving a herring in curt and giving power of attorney to the person in charge of the bureau to make such a Plea and nay such fine in court. (b) Any person who has been guilt* of three or more traffic violrtions, except as otherwise provided znthis title, within the preceding twelve months shall not be permitted to Day a fine at the traffic violations bureau, and he must make statutory bail for appearance in epurt.
