AN ORDINANCE AMENDING THE EULESS CODE OF ORDINANCES,
CHAPTER 30, SECTION 30 -16 "SOLID WASTE COLLECTION" TO
PROVIDE FOR REVISED SOLID WASTE COLLECTION FEES; AMENDING
ORDINANCE CODE CHAPTER 66, SECTION 66 -1; "DEFINITIONS ",
SECTION 66 -2 "SCOPE OF REFUSE COLLECTION WORK ", AND 66-4
"CONTRACTOR'S OPERATION" BY REVISING THE DEFINITIONS OF
"BUNDLE OR BOXED BUNDLE" AND 'TREES ", AND DELETING FROM
SECTION 664 THE DEFINITIONS OF "SPECIAL BRUSH COLLECTION"
AND 'TIRES, BATTERIES, ETC.", AND REVISING THE DEFINITIONS OF
"QUANTITY" AND "COMMERCIAL REFUSE" IN SECTION 66 -2, AND
REVISING (a)'HOURS OF OPERATION ", (b) "HOLIDAYS" (c-1) "SERVICE
COMPLAINTS - CONTRACTOR ", AND (c-4) 'COMPLAINT PROCEDURES"
OF SECTION 66 -4; PROVIDING A SEVERABILITY CLAUSE AND
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
Section 1.
Chapter 30, "FEES ", Section 30 -16, entitled "Solid Waste Collection" is partially amended
as follows:
Service Fees to Customers

The Section titled "Standard Commercial Rates" is hereby deleted.

The "On Call Service" charge chart is hereby deleted.
Section 11.
Chapter 66 "SOLID WASTE ", Section 66 -1, titled "Definitions ", only the following definitions
are amended as follows:
Bundle or boxed bundle is amended to read, 'Tree, shrub or brush trimmings securely tied
together forming an easily handled package not exceeding four (4) feet in length or fifty
(50) pounds in weight."
Trees is amended to read, 'Trees and tree trimmings smaller than four (4) feet long
bundles may be accommodated during regular curbside pickup services. Cost for pick -up
of trees larger than the four (4) foot specifications shall be set by the contractor upon site
visit and evaluation of size."
Section Ill.
Chapter 66 "SOLID WASTE ", Section 66 -2 titled "Scope of Refuse Collection Work ", only
the following paragraphs shall be amended as follows:
The definitions of "Special Brush Collection" and "Tires, Batteries, etc." are hereby deleted.
Section 66 -2(d) Quantity shall be amended to read as follows:
Quantity. Under the title of 'Take All Service" the contractor shall be required to pick up
all rubbish, refuse and construction debris generated from a residential unit provided that
same is property prepared, bagged and stored for collection in garbage containers.
Rubbish, construction debris and /or bulky wastes which are not contained in garbage
containers but can be lifted and loaded by two (2) employees in no more than five (5)
minutes shall also be collected upon the regular residential collection frequency.
Contractor shall also be required to pick up all brush and trees during the regular collection

frequency provided that same are prepared and stored for collection in a bundle or boxed
bundle not to exceed four (4) feet in length. Rubbish, construction debris, or bulky wastes
which are not contained in garbage containers and which cannot be lifted and loaded by
two (2) employees in five (5) minutes, or brush and trees that are not prepared and placed
for collection in a boxed bundle or bundle, shall be collected and disposed of by contractor
provided contractor receives service charge from the requesting customer based on scale
of cost as stated in Contract.
Section 66 -2(f) Commercial Refuse shall be amended to read as follows:
Commercial Refuse. Every commercial unit shall have a commercial container or
containers of a size sufficient to contain all the rubbish, refuse, brush, bulky waste,
construction debris, trees and other refuse generated upon the premises and to avoid
congregation of flies, rodents, scavengers, unnecessary odor and to prohibit unsightly
accumulation of such refuse materials or fire hazards. Contractor agrees to make
commercial containers of adequate size available upon request to any commercial unit
within the corporate limits of City. The commercial containers provided by the contractor
shall be equipped with suitable operable covers to prevent blowing or scattering of refuse
(except for roll -off containers); shall be maintained in good order, appearance and in a
sanitary condition; shall be of uniform color or color scheme; and shall be clearly marked
with the contractor's name and telephone number. Any remaining commercial containers
with the name of the previous contractor servicing City should be changed within 90 days
of signing contract. Any damages to screening structures caused by the contractor will be
repaired within fourteen (14) days of damage incurred.
Section IV.
Chapter 66 "SOLID WASTE ", Section 66-4 titled "Contractor's Operation" only the following
paragraphs shall be amended as follows:
(a) Hours of Operation. Collection from residential units shall not start before 7:00 a.m.
or continue after 6:00 p.m. Collection from commercial units shall not start before
3:00 a.m., ensuring that collection at anytime before 7:00 a.m. from commercial
units is not in proximity to residential living areas, and does not continue after 6:00
p.m. on the same day.
(b) Holidays. The following shall be holidays for purposes of this article:
Thanksgiving Day, Christmas Day, New Years Day, Memorial Day, Independence
Day, and Labor Day.
(c -1) Service Complaints - Contractor. All service complaints shall initially be directed to the
contractor and shall be resolved by the end of the next business day. The
contractor shall supply all copies of all complaints on a form approved by the City
indicating the disposition of each complaint. The form shall indicate the day and
hour on which the complaint was received and the day and hour at which the

complaint was addressed and resolved.
(c-4) Complaint Procedures. The contractor shall provide the City with information
regarding complaint procedures, rules and regulations and day(s) of collection, etc.
Information is to be in the form of printed material distributed by the contractor and
updated or renewed by the contractor as needed or as requested by the City. The
sanitation of all commercial trash receptacles will be reported to the City upon
completion by the contractor on a biannual basis.
Section V.
SAVING CLAUSE. That Chapter 30, "FEES" and Chapter 66, "SOLID WASTE ", of the
Code of Ordinances, City of Euless, Texas, as amended herein, shall remain in full force
and effect, save and except as amended by this ordinance.
Section VI.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall
be declared invalid or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this
ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or
section.
Section VII.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage and publication as provided by the Euless City Charter and the laws of the State
of Texas.
PRESENTED AND APPROVED ON THE FIRST AND FINAL READING on the 28th day
of February, 1995, at a regular meeting of the City Council of the City of Euless, Texas,
by a vote of 7 ayes, 0 nays and 0 abstentions.
