HomeMy WebLinkAbout1178 DENIEDORDINANCE NO. 1178 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, EXEMPTING FROM AD VALOREM TAXES RESIDENTIAL PROPERTY OWNED BY THE UNITED STATES AND USED TO PROVIDE TRANSITIONAL HOUSING FOR THE INDIGENT UNDER A PROGRAM OPERATED OR DIRECTED BY THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE WHEREAS, Section 11.111 of the Texas Property Tax Code permits a city to exempt from ad valorem taxes property owned by the United States or an agency of the United States and used to provide transitional housing for the indigent; and WHEREAS, the City Council of the City of Euless, Texas, desires to exempt from ad valorem taxation certain qualified property pursuant to the provisions of Section 11.111 of the Texas Property Code; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,TEXAS: There is hereby exempted from ad valorem taxes residential property owned by the United States or an agency of the United States and used to provide transitional housing for the indigent under a program operated or directed by the United States Department of Housing and Urban Development which properties are identified on Exhibit "A" attached hereto and shall apply only to ad valorem taxes levied for 1995. This exemption is established pursuant to the provisions of Section 11.111 of the Texas Property Tax Code or any successor statute. The total exemption granted for all houses shall not exceed two thousand dollars for any one tax year. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED on first and final reading on the 13th day of June, 1995, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of ayes, nays, and abstentions.
