AN ORDINANCE AMENDING CHAPTER 30, "FEES ", SECTION
30 -4 "ANIMALS "; SECTION 30 -15 "FIRE PREVENTION CODE ";
SECTION 30 -34 "WATER DEPOSITS "; SECTION 30 -39
"MISCELLANEOUS FEES "; SECTION 30 -39 "PLANNING AND
ZONING FEES "; SECTION 30 -40 "SUBDIVISIONS "; AND
ADDING SECTION 30 -44 "DANGEROUS BUILDING /STRUCTURE
ABATEMENT FEES" OF THE CODE OF ORDINANCES, CITY OF
EULESS; TO REVISE THE FEES LISTED IN SAID SECTIONS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Euless, Texas, after study, finds
that certain fees contained in the current fee structure do not provide
adequate reimbursement to the City of Euless for the goods and services
furnished in return for such fees; and
WHEREAS, the City Council further finds that the fees contained in this
ordinance provide such adequate reimbursement.
NON, THEREFORE, BE IT ORDAINED by the City Council of the City of Euless,
Texas:
SECTION I
That Section 30 -4 "Animals" of Chapter 30 "Fees" of the Code of
Ordinances, City of Euless, Texas, as amended, be hereby amended as
follows:
Sec. 30 -4. Animals.

follows:

Ordinances, City of Euless, Texas, as amended, be hereby amended as
follows:

SECTION V
That Section 30 -39 "Planning and zoning fees" of Chapter 30 "Fees" of the
Code of Ordinances, City of Euless, Texas, as amended, be amended to
hereafter be and read as follows:
Sec. 30 -39. Planning and zoning fees.
The schedule of fees for zoning shall be as follows:
(1) Applications for change of zoning:
a. Planned development (PD) $500.00 + $10.00 per acre
b. All zoning change requests other than "PD"
containing a land area between:
1. Zero to one -half acre $125.00
2. One -half to five acres 250.00
3. Five to 25 acres 500.00
4. Over 25 acres 500.00
Plus $10.00 per acre over 25 acres
(2) Applications for specific use permit containing site
area (including parking) between:

SECTION VII
That Section 30 -44 "Dangerous buildings /structure abatement fees" of Chapter
30 "Fees" of the Code of Ordinances, as amended, be added to read as follows:

Severability Clause. That it is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence, paragraph
or section of this ordinance shall be declared invalid or unconstitutional by
the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation
in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION IX
Saving Clause. That Chapter 30 of the Code of Ordinances, City of Euless,
Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.

SECTION X
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Euless City Charter and the laws
of the State of Texas.

of the Euless City Council on the 27 day of June 1995, by a vote of
—7 ayes, 0 nays, and 0 abstentions.
